About construction of facilities of cellular communication

For the purpose of development of modern infrastructure of networks of telecommunication, implementation of new information and communication technologies, improvement of quality and availability of the rendered services of telecommunication:

1. Determine that:

1.1. availability of objects of cellular mobile telecommunication (including means and lines of telecommunication) (further - objects of cellular communication), the engineering and transport infrastructure necessary for ensuring their functioning (further - necessary infrastructure), and also development of technology of cellular mobile telecommunication is provided with operators of cellular mobile telecommunication at the same time with construction of apartment houses, entertainment and shopping centers, sports complexes;

1.2. the parcels of land for construction and servicing of objects of cellular communication and necessary infrastructure are provided to operators of cellular mobile telecommunication in lease for a period of 99 years without holding the auction and without collection of payment for the lease right, in permanent and (or) temporary use without their inclusion in lists of the free (unoccupied) parcels of land and lists of the parcels of land for implementation of investment projects.

The parcels of land for construction and servicing of objects of cellular communication and necessary infrastructure within settlements, and also in the territories of gardening partnerships (the lands used by citizens for collective gardening) are provided without functional zoning of the territories;

1.3. registration of materials on withdrawal of the parcels of land provided according to subitem 1.2 of this Item is made based on the statement of the operator of cellular mobile telecommunication along with performance of works on development of the project documentation and construction of facilities of cellular communication and necessary infrastructure. At the same time occupation and use of the parcel of land without document certifying the right to it are not unauthorized occupation of the parcel of land.

Development of the project documentation on objects of cellular communication and necessary infrastructure is performed without preliminary approval of the location of the parcels of land, except as specified, when such sites are asked from farmlands of agricultural purpose, forest lands of forest fund (the nature protection, recreational and improving and protective woods);

1.4. construction of facilities of cellular communication and necessary infrastructure on the provided parcel of land or by its provision is allowed to be performed within the permitted (most limiting) indicators of engineering loadings according to the decision of the operator of cellular mobile telecommunication based on set of the following documents:

the conceptual design of object of cellular communication and necessary infrastructure (further - conceptual design *) approved by the head of the structural unit of local executive and administrative organ of the datum territorial level performing state powers of authority in the field of architectural, town-planning and construction activities in the territory of administrative and territorial unit including the territories of areas in the city;

the project documentation in the amount determined by the operator of cellular mobile telecommunication and allowing to confirm observance of safety requirements.

When constructing facilities cellular communication and necessary infrastructure it is not required:

development of preproject (pre-investment) documentation;

receipt of allowing documentation on construction;

passing of stipulated by the legislation examinations of the project documentation.

When constructing facilities cellular communication and necessary infrastructure supervision in the field of architectural, town-planning and construction activities, except for the state construction supervision concerning objects on which it is conducted, is not performed;

1.5. receipt of data on the permitted (most limiting) indicators of engineering loadings, information on town-planning, natural, ecological, hygienic characteristics and restrictions (encumbrances) for the parcel of land, other basic data, including the conclusion of the Ministry of Defence and approval of Department on aircraft of the Ministry of Transport and Communications, is performed by the operator of cellular mobile telecommunication independently;

1.6. concerning objects of cellular communication and necessary infrastructure the environmental impact assessment is not made;

1.7. acceptance for operation of objects of cellular communication and necessary infrastructure is performed taking into account the features established in appendix;

1.8. installation of objects of cellular communication in (on) the existing capital structures (buildings, constructions), their parts, other engineering objects and technological platforms does not belong to construction activities (construction), is implemented taking into account compliance with law about use of airspace of the Republic of Belarus and aircraft, and also the legislation on culture, is approved with the structural division specified in the paragraph the second to part one of subitem 1.4 of this Item.

Such approval is performed on a grant basis based on the cellular mobile telecommunication of the survey scheme of placement of object of cellular communication provided by the operator with indication of in it data on the site area of cellular communication and its technical characteristics in fifteen-day time from the date of provision of such scheme;

1.9. provision to the operator of cellular mobile telecommunication of common property of joint household (its parts) for the purpose of installation of objects of cellular communication is performed based on the civil agreement signed by the operator of cellular mobile telecommunication:

with participants of joint household or with the participant of joint household authorized by them specified in the agreement on joint household under management of common property of joint household direct his participants;

with the organization managing common property of joint household;

with the authorized person designated by local executive and administrative organ;

with partnership of owners, the organization of builders.

Provision of common property of joint household (its parts) in (on) non-residential capital structures (buildings, constructions) for creation and servicing of objects of cellular communication is performed without decision making of general meeting of participants of joint household;
