About approval of the Regulations on open banking in Ukraine

According to Articles 7, of 15, 56 Laws of Ukraine "About the National Bank of Ukraine", Articles 5, of 6, of 10, of 31, of 53, of 54, of 55, 76 Laws of Ukraine "About payment services", for the purpose of settlement of work of open banking in Ukraine the Board of the National Bank of Ukraine decides:

1 Approve the enclosed Regulations on open banking in Ukraine (further - the Provision).

2. Predostavitelyam of payment services on servicing of accounts to bring the activities into accord with requirements of the Provision within five months from the date of entry into force of this resolution.

3. To technological operators of payment services, data on which are entered in the Register of payment infrastructure (further, – the Register), in case of intention to provide services of the technological operator of payment services to payment service providers on servicing of accounts and/or payment service providers on initiation of payment transaction, and/or to payment service providers on provision of data from accounts within open banking to approve with the National Bank of Ukraine of condition and procedure for provision of such services according to requirements and according to the procedure, 94 Sections VIII of the Regulations on registration of payment service providers, members of payment service providers and technological operators of payment services approved by the resolution of Board of the National Bank of Ukraine of September 26, 2022 No. 208 determined in Items 93, (with changes).

4. To legal entities (except banks) in case of intention to provide services of the technological operator of payment services to payment service providers on servicing of accounts and/or payment service providers on initiation of payment transaction, and/or to payment service providers on provision of data from accounts within open banking to file to the National Bank of Ukraine documents for registration and entering into the Register of information about them as the technological operator of payment services and to approve with the National Bank of Ukraine of condition and procedure for provision of such services according to requirements and according to the procedure, determined in Item 92 of the Section VIII of the Regulations on registration of payment systems, members of payment service providers and technological operators of payment services approved by the resolution of Board of the National Bank of Ukraine of September 26, 2022 No. 208 (with changes).

5. To department of payment systems and innovative development (Andrey Podderegin) after official publication to inform participants of the payment market information on adoption of this resolution.

6. The National Bank of Ukraine does not constitute the document in which violation is fixed, and does not apply to payment service providers on servicing of accounts of corrective actions for violation of requirements for providing with payment service providers on servicing of accounts of continuous access to accounts of the users to predostavitel of non-financial payment services and the banks which acquired the right to provision of non-financial payment services, and requirements for setup by payment service providers for servicing of accounts of specialized interfaces if such violations were within 12 months from the date of entry into force of this resolution.

7. To impose control over the implementation of this resolution on the vice-chairman of the National Bank of Ukraine Alexey Shaban.

8. The resolution becomes effective since August 1, 2025, except the subitem 5 of Item 30 and Item 31 of the Section III of Provisions which become effective since August 1, 2026.

Regulations on open banking in Ukraine

I. General provisions

1. This Provision is developed according to the laws of Ukraine "About the National Bank of Ukraine" and "About payment services".

2. Terms in this Provision are used in such value:

1) the active consent of the user of payment services - the consent of the user of payment services (further - the user) on the provision of data from accounts confirmed with the strengthened authentication and operating;
