About some questions of determination of the regulatory capital of non-bank payment service providers

According to Articles 7, of 15, 55-1, 56, 58 Laws of Ukraine "About the National Bank of Ukraine", Articles 16, of 77, of 78, of 81 Law of Ukraine "About payment services", article 14 of the Law of Ukraine "About financial services and finance companies", for the purpose of establishment of requirements of the National Bank of Ukraine to sufficiency (adequacy) of the regulatory capital of payment service providers and procedure of payments and components of the regulatory capital, and also determination of procedure for attraction of subordinated debt and receipt of permission to its inclusion in the regulatory capital by payment organizations, organizations of electronic money according to requirements of the legislation of Ukraine the board of the National Bank of Ukraine decides:

1. Approve:

1) Regulations on requirements to the regulatory capital of non-bank payment service providers (further - Regulations on requirements to the regulatory capital) which are applied;

2) Changes in Regulations on authorization of suppliers of financial services and condition of the implementation by them of activities for provision of financial services approved by the resolution of Board of the National Bank of Ukraine of December 29, 2023 No. 199 (with the enclosed changes).

2. To payment organizations (except small payment organizations), to the financial institutions having the right to provision of financial payment services and operators of mail service (further - Organizations) to provide reduction of the regulatory capital in compliance with requirements of the Regulations on requirements to the regulatory capital till December 31, 2025.

3. Organizations shall bring the regulatory capital into accord with requirements of the Regulations on requirements to the regulatory capital taking into account average monthly amount of the payment transactions made in 2024.

4. Recognize invalid:

1) the resolution of Board of the National Bank of Ukraine of August 25, 2022 No. 190 "About approval of the Regulations on establishment of prudential standard rates which are obligatory for observance by non-bank payment service providers, and determination of technique of their calculation";

2) the resolution of Board of the National Bank of Ukraine of March 10, 2023 No. 20 "About modification of the Regulations on establishment of prudential standard rates which are obligatory for observance by non-bank payment service providers, and determination of technique of their calculation".

5. To department of methodology of regulation of activities of non-bank financial institutions (Sergey Savchuk) after official publication to inform non-bank payment service providers information on adoption of this resolution.

6. The resolution becomes effective from the date of, its official publication following behind day.

Regulations on requirements to the regulatory capital of non-bank payment service providers

I. General provisions

1. This Provision is developed according to the laws of Ukraine "About the National Bank of Ukraine", "About payment services", "About financial services and finance companies" and taking into account provisions of the Directive of the European Parliament and Council (EU) No. 2015/2366 of November 25, 2015 about payment services in the domestic market, about modification of Directives 2002/65/EC, 2009/110/EC and 2013/36/EC and Regulations (EU) No. 1093/2010 and about cancellation of the Directive 2007/64/EU (with changes).

2. Terms and reducings in this Provision are used in such value:

1) the non-bank payment service provider - payment organization (except small payment organization), branch of foreign payment organization, organization of electronic money, the financial institution having the right to provision of payment services, the operator of mail service having the right to provision of payment services;

2) the regulatory capital - indicator of activities of the non-bank payment service provider which basic purpose is absorption of the losses caused by risks to which the non-bank supplier of financial payment services is exposed during implementation by it of activities for provision of payment services and the related support services;

3) average monthly amount of payment transactions (further - SOP) - one twelfth from the total amount of the payment transactions executed by the non-bank supplier of financial payment services previous reporting year.

The term "user of payment services" (further - the user) is used in the value determined in the Law of Ukraine "About payment services".

Other terms in this the Provision are used in the values determined by the Laws of Ukraine "About the National Bank of Ukraine", "About payment services", "About financial services and finance companies", the Presidential decree of Ukraine of June 15, 1993 No. 210/93 "About corporatisation of the companies" (with changes).

3. This Provision is developed for the purpose of establishment of requirements to sufficiency (adequacy) of the regulatory capital of non-bank suppliers of financial payment services, and also procedure of payments and determination of the non-bank payment service providers constituting the regulatory capital (further - requirements to the regulatory capital).

4. The non-bank payment service provider shall observe daily in the activities requirements to the regulatory capital.
