About approval of the Procedure for provision of leaves to the workers who adopted (adopted) the child

1. Approve the Procedure for provision of leaves to the workers who adopted (adopted) the child according to appendix.

2. Recognize invalid:

1) the order of the Government of the Kyrgyz Republic "About approval of the Procedure for provision of leaves to the workers who adopted (adopted) the child" of December 22, 2005 No. 606;

2) the order of the Government of the Kyrgyz Republic "About modification of the order of the Government of the Kyrgyz Republic "About approval of the Procedure for provision of leaves to the workers who adopted (adopted) the child" of December 22, 2005 No. 606" of May 13, 2014 No. 257.

3. This resolution becomes effective after ten days from the date of official publication.

Procedure for provision of leaves to the workers who adopted (adopted) the child

1. The workers who adopted (adopted) the child aged up to 3 months are granted leave:

- for the period from the date of adoption (adoption) and before the expiration of 70 calendar days since the birth of the adopted (adopted) child, and in case of simultaneous adoption (adoption) of two and more children - 110 calendar days from the date of their birth;

- additional vacation non-paid before achievement of three years by the child.

In case of adoption (adoption) of child(children) by both spouses the specified leaves are granted to one of spouses at their discretion.

The women who adopted (adopted) the child at will instead of leave are granted maternity leave for the period from the date of adoption (adoption) of the child before the expiration of 70 calendar days, and in case of simultaneous adoption (adoption) of two and more children - 110 calendar days from the date of their birth.

2. For receipt of child care leave the worker who adopted (adopted) child(children) submits on place of employment the leave request with indication of in it leave type and its duration and submits the document confirming the worker's right to its obtaining (the judgment about adoption (adoption) of child(children) or the certificate of birth of child(children).

In case of registration of child care leave (children) by one of spouses the reference (services, studies) other spouse that the child care leave specified in Item of 1 this Procedure is not used by it or that the spouse is on the maternity leave provided according to the paragraph to third Item of 1 this Procedure is submitted.

3. Provision to workers of the leaves specified in Item of 1 this Procedure is drawn up by orders of the employer with indication of in them duration of each leave.

4. The basis for provision to the worker who adopted (adopted) child(children), maternity leaves is the disability leaf which is issued according to the procedure, established by the Cabinet of Ministers of the Kyrgyz Republic.

5. The workers who adopted (adopted) child(children) for the leave specified in the paragraph the second Item of 1 this Procedure are granted and paid maternity allowance according to the procedure, established by the Cabinet of Ministers of the Kyrgyz Republic.

6. The officials who are involved in hearing of cases about adoption (adoption) of the child and pronouncement of the corresponding judgment and also officials of the bodies performing modification of civil registrations based on the judgment which took legal effect about adoption (adoption) and other persons who in connection with accomplishment of service (labor) duties knew of adoption (adoption) of the child shall keep secrecy of adoption (adoptions) of the child.
