1. Approve Standard rules of general water use according to appendix 1 to this order.

2. Recognize invalid some orders according to appendix 2 to this order.

3. To provide to department of water policy of the Ministry of Water Resources and Irrigation of the Republic of Kazakhstan in the procedure established by the legislation:

1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

2) placement of this order on Internet resource of the Ministry of Water Resources and Irrigation of the Republic of Kazakhstan after its official publication.

4. To impose control of execution of this order on the supervising vice-Minister of Water Resources and Irrigation of the Republic of Kazakhstan.

5. This order becomes effective after day of its first official publication.

Standard rules of general water use

Chapter 1. General provisions

1. These Standard rules of general water use (further - Standard rules) are developed according to the subitem 2) of Item 1 of article 26 of the Water code of the Republic of Kazakhstan (further - the Code) and determine procedure physical persons of general water use in the territory of the Republic of Kazakhstan on water common use facilities.

2. General water use is performed by physical persons for satisfaction of personal needs in the recreation, tourism, amateur (sports) fishery and other forms of leisure which are not connected with implementation of economic or business activity, and also watering place of farm animals on pastures.

3. Special permission for implementation of general water use is not required.

4. Use of water objects in case of general water use is performed within the public water servitude which is integral part of water object.

Chapter 2. Procedure for general water use

5. Local executive bodies for realization of the right of general water use by physical persons:

1) provide easy access to water objects;

2) is determined by places for mass rest, tourism and sport on water objects of general water use;

3) is determined by sites of fishery water objects and (or) sites and adjacent shore for implementation of amateur (sports) fishery;

4) provide informing the population on the set restrictions and prohibitions of general water use.

6. In the absence of direct access to water object, local executive bodies establish the public servitude according to Article 69 of the Land code of the Republic of Kazakhstan.

7. Information on restrictions or prohibitions is subject to publication in mass media, on Internet resource of state bodies and shall be available to acquaintance by establishment of special information signs along coast of water objects.

8. Use of water objects for watering place of farm animals is allowed out of zone of sanitary protection and in the presence of the vodopoyny platforms and other devices preventing pollution and contamination of water objects.

9. On fishery water objects amateur (sports) fishery is organized by physical and (or) legal entities who are granted the right of conducting lake and commodity economic activity on this water object.

10. When using water objects of general water use are not allowed:

1) unauthorized installation of barriers, barriers, prohibitive signs, other means of restriction of access for physical persons to water objects;

2) pollution and contamination of water object;

3) washing of transport, washing of linen and bathing of animals in the places intended for bathing;

4) bathing in places where special information signs with the warning or prohibiting texts are exposed;

5) unauthorized removal, damage or destruction of special information signs;

6) storage in the territory of fuels and lubricants;

7) implementation of fuelling, sink and repair of transport;

8) to leave on water objects and in close proximity to them minor children without supervision of adults.
