1. Approve the enclosed Rules of planning, selection, approval of projects, monitoring of design process, construction and (or) operation in the field of the housing relations and housing and communal services within the national project on upgrade of energy and utility sectors.

2. To provide to committee on cases of construction and housing and communal services of the Industry ministry and construction of the Republic of Kazakhstan in the procedure established by the legislation:

1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

2) placement of this order on Internet resource of the Industry ministry and construction of the Republic of Kazakhstan after its official publication.

3. To impose control of execution of this order on the supervising vice-Minister of Industry and construction of the Republic of Kazakhstan.

4. This order becomes effective after ten calendar days after day of its first official publication.

Rules of planning, selection, approval of projects, monitoring of design process, construction and (or) operation in the field of the housing relations and housing and communal services within the national project on upgrade of energy and utility sectors

Chapter 1. General provisions

1. These rules of planning, selection, approval of projects, monitoring of design process, construction and (or) operation in the field of the housing relations and housing and communal services within the national project on upgrade of energy and utility sectors (further – Rules) are developed according to subitem 10-42) of article 10-2 of the Law of the Republic of Kazakhstan "About the housing relations" and determine procedure for planning, selection, approval of projects, monitoring of design process, construction and (or) operation in the field of the housing relations and housing and communal services within the national project on upgrade of energy and utility sectors.

2. Financing of activities of the technical operator within implementation of Rules is performed at the expense of means of the republican budget by means of placement of the state task according to the budget legislation of the Republic of Kazakhstan.

3. In Rules the following basic concepts are used:

1) estimated cost of "turnkey" construction – the construction cost of objects determined at preproject stage for holding competitive procedures and the conclusion of agreements on "turnkey" construction according to the Budget code of the Republic of Kazakhstan;

2) electronic platform of purchases of the national project on upgrade of energy and utility sectors (further – electronic platform) – the information system providing carrying out electronic procurement within implementation of the national project on upgrade of energy and utility sectors, providing electronic services in providing point of access for purchase of goods, works and services, the conclusions of the agreement on "turnkey" construction and also selection and monitoring of projects within implementation of the national project on upgrade of energy and utility sectors;

3) the request – the preliminary application of the subject natural monopolies and local executive bodies on the projects participating in upgrade and construction of energy and utility infrastructure within implementation of the national project on upgrade of energy and utility sectors;

4) the project – the project of upgrade and construction of energy and utility infrastructure within implementation of the national project on upgrade of energy and utility sectors;

5) the technical operator – the legal entity with absolute participation of the state in the authorized capital determined by the Government of the Republic of Kazakhstan as the technical operator in the field of the housing relations and housing and communal services of the national project on upgrade of energy and utility sectors;

6) the financial operator – joint-stock company "National managing holding "Bayterek";
