Based on Item b) parts (1) Article 49 and part (2) article 52 of the Law No. 82/2024 on official control in the agrofood sphere (The official monitor of the Republic of Moldova, 2024, Art. No. 199-201, 265) DECIDES: the Government

1. Approve:

1.1. Regulation for transactions which shall be carried out in time and after conducting verifications of documents, checks of identity and physical controls concerning animals and the goods which are subject to official control on posts of border control according to appendix No. 1;

1.2. Regulation for uniform respect for frequency of conducting checks of identity and physical controls concerning loads of the animals and goods imported into the Republic of Moldova according to appendix No. 2.

2. To impose control over the implementation of this resolution on the National agency on safety of foodstuff.

3. This resolution becomes effective since May 8, 2026.

Regulation for transactions which shall be carried out in time and after conducting verifications of documents, checks of identity and physical controls concerning animals and the goods which are subject to official control on posts of border control

The this Regulation shifts Executive regulations of the Commission (EU) 2019/2130 of November 25, 2019, establishing detailed regulations of carrying out transactions which shall be carried out in time and after conducting verifications of documents, checks of identity and physical controls concerning animals and the goods which are subject to official control on posts of border control (CELEX: 32019R2130), published in the Official magazine of the European Union by L 321 of December 12, 2019.

1. The this Regulation establishes detailed requirements to transactions which shall be carried out to time and after verifications of the documents, checks of identity and physical controls specified in Item and) parts (3) Articles 19, Item b) of part (3) Articles 21, articles 47 and 48 of the Law No. 82/2024 on official control in the agrofood sphere (further – the Law No. 82/2024), concerning loads of animals or goods of the categories specified in part (1) article 45 of the relevant law.

2. Concerning each load of the animals and goods specified in Item 1, competent authority establishes purpose of animals and goods on the basis official certificates, official certificates and other documents accompanying load, and also destination of the load specified in appropriate certificates, certificates and documents.

3. The competent authority studies all official certificates, official certificates and other documents specified in article 3 of the Law No. 82/2024, or their electronic equivalents provided in the client information control system for official control (further – IMSOC) specified in article 89 of the relevant law or through the existing national systems to make sure that:

3.1. they are issued by competent authority of other country;

3.2. they conform to the requirements provided in part (1) Articles 73, to Article 74 and part (2) article 75 of the Law No. 82/2024;

3.3. they meet the standards specified in part (2) article 1 of the Law No. 82/2024;

3.4. the data fixed in certificates or documents meet the standards specified in part (2) article 1 of the Law No. 82/2024.

4. The competent authority checks in what amount and how correctly the carrier responsible for load filled the corresponding part of the general entering veterinary and sanitary document (further – OVVSD) as it is provided in part (1) article 54 of the Law No. 82/2024, and whether there correspond data in this document to the data containing in the official certificates, official certificates and other documents accompanying load.

5. When checking identity of loads of the animals and goods specified in Item 1, competent authority checks compliance of the following elements to the data containing in the official certificates, official certificates and other documents accompanying loads:

5.1. quantity of animals, their type, breed, sex, age and category, depending on circumstances;

5.2. content of loads;

5.3. quantity of loads;

5.4. corresponding stamps and marking or identification codes, when applicable;

5.5. vehicle identification, when applicable;

5.6. seals on containers or vehicles, depending on circumstances.

6. Concerning loads of animal products, the reproducing materials, offal of animal origin and derivative products, hay and straw, and also composite products check of identity can be limited to the provisions specified in subitems 5.5 and 5. 6, in cases, when:

6.1. loads are not selected for carrying out physical control;

6.2. loads are shipped in the closed transport units and sealed by seal;

6.3. seals on containers or on vehicles are not damaged and their integrity is not broken;

6.4. seals on containers or vehicles were imposed by the competent authority which issued the official certificate or under its observation;

6.5. the data specified on seals correspond to the data specified in the official accompanying certificate provided by the regulations specified in part (2) article 1 of the Law No. 82/2024.

7. Concerning loads of animal products, the reproducing materials, offal of animal origin, derivative products, hay and straw, and also composite products for conducting check of identity from load 1% of objects or packagings, or at least two or no more than 10 objects or packagings is selected.
