About approval of Regulations about safety of hydraulic engineering constructions
According to Item 2 of article 70 of the Water code of the Republic of Kazakhstan and Item 2 of article 27 of the Law of the Republic of Kazakhstan "About legal acts", I ORDER:
1. Approve the enclosed Regulations about safety of hydraulic engineering constructions.
1) the Minister of Agriculture of the Republic of Kazakhstan of March 31, 2015 No. 19-4/286 "About approval of Rules of safety of water management systems and constructions" (it is registered in the Register of state registration of regulatory legal acts at No. 11478);
2) the Minister of ecology, geology and natural resources of the Republic of Kazakhstan of June 2, 2021 No. 172 "About approval of criteria of safety of water management systems and constructions, Rules of determination of criteria of safety of water management systems and constructions" (it is registered in the Register of state registration of regulatory legal acts at No. 22973).
3. To provide to development department of water management constructions of the Ministry of Water Resources and Irrigation of the Republic of Kazakhstan in the procedure established by the legislation:
1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;
2) placement of this order on Internet resource of the Ministry of Water Resources and Irrigation of the Republic of Kazakhstan after its official publication.
4. To impose control of execution of this order on the supervising vice-Minister of Water Resources and Irrigation of the Republic of Kazakhstan.
5. This order becomes effective after ten calendar days after day of its first official publication.

1. These Regulations about safety of hydraulic engineering constructions (further – Regulations) are developed according to Item 2 of article 70 of the Water code of the Republic of Kazakhstan (further – the Code) and determine types of the hydraulic engineering constructions (further – GTS) carried to potentially dangerous constructions requirements for their safety imposed to designing, construction, operation, reconstruction, preservation or liquidation.
2. In these Regulations the following basic concepts are used:
1) emergency - danger of emergence of accident of GTS as a result of the external impacts which are not provided by the project, decrease in operability of construction or its basis as a result of change of properties of materials of construction or soil of the basis or decrease in reliability of the hydromechanical equipment, and also as a result of decrease in water handling capacity of constructions as for technical reasons, and in connection with restrictions under the terms of the admissible water mode of waterway below alignment of constructions;
2) dike - retaining GTS on waterway for rise in water level and (or) creation of water storage basin;
3) accident of GTS - partial or final fracture of GTS, equipment failure as a result of which the construction becomes disabled and can arise emergency situation;
4) inspection of GTS - complex of actions for assessment of technical condition and operability of GTS, and to determination of the list of necessary works on ensuring reliability and safe operation of these constructions;
5) the declaration of safety of GTS - the main document in which safety of GTS is proved is established GTS compliance to criteria of safety taking into account its class and the list of necessary works on safety of GTS is determined;
6) class GTS - the indicator established by regulations and rules of designing of GTS depending on which requirements to reliability of GTS are established;
7) preservation of GTS - complex of the project and construction works performed for the purpose of temporary preserving GTS and ensuring its safety in the conditions of the omission of transit expenses without regulation of the water mode with the corresponding decrease in water level in water storage basin;
8) liquidation - complex of the project and construction works performed for the purpose of complete disassembly of GTS and recovery of the natural water mode and bed of waterway which are not creating obstacles in case of the omission of flood;
9) To - diagnostic value of technical performances of the criteria measured in process of monitoring of technical condition of GTS;
10) K1 - the controlled level of criteria value in case of which achievement stability, the mechanical and filtrational durability of GTS and its basis, and also handling capacity of water waste and water throughput constructions still correspond to conditions of normal operation;
11) K2 - the controlled level of criteria value in case of which exceeding operation of GTS in the project modes is inadmissible.
3. Depending on characteristics and degree of potential danger for the environment and life activity of the person of GTS are distributed on danger classes according to the procedure from the highest to the smallest.
4. Belong to the I class GTS:
1) dikes more than thirty meters high and (or) water storage basin amount more than hundred million cubic meters;
2) water-engineering systems or water waste constructions with handling capacity more than hundred cubic meters per second.
5. Belong to the II class GTS:
1) dikes more than twenty meters high and (or) water storage basin amount more than fifty million cubic meters;
2) water-engineering systems or water waste constructions with handling capacity more than fifty cubic meters per second.
6. Belong to the III class GTS:
1) dikes more than ten meters high and (or) water storage basin amount more than twenty million cubic meters;
2) water-engineering systems or water waste constructions with handling capacity more than twenty cubic meters per second.
7. Belong to the IV class GTS:
1) dikes more than five meters high and (or) water storage basin amount more than ten million cubic meters;
2) water-engineering systems or water waste constructions with handling capacity to ten cubic meters per second.
7-1. Treat the GTS constituting the increased danger in case of emergency situations of natural and technogenic nature, and also carried to potentially dangerous GTS I, II and III classes, and also class GTS IV if their destructions will entail damnifications of life and to human health, the environment, material damage to physical persons and legal entities.
8. Safety is performed based on requirements imposed to designing, construction, operation, reconstruction of preservation and liquidation of GTS.
9. For safety of GTS natural observations (monitoring) of their work and condition, both in the course of construction are made, and in case of operation, reconstruction, preservation and liquidation.
10. When calculating results of engineering researches, functional purpose and characteristics of location of GTS, expected effects of destruction of the bearing building constructions, and also adverse combinations of loadings and impacts are considered.
11. Special design decisions are applied to prevention of possible dangerous damages and emergencies in case of GTS construction in seismodangerous areas.
12. The owner (owner) of GTS provide safe operation of GTS on functional purpose, the safe level of their technical condition, and also maintenance, running repair and upgrade.
13. In case of threat of emergence of the accidents connected with the assumed or happened emergency situations of natural and technogenic nature, the owner (owner) of GTS takes measures for safety, and also for GTS conclusion from operation, in case of discrepancy of the GTS controlled parameters to the established safety requirements based on service regulations of GTS.
14. Mitigation of consequences of emergency situation of natural and technogenic nature on GTS is performed by the owner (owner) according to the actions plan on mitigation of consequences of emergency situations and the project documentation on recovery of GTS.
15. In the presence on GTS of remedies from the fire, explosion and other dangerous situations, the owner (owner) of GTS maintain their operating state according to passports of the water management constructions developed based on rules of carrying out certification of water management and hydraulic engineering constructions and also form of the passport of water management and hydraulic engineering constructions.
16. Maintenance of safe condition of GTS constituting the increased danger in case of emergency situations of natural and technogenic nature, and also carried to potentially dangerous, in case of operation are provided with the owner (owner) by carrying out multifactorial inspection according to Rules of carrying out the multifactorial inspection of hydraulic engineering constructions approved by the order of the Minister of Water Resources and Irrigation of the Republic of Kazakhstan of June 27, 2025 No. 156-HK (it is registered in the Register of state registration of regulatory legal acts at No. 36350).
17. Development of programs of repair work and works on reconstruction of GTS is made on the basis of assessment of condition of systems and constructions and risk level of emergence of accident (safety level) of the operated GTS.
18. The owner (owner) of GTS when carrying out in the adjacent territory of the works constituting danger to people take measures for prevention of accidental access to the danger area.
19. The owner (owner) of GTS when holding actions for the prevention and liquidation of harmful effects of waters takes the following measures:
1) follows service regulations of GTS;
2) is systematically analyzed by security status of GTS;
3) conducts regular examinations of technical condition of GTS;
4) supports in permanent readiness local warning systems of civil protection on GTS.
20. The owner (owner) of GTS ensures safety of physical persons on GTS;
21. GTS is designed, proceeding, from requirements of complex use of water resources, on the basis of engineering calculations on regulation of superficial drain of waters, taking into account schemes of use of water currents and water consumption based on the short-term and long-term forecasts, data and provisions containing in programs of enhancement of structure of economy, development and placement of production forces and industrial facilities, town-planning documentation.
22. As a part of the GTS project the special Section of the automated monitoring system of the intense deformed GTS condition is developed. The system of stationary observations and control of change of strength characteristics and deformations of designs and bases of GTS shall function in the automated mode, both in the course of construction, and in case of operation of GTS.
23. When designing GTS it is provided constructive technology solutions on prevention of development of possible dangerous damages and emergencies which can arise during the construction periods.
24. Criteria of safety of GTS it is determined on blueprint stage according to appendix 1 to these Regulations.
25. The owner (owner) of GTS determines person responsible for determination and monitoring of criteria.
26. The structure and level of criteria K1 and K2 values on blueprint stage is determined on the basis of the analysis of results of calculations and pilot studies of the filtrational, hydraulic and temperature modes, the intense deformed condition, durability and stability of GTS on the main and special combination of loadings, and also on the basis of the analysis of strength, deformation and filtrational characteristics of material.
27. Adjustment of criteria values is performed before input of GTS in operation.
28. In case of construction of GTS observance of requirements of the project documentation, technical regulations and safe engineering is provided.
29. In case of the omission of construction expenses of water creation in the lower byef of the modes creating threat for safety of constructions under construction, their elements and adjoining them sites of bed is inadmissible.
30. The construction of concrete and steel concrete GTS is carried out with observance of the Technical regulation "Requirements to Safety of Steel Concrete, Concrete Designs", approved by the order of the Government of the Republic of Kazakhstan of December 22, 2008 No. 1198.
31. Variations of not basic nature, possible in the period of construction of GTS, which are not influencing the constructive scheme of object on its space-planning, technical or technology project solutions and on the approved technical and economic indicators are approved with developer of the design estimates according to the subitem 19) of Item 11 of Rules of the organization of activities and implementation of the functions of the customer (builder) approved by the order of the Minister of national economy of the Republic of Kazakhstan of March 19, 2015 No. 229 "About approval of Rules of the organization of activities and implementation of functions of the customer (builder)" (it is registered in the Register of state registration of regulatory legal acts at No. 10795).
32. Works are carried out to the winter period according to the actions excluding promorazhivany bodies of soil constructions before consolidation or consolidation of soil, and concrete constructions and their designs before completion of their curing and finding of normative durability.
33. In the period of construction of the GTS I, II and III water-engineering system of classes technical and author's supervisions make systematic control tool and visual natural observations according to articles 34 and 34-1 of the Law on architectural, town-planning and construction activities in the Republic of Kazakhstan. On GTS IV of class carrying out systematic visual observations is allowed.
34. Control natural observations of GTS it is carried out with the set frequency according to the project.
35. During the entire period of construction of GTS the contractor (general contractor) provides measures for safety and protection against the damages established and established on GTS the control instrumentation (further – KIA).
36. Upon completion of construction all materials of natural observations and KIA are transferred to the owner (owner).
37. The defects revealed in the course of construction, testing and trial start-up and discrepancies of the GTS parameters of the project documentation are eliminated before acceptance for operation.
38. Commissioning is forbidden:
1) GTS before holding the actions provided by projects preventing flooding, flooding, bogging and salinization of lands and erosion of soils;
2) GTS without establishment of zones of sanitary protection and Items of observation of indicators of condition of GTS provided by the project documentation;
39. Operation of GTS is allowed in the presence:
1) passports of GTS;
2) service regulations of GTS;
3) declarations of safety of GTS in cases, stipulated in Item 4 articles 72 of the Code.
40. The passport and service regulations of GTS are developed, affirm his owner (owner) and are stored at the owner (owner) in the original.
The owner (owner) provides entering of electronic versions of the passport and service regulations into basin water inspectorate for protection and regulation of use of water resources for inclusion in the register of water management and hydraulic engineering constructions.
41. Determinations of criteria of safety of GTS it is determined at operation stage according to appendix 2 to these Regulations.
42. The structure and level of criteria K1 and K2 values is determined on the basis of multiple factor analysis of results of comparison of the criteria values developed as a part of the project with the indicators controlled on GTS in case of maximum demands.
43. Adjustment of criteria values is performed in cases:
1) after the first two years of operation;
2) after reconstruction of the hydraulic engineering construction, their capital repairs, recovery and change of service conditions;
3) in case of conclusion from operation and in case of preservation;
4) after emergencies.
44. On the operated GTS maintenance, planned repairs and upgrade which amount is determined by need of safety of construction and its maintenance for serviceable and operating state is made.
45. The owner (owner) of GTS provides control of technical condition of GTS, their mechanical equipment, accomplishment of amounts of the repair work providing stability of the established operation indicators, completeness of accomplishment of preparatory work, timely providing the planned amounts of repair work with spare parts and construction materials and also of terms and quality of the performed repair work.
46. The owner (owner) of GTS ensures safety and development of the KIA system for carrying out high-quality monitoring of condition of constructions.
47. The failed equipment is subject to replacement on similar, capable to give reliable information.
48. Owners (owners) of GTS specified in article 70 of the Code for ensuring their safe operation take the following measures:
1) inspection of technical condition, including subjects of engineering facilities of functioning;
2) carrying out routine maintenance and overhaul repairs, replacement of the capital and service equipment;
3) maintenance in good repair and adherence to deadlines of the state certification of equipment and the equipment for accounting of consumption and dumping of waters;
4) creation of inventories of material resources;
5) other measures, stipulated by the legislation Republic of Kazakhstan and service regulations of GTS.
49. The owner (owner) develops the schedule and the program of inspection for carrying out inspection of technical condition of GTS.
Following the results of inspection of technical condition of construction the plan of repair work which contains the actions directed to reducing losses and leakages of water is constituted.
50. For GTS constituting the increased danger in case of emergency situations of natural and technogenic nature, examination of technical condition is conducted within multifactorial inspection. Multifactorial inspection is carried out each five years.
For carrying out multifactorial inspection by the owner (owner) determination of criteria of safety of GTS and annual monitoring of their observance is carried out.
51. In case of reconstruction of GTS owners (owner) provides the necessary level of safety in case of change of service conditions (change of normative requirements) – increases in seismicity of the area, change of settlement expenses of water, work of constructions in complex with again constructed objects.
52. In case of reconstruction the maximum use of the existing constructions or elements of the constructions which are in normal operational state is provided.
53. Reconstruction of the main parts of constructions is made without the termination of accomplishment of the main operational functions by them, at the same time the temporary restriction of the project modes and service conditions as the reconstructed objects, and water-engineering system in general is allowed. These restrictions are proved in the project documentation and shall not reduce the level of admissible risk of accident of the reconstructed construction.
54. Development of the work program on reconstruction of GTS is made on the basis of assessment of condition of constructions and risk level of accident (safety level) of the operated GTS.
55. Reconstruction of the operated GTS is made based on the project decisions considering its condition and possible change of working conditions.
56. Preservation and liquidation of GTS is made based on the project decisions providing the admissible level of their safety during works on preservation and liquidation.
57. Behind safe condition of the preserved GTS constant engineering supervision which is provided by the owner (owner) of GTS is exercised.
58. Liquidation of GTS for the purpose of complete or partial destruction, and also use on other appointment, including reorganization, is performed on the project from ensuring its safety.
59. For the purpose of safety prior to process of liquidation of GTS drawdown of water storage basin, and also shutdown GTS and the equipment from any power sources is performed.
