Chapter I. Sphere of regulation. Concepts and departures

Article 1. Subject and sphere of regulation

(1) This law establishes the basic provisions concerning:

a) common and specific purposes which shall be implemented by means of the financial support provided by National fund of development of agricultural industry and the rural zone (further - NFRSKHSM) promoting implementation of policy in the field of agricultural industry;

b) institutional structure of NFRSKHSM;

c) general requirements and types of interventions by means of which common goals, and the accompanying financial measures shall be implemented;

d) financings, management and monitoring of policy in the field of agricultural industry, in particular the rule of financing of expenses, management systems and control, and also procedures of financial check and observance of payments;

e) The strategic program of policy in the field of agricultural industry (further - SPPSH) by means of which the strategy of intervention, indicators, conditions of intervention are established and in which financial resources and sources of financing according to specific purposes and the revealed requirements are specified;

f) monitoring, reporting, assessment and ensuring transparency of SPPSH.

(2) This law regulates the financial support provided to NFRSKHSM for the interventions specified in SPPSH approved by the Government for the five-year period.

Article 2. Common goals of policy in the field of agricultural industry

According to the policy purposes in the field of agricultural industry and for maintenance of functioning of the agricultural market and fair conditions of the competition between farmers the financial support provided to NFRSKHSM is intended for further improvement of sustainable development of agricultural industry, the agrofood sector and the rural zone, and also for assistance of realization of the following common goals:

a) promotion of the intellectual, competitive, viable and diversified agricultural sector ensuring long-term food security;

b) support and strengthening of environmental protection, including biodiversity, and actions in the field of climate, and also assistance to achievement of the nature protection and climatic purposes of the Republic of Moldova, including the undertaken obligations within the Parisian agreement ratified by the Law No. 78/2017;

c) strengthening of social and economic structure of the rural zone;

d) ensuring transposition and progressive implementation of the European Union law in the field of agricultural industry, development of the rural zone and safety of foodstuff.

Article 3. Specific purposes of policy in the field of agricultural industry. Indicators

(1) Achievement of common goals is performed by means of the following specific purposes:

a) support of stability of the income of holdings and stability of the agricultural sector for expansion of variety of agricultural products and ensuring long-term food security, and also for ensuring economic stability of farm-production;

b) support of focus on the market and increase in competitiveness of holdings both in short-term, and in the long term, including at the expense of priority of researches, innovations and digitalization;

c) improvement of the situation of farmers in chain of creation of value added;

d) assistance to mitigation of the consequences of climate change and adaptation to them, and also encouragement of energy use from renewable sources;

e) assistance to sustainable development and effective management of natural resources, such as water, the soil and air, including by decrease in dependence on chemicals;

f) attraction and support of young farmers and the beginning farmers, and also assistance to development of steady holdings in the rural zone;

g) assistance of employment of the population, to the economic growth, gender equality, including participation of women in agricultural industry, assistance of social integration and to local development in the rural zone, including bioeconomy of the closed cycle;

h) improvement of response of agricultural industry to requirements of society for food and health, including concerning the high-quality, safe and nutritive products made by steady method concerning minimization of food wastes, and also improvement of wellbeing of animals and the prevention of development of stability to antimicrobic medicines;

i) development of product competitiveness with value added;

j) ensuring supply with food, high-quality, safe, nutritive and competitive at the price.

(2) the Purposes provided by part (1), promotions of innovations and digitalization in agricultural industry and the rural zone, and also by encouragement of their implementation by farmers, improvement of access to researches, innovations, knowledge sharing and training shall be added and interconnected with the end-to-end purpose of upgrade of agricultural industry and development of the rural zone by promotion of knowledge and exchange of them.

(3) Goal achievement, specified in Article 2 and in parts (1) and (2) this Article, it is evaluated on the basis of the indicators of realization, result and impact provided in SPPSH.

Article 4. Concepts

For the purposes of this law the following concepts mean:

1) agricultural activities - production, cultivation and/or cultivation of agricultural products; cultivation, milking and/or content of animals for the agricultural purposes; primary/final conversion of agricultural products of plant and/or animal origin; maintenance of lands in good agricultural and nature protection shape;

The beneficiary - concerning types of the interventions for development of the rural zone specified in Article 22, means 2):

a) the legal entity of public or private law, physical person or group of the physical persons or legal entities responsible or for initiation of transactions, or for initiation and accomplishment of transactions;
