1. Approve Rules of cost determination and subject of the capital expenditures performed within the agreement of leasing of medical equipment according to appendix to this order.

2. To provide to development department of the pharmaceutical and medical industry of the Ministry of Health of the Republic of Kazakhstan in the procedure established by the legislation of the Republic of Kazakhstan:

1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

2) placement of this order on Internet resource of the Ministry of Health of the Republic of Kazakhstan after its official publication;

3) within ten working days after state registration of this order in the Ministry of Justice of the Republic of Kazakhstan submission to Legal department of the Ministry of Health of the Republic of Kazakhstan of data on execution of the actions provided by subitems 1) and 2) of this Item.

3. To impose control of execution of this order on the supervising vice-Minister of Health of the Republic of Kazakhstan.

4. This order becomes effective after ten calendar days after day of its first official publication.

Rules of cost determination and subject of the capital expenditures performed within the agreement of leasing of medical equipment

Chapter 1. General provisions

1. These rules of cost determination and subject of the capital expenditures performed within the agreement of leasing of medical equipment (further - Rules), are developed according to item 4 of Article 14 of the Budget code of the Republic of Kazakhstan and determine procedure for cost determination and subject of the capital expenditures performed within the agreement of leasing of medical equipment.

2. In these rules the following basic concepts are used:

1) the administrator of the budget programs (further - ABP) - the state body responsible for planning, reasons, realization and achievement of results of the budget programs determined according to the functions assigned to it by the legislation of the Republic of Kazakhstan, powers and competences;

2) medical equipment - the devices, devices, the equipment, complexes, systems applied separately or in combination among themselves to delivery of health care according to the functional purpose and operational characteristics established by the producer;

3) the lessor - the participant of the leasing transaction who by the attracted and (or) own money acquires subject of leasing in property and gives him to the organizations of health care on terms of the contract of leasing of medical equipment;

4) the agreement of leasing of medical equipment - the transaction according to which the lessor shall transfer acquired to the possession at certain seller of medical equipment to the leasing recipient for certain payment and under certain conditions in temporary ownership and use for the term of more than one year which including provides insurance of medical equipment;

5) the schedule of leasing payments - information on terms, the amount of repayment of leasing payments, share of leasing payment on one financial service, the total amount of remuneration and the planned number of financial services in month created for each leasing recipient individually according to the agreement of leasing and accounting of delivery dates of medical equipment;

6) the seller - the participant of the leasing transaction at whom the lessor acquires medical equipment based on the agreement of leasing.

Chapter 2. Procedure for cost determination and subject of the capital expenditures performed within the agreement of leasing of medical equipment

3. ABP declares collection of requests for medical equipment.

4. The organizations of health care within 30 (thirty) working days send to ABP the need for medical equipment with appendix of the expert evaluation of optimum technical characteristics and kliniko-technical reasons for medical products performed according to the order of the Minister of Health of the Republic of Kazakhstan of January 5, 2021 No. KR DSM-1 "About approval of technique of implementation of expert evaluation of optimum technical characteristics and kliniko-technical reasons for medical products" (it is registered in the Register of state registration of regulatory legal acts at No. 22040), with indication of in the technical specification of the name, model, the name of the place of origin of medical equipment, the name of the producer and picking with technical characteristics of medical equipment.

5. ABP within 5 (five) working days from the date of forming of the code of requests for medical equipment places on the official Internet resource the announcement of collection of offers from sellers.

6. Sellers within 5 (five) working days from the date of placement of the announcement direct to ABP of the offer to medical equipment with indication of model, numbers of the registration certificate, picking, technical characteristics and cost.

7. ABP within 5 (five) working days from the date of completion of acceptance of offers creates results with indication of names of medical equipment, cost and effective period of leasing with the subsequent placement them on the official Internet resource.

8. Lessors within 5 (five) working days from the date of placement on the ABP official Internet resource of results, make offers in ABP.

9. The cost of the capital expenditures performed within the agreement of leasing of medical equipment is determined by ABP on the basis of the smallest cost by provision in leasing of the medical equipment specified in the offers provided according to Item 8 of these rules.

ABP is also determined the schedule of leasing payments by compensation of principal debt and remuneration with indication of interest rate.

10. ABP sends the created budget request for consideration of the Republican or local budget commission according to the budget legislation of the Republic of Kazakhstan.

11. ABP based on the decision of the Republican or local budget commission creates the appropriate budget program according to the budget legislation of the Republic of Kazakhstan.
