1. Approve Rules of subsidizing of costs of the organizations of water supply and water disposal on repayment and servicing of loans of the international financial institutions attracted to projects implementation on expansion, upgrade, reconstruction, updating, maintenance of the existing assets and creation of new assets in settlements according to appendix 1 to this order.

2. Declare invalid some orders according to appendix 2 to this order.

3. To provide to committee on cases of construction and housing and communal services of the Industry ministry and construction of the Republic of Kazakhstan:

1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

2) placement of this order on Internet resource of the Industry ministry and construction of the Republic of Kazakhstan.

4. To impose control of execution of this order on the supervising vice-Minister of Industry and construction of the Republic of Kazakhstan.

5. This order becomes effective after ten calendar days after day of its first official publication.

Rules of subsidizing of costs of the organizations of water supply and water disposal on repayment and servicing of loans of the international financial institutions attracted to projects implementation on expansion, upgrade, reconstruction, updating, maintenance of the existing assets and creation of new assets in settlements

Chapter 1. General provisions

1. These rules of subsidizing of costs of the organizations of water supply and water disposal for repayment and servicing of loans of the international financial institutions attracted to projects implementation on expansion, upgrade, reconstruction, updating, maintenance of the existing assets and creation of new assets in settlements (further – Rules) are developed according to subitems 4) and 12) of Item 2 of article 25 of the Water code of the Republic of Kazakhstan, the subitem 486) of Item 15 of the Regulations on the Industry ministry and the construction of the Republic of Kazakhstan approved by the order of the Government of the Republic of Kazakhstan of October 4, 2023 No. 864 "Some questions of the Industry ministry and construction of the Republic of Kazakhstan" and determine procedure for subsidizing of costs of the organizations of water supply and water disposal for repayment and servicing of loans of the international financial institutions attracted to projects implementation on expansion, upgrade to reconstruction, updating, maintenance of the existing assets and creation of new assets in settlements for the account and within the means provided in republican and local budgets for the corresponding financial year.

2. In these rules the following concepts are used:

1) the administrator of local budget programs – the public institution authorized by akimat of area, the cities of republican value and the capital on the implementation of separate functions in the field of water supply and water disposal financed from local budgets;

2) working group – advisory advisory body, on development of offers and recommendations about provision of budgetary funds for subsidizing of costs of the organizations of water supply and water disposal on repayment and servicing of loans of the international financial institutions attracted to projects implementation on expansion, upgrade, reconstruction, updating, maintenance of the existing assets and creation of new assets in settlements;

3) investing program – the actions plan on investment and return of the funds allocated for expansion, upgrade, reconstruction, updating, maintenance of the existing assets and creation of new assets of the subject of natural monopoly for the purpose of receipt of the technical and economic and (or) ecological effects expressed in achievement of target indicators of investing program or preserving indicators of activities of the subject of natural monopoly at the existing level;

4) the credit agreement – the contract on implementation of the investment project between international financial institution and the receiver of subsidy;

5) the request – set of the documents constituted for reasons for amounts of expenses;

6) the administrator of the republican budget program – the authorized body performing coordination of local executive bodies of areas, cities of republican value, the capital when subsidizing costs of the organizations of water supply and water disposal on repayment and servicing of loans of the international financial institutions attracted to projects implementation on expansion, upgrade, reconstruction, updating, maintenance of the existing assets and creation of new assets in settlements;

7) subsidizing – provision of irrevocable payments from republican and local budgets to the receiver of subsidies for repayment and servicing of loans of international financial institutions;

8) the receiver of subsidy – the organizations in spheres of water supply and water disposal which are subjects of natural monopolies;

9) the agreement of subsidizing – the agreement signed between the receiver of subsidies and the administrator of local budget programs in writing, providing payment procedure, payment due dates, responsibility of the parties and provision of the reporting;

10) authorized body – the state body performing management in the respective spheres of natural monopolies;
