1. Approve the enclosed Rules of payment of means to the physical person included in the list of the organizations and faces tied with financing of terrorism and extremism for ensuring the activity.

2. Recognize invalid some orders of the Minister of Finance of the Republic of Kazakhstan and the Chairman of the Agency of the Republic of Kazakhstan on financial monitoring according to appendix to this order.

3. To provide to legal support department of the Agency of the Republic of Kazakhstan on financial monitoring in the procedure established by the legislation of the Republic of Kazakhstan:

1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

2) placement of this order on Internet resource of the Agency of the Republic of Kazakhstan on financial monitoring.

4. To impose control of execution of this order on the First Deputy Chairman of the Agency of the Republic of Kazakhstan on financial monitoring.

5. This order becomes effective after ten calendar days after day of its first official publication.

Rules of payment of means to the physical person included in the list of the organizations and faces tied with financing of terrorism and extremism for ensuring the activity

Chapter 1. General provisions

1. These rules of payment to the physical person included in the list of the organizations and faces tied with financing of terrorism and extremism for ensuring the activity (further - Rules) are developed according to part two of Item 8 of article 12 of the Law of the Republic of Kazakhstan "About counteraction of legalization (washing) of the income received in the criminal way, to financing of terrorism and financing of distribution of weapons of mass destruction" (further - the Law) and determine payment procedure subjects of financial monitoring (further - SFM) means to the physical person included in the list of the organizations and faces tied with financing of terrorism and extremism (further - the List of FT), for the ensuring the activity and family members who do not have independent sources of the income and also establish requirements in case of transfer of money and other property to the faces included in lists of the organizations and to the faces tied with financing of terrorism and extremism and financing of distribution of weapons of mass destruction.

2. The right to means, stipulated in Item article 12 of the Law, and on transactions to which measures for freezing according to Item 1-1 of article 13 of the Law are not applied the physical persons included in the list of the organizations and faces tied with financing of terrorism and extremism on the bases provided by subitems 3), 4), 5), 6) and 7) of item 4 of article 12 of the Law for the ensuring the activity and members of his family who do not have independent sources of the income have the 8th.

3. In these rules the following terms and concepts are used:

1) family members - the spouse (spouse), joint or one of spouses minor children (including adopted, being in dependence or under guardianship (guardianship), the parents and parents of the spouse (spouse) who are in dependence;

2) the list of FT - the list of the organizations and faces tied with financing of terrorism and extremism, constituted and placed by authorized body on the Internet resource;

3) the list of the organizations and faces tied with financing of distribution of weapons of mass destruction - the list of the organizations and faces tied with financing of distribution of weapons of mass destruction, constituted and placed to authorized bodies on the Internet resource (further - the list of FROMU).

Other determinations and terms used in these rules are applied according to the Law.

Chapter 2. Payment procedure of means to persons included in the list of the organizations and faces tied with financing of terrorism and extremism based on subitems 3), 4), 5) and 6) of item 4 of article 12 of the Law of the Republic of Kazakhstan "About counteraction of legalization (washing) of income gained in the criminal way, to financing of terrorism and financing of distribution of weapons of mass destruction"

4. The physical person included in the List FT on the bases provided by subitems 3), 4), 5) and 6) of item 4 of article 12 of the Law for the purpose of the ensuring the activity and family members who do not have independent sources of the income having the right to address SFM for implementation of the following transactions with money or other property:

1) received in the payment type of labor leave or the salary in the amount of which is not exceeding the minimum size of the salary established for the corresponding financial year by the law on the republican budget during calendar month at the rate on each family member;

2) received in the form of pension, expenses on official journeys, grants, benefits, other social payment according to the legislation of the Republic of Kazakhstan and also to make tax payment, utility and social payments, other obligatory payments in the budget, penalty fee and penalties;

3) connected with compulsory social medical insurance, insurance of the worker upon accidents in case of execution of labor (office) obligations by it, compulsory insurance of civil responsibility of owners of vehicles, compulsory insurance of civil responsibility of carrier to passengers.

5. SFM for payment received in payment type of labor leave or the salary to the physical person included in the List FT the reference about the size of the salary and (or) the document confirming charge of vacation pay is requested.
