Approve the enclosed Regulations on maintaining the register of unfair suppliers and on requirements to technological, program, linguistic, legal and organizational means of ensuring of maintaining the register of unfair suppliers.

Regulations on maintaining the register of unfair suppliers and on requirements to technological, program, linguistic, legal and organizational means of ensuring of maintaining the register of unfair suppliers

I. General provisions

1. This Provision determines procedure for maintaining the register of unfair suppliers (further - the register) and requirements to technological, program, linguistic, legal and organizational means of ensuring of maintaining the register.

2. The register is kept the information system, in electronic form by use, including the means of the software meeting the requirements established by this Provision (further - information system).

3. Maintaining the register, including inclusion and exception of the register of information about unfair suppliers (contractors, contractors), is performed by the federal executive body authorized on control in the sphere of order placement according to powers in the established field of activity (further - authorized body).

4. The authorized body places the data containing in the register on the official site of the Russian Federation on the Internet for placement of information on order placement on delivery of goods, performance of works, rendering services for federal state needs (further - the official site) within 3 days from the date of their receipt. Entering of data into the register is performed taking into account requirements of the legislation of the Russian Federation about protection of the state secret.

5. The data containing in the register shall be available to acquaintance on the official site without collection of payment.

6. The information about unfair suppliers (contractors, contractors) presented by customers in the written or electronic form is stored by the relevant authorized body according to the procedure, the established legislation of the Russian Federation on archiving.

II. Procedure for submission by customers of information about unfair suppliers (contractors, contractors)

7. In case of evasion of the winner of tender (auction) or the bidding winner from the conclusion of the public or municipal contract the customer no later than 3 days from the date of the conclusion of the public or municipal contract with the bidder with whom in accordance with the legislation of the Russian Federation in the sphere of order placement the contract in case of evasion of the winner of tender (auction) or the bidding winner from the conclusion of the contract is signed sends to authorized body:

a) the information about person who evaded from the conclusion of the public or municipal contract, represented according to subitems "v", "g", "d" and "zh" (except for numbers of the register entry in registers of the public or municipal contracts signed following the results of order placement) Item 15 of this provision;

b) the copy of the protocol or minutes abstract of assessment and comparison of bids, the copy of the protocol of auction or the protocol of consideration and assessment of quoted bids regarding determination of the winner of tender (auction) or the bidding winner;

c) the copy of the notification of the winner of tender (auction) or the bidding winner about refusal of the conclusion of the contract (in case of its availability);

d) the copy of the judgment about compulsion of the winner of tender (auction) or the bidding winner to the conclusion of the contract (in case of its availability);

e) other documents (in case of their availability), testimonial of refusal of the winner of tender (auction) or the bidding winner from the conclusion of the public or municipal contract.

8. If the single bidder who submitted the bid (auction) or the bidder recognized as the single participant of tender (auction) or the participant of auction only participating in auction evaded from the conclusion of the public or municipal contract, the customer within 5 days from expiry date of the contract signature specified in the tender documentation or the auction documentation sends to authorized body:

a) the information about person who evaded from the conclusion of the public or municipal contract, represented according to subitems "v", "g", "d" and "zh" (except for numbers of the register entry in registers of the public or municipal contracts signed following the results of order placement) Item 15 of this provision;

b) copy of the protocol or minutes abstract of consideration of bids, copy of the protocol of consideration of auction participation applications;

c) the copy of the notification directed by the single bidder who submitted the bid (auction) or the bidder recognized as the single participant of tender (auction), or the participant of auction only participating in auction about refusal of the conclusion of the contract (in case of its availability);

d) the copy of the judgment about compulsion of the bidder recognized as the single participant of tender (auction) to the conclusion of the contract (in case of its availability);

e) other documents (in case of their availability), testimonial of refusal of the single bidder who submitted the bid (auction), or the bidder recognized as the single participant of tender (auction), or the participant of the auction only participating in auction from the conclusion of the contract.

9. In case of termination of the public or municipal contract in connection with fundamental breach by the supplier (the contractor, the contractor) of terms of the contract the customer within 3 days from the date of contract cancelation sends to authorized body:

a) the information about the specified supplier (the contractor, the contractor) represented according to subitems "v", "g", "d" and "zh" of Item 15 of this provision;
