About critical infrastructure of the financial sector

According to Articles 7, of 15, 56 Laws of Ukraine "About the National Bank of Ukraine", Articles 8-10, 12, of 14, 19 Laws of Ukraine "About critical infrastructure", for the purpose of normative settlement of the organization and ensuring protection of objects of critical infrastructure the Board of the National Bank of Ukraine decides:

1. Approve:

1) the Regulations on critical infrastructure of the financial sector enclosed;

2) the Change in Regulations on the organization of cyberprotection in bank system of Ukraine approved by the resolution of Board of the National Bank of Ukraine of August 12, 2022 No. 178 (with the enclosed changes).

2. To the banks, other persons performing activities in the markets of non-bank financial services, state regulation and supervision of which activities is exercised by the National Bank of Ukraine, to operators of payment service providers, technological operators of payment services to perform categorization of objects of critical infrastructure within six months from the date of entry into force of this resolution.

3. Recognize invalid:

1) the resolution of Board of the National Bank of Ukraine of November 30, 2020 No. 151 "About approval of the Regulations on determination of objects of critical infrastructure in bank system of Ukraine";

2) Item 2 of the Resolution of Board of the National Bank of Ukraine of August 12, 2022 No. 178 "About approval of the Regulations on the organization of cyberprotection in bank system of Ukraine and modification of the Regulations on determination of objects of critical infrastructure in bank system of Ukraine".

4. To impose control over the implementation of this resolution on the vice-chairman of the National Bank of Ukraine Alexey Shaban.

5. The resolution becomes effective from the date of, its official publication following behind day.

Regulations on critical infrastructure of the financial sector

I. General provisions

1. This Provision is developed according to the Laws of Ukraine "About critical infrastructure" and "About the National Bank of Ukraine".

2. Terms in this Provision are used in such value:

1) the office building - the building of the main office of organization (part of the building) in which heads of organization, employees of divisions of organization who provide provision of the main services accommodate exercise control of objects of critical infrastructure and provide their functioning;

2) the main service - the service provided by the operator of critical infrastructure and referred by the legislation in the sphere of protection of critical infrastructure to the vital (main) services and/or accomplishment of the vital functions;

3) sectoral body in the sphere of protection of critical infrastructure (further - Sectoral body) - the National Bank of Ukraine (further - National Bank) which is determined by the legislation of Ukraine responsible for ensuring forming and realization of state policy in the sphere of protection of critical infrastructure in the financial sector;

4) the sectoral list of objects of critical infrastructure of the financial sector (further - the Sectoral list) - summary data on the identified and categorized objects of critical infrastructure (further - OKI) National Bank, banks, other persons performing activities in the markets of non-bank financial services, state regulation and supervision of which activities the National Bank exercises, operators of payment systems, technological operators of payment services;
