This resolution shifts Regulations (EU) of 2019/941 European Parliament and Council of June 5, 2019 about readiness for risks in electric utility sector and about cancellation of the Directive 2005/89/EU (CELEX: 32019R0941), published in the Official magazine of the European Union by L 158/1 of June 14, 2019, in the option adapted and approved by the Decision of Ministerial council of Energy community No. 2021/13/Mc-EnC of November 30, 2021.

1. Approve:

1.1. Regulations on emergency situations in electric utility sector, according to appendix No. 1;

1.2. The action plan in emergency situations in electric utility sector, according to appendix No. 2.

2. Declare invalid the Order of the Government No. 149/2019 about approval of the Regulations on emergency situations on electricity market and the Action plan in emergency situations on electricity market (The official monitor of the Republic of Moldova, 2019, Art. No. 111-118, 216).

3. To impose control of execution of this resolution on the Department of Energy.

4. This resolution becomes effective from the date of publication in the Official monitor of the Republic of Moldova.

to the Order of the Government of the Republic of Moldova of December 11, 2024 No. 820

Regulations on emergency situations in electric utility sector

Part 1. General provisions

1. The regulations on emergency situations in electric utility sector (further - the Provision) create the necessary legal basis for safety of supply with the electric power by the organization of normal and smooth functioning of electricity market and implementation of the measures designed to promote accomplishment of the purposes of Energy community concerning energy security, solidarity, trust and ensuring management of situations of electrical power crisis.

2. The purpose of the Provision consists in determination of rules of cooperation between Contracting parties of Energy community (further - Contracting parties) for prevention of electrical power crises, readiness for such crises and management of them, in the spirit of solidarity and transparency, and taking into account, in full, requirements of the competitive domestic market of the electric power.

3. Requirements of the Provision provide powers and responsibility of the electrical power companies, members of electricity market, users of system and final consumers, concerning decrease in risks for safety of supply with the electric power and readiness for the prevention and management of electrical power crises, with ensuring transparency and accounting of requirements of competitive electricity market.

4. For the purposes of this provision concepts which are given definition in the Law on the electric power and Codes of power supply networks, and also the following concepts are applied:

safety of supply with the electric power - capability of electric system to guarantee supply of consumers with the electric power at accurately established efficiency level;

interzonal handling capacity - capability of the system which is in intersystem connection to perform transmission of energy between zones of the biddings;

simultaneous electrical power crisis - electrical power crisis which at the same time affects several states;

competent authority - the body of public management responsible for implementation of the measures provided by Regulations on emergency situations in electric utility sector and the Action plan in emergency situations in electric utility sector;

regulating authority - the regulating authority specified in part (1) article 8 of the Law No. 174/2017 on power;

the crisis coordinator - person, group of persons, the team consisting of the corresponding heads of electrical power crises at the national level or organization, it is entrusted to them to be effective as contact Item and to coordinate information flows during electrical power crisis;

the non-market measure - any measure connected with the supply and demand which is directed to mitigation of electrical power crisis and deviates market regulations or commercial agreements;

the region - group of contracting parties of the Constitutive treaty of Energy community and member states of the European Union at which operators of the transferring system have the same regional coordination center;

subgroup - the group of contracting parties and state members which enter one region and have the technical potential for mutual assistance according to Part 7;
