Based on part (1) article 26 of the Law No. 10/2016 on promotion of energy use from renewable sources (The official monitor of the Republic of Moldova, 2016, Art. No. 69-77, 117), with subsequent changes, DECIDES: the Government

1. Approve Regulations on solid biofuel it (is applied).

2. Declare invalid the Order of the Government No. 1070/2013 about approval of the Regulations on solid biofuel (The official monitor of the Republic of Moldova, 2013, Art. No. 315-319, 1179), with subsequent changes.

3. To impose control over the implementation of this resolution on the Department of Energy.

Regulations on solid biofuel

I. General provisions

1. The regulations on solid biofuel (further - the Provision) establish concepts, requirements to marking, and also conditions of warehousing, storage, placement in the market and supervision of solid biofuel as national production, and import.

2. Requirements of this provision are applied to the solid biofuel placed in the market of the Republic of Moldova or intended for export, made from:

2.1. products rural, forestry or cultures of wood energy plants;

2.2. vegetable waste of agricultural industry, livestock production and forestry;

2.3. vegetable waste of the food industry;

2.4. wood waste;

2.5. the fibrous vegetable waste which is formed as a result of production of cellulose of primary raw materials and production of paper from cellulose weight if this waste concentrates in production site and if the made heat is used;

2.6. pith waste;

2.7. the biofuel received from water biomass.

3. Requirements of this provision are not applied to the biofuel received from wood waste which can contain the halogenated organic compounds or heavy metals as a result of processing of tree the protecting means or its coverings, including in particular the wood waste of this kind received from construction scrap or as a result of demolition.

4. The concepts used for the purposes of this provision mean:

4.1. additives - substances which improve fuel quality reduce emissions or increase production efficiency;

4.2. biofuel mix - the biofuel received as a result of natural or inadvertent mixing of different types of biofuel and/or different types of biomass;

4.3. solid biofuel - the solid fuel made directly or indirectly from biomass;

4.4. biomass - biodegradable share of products, waste and remaining balance of biological origin, including vegetable substances and substances of animal origin, from rural, forestry or allied industries of production, including fishery and aquaculture, and also biodegradable share of waste, including industrial and municipal wastes of biological origin;

4.5. ashes, ash content - the mass of the inorganic remaining balance formed after complete combustion of fuel in specific conditions, expressed usually as percent from the mass of solid of fuel;

4.6. bulk density - the mass of certain share of particles of substance divided into amount of the reservoir which is filled with this share in specific conditions;

4.7. mechanical durability - capability of units of the condensed fuel to remain invariable during transactions and transportation;

4.8. heat of combustion - the calculated value of specific energy of combustion per unit mass the fuel burned with permanent pressure of oxygen without warmth of condensation of water vapor (MPa 0,1) when other products are at reference temperature, as well as in case of the highest calorific capability;

4.9. chemical processing - processing by chemicals, except for air, water or is warm.

II. Placement conditions in the market

5. It is considered to relevant requirements of this provision and solid biofuel in packed form or in bulk which is allowed to placement in the market:

5.1. it is labeled, marked or accompanied by trade documents according to requirements of this provision;

5.2. it is accompanied by documents, confirmatory that determination of compliance was performed in accredited test laboratories proceeding from the technical characteristics and properties specified in national standards which adapt the European and international standards which list is developed by the central industry body of public management in the field of power and is published in the Official monitor of the Republic of Moldova.

6. The solid biofuel entered on the market and/or presented at the market shall meet the quality requirements provided by series of the SM EN ISO 17225 standards (all parts) and the requirements to marking provided in this Provision.

7. In case of introduction on the market of the solid biofuel which is not corresponding to regulations on marking the measures provided by the Law No. 162/2023 on supervision of the market and products compliance are applied.

8. Storage, transportation and placement of solid biofuel in the market shall be performed in conditions which provide preserving quality characteristics.

9. Solid biofuel is stored in the net, dry, well ventilated, dark rooms protected from sunlight and equipped with the machinery and equipment, necessary for providing storage conditions.

10. The expiration date of solid biofuel is determined by the producer or in cooperation with research establishments after preliminary testing. The expiration date cannot be less than 12 months, on condition of observance of the requirements provided in Items 8 and 9.

III. Labeling

11. Information on quality of solid biofuel is specified in the form of the text and/or marking on packaging and/or labels of product and shall contain:

11.1. origin country name. In case of the solid biofuel made in the Republic of Moldova "Fabricat in Moldova" is specified;

11.2. information provided in appendix;

11.3. instruction for use of solid biofuel;

11.4. storage conditions;

11.5. number of the protocol on laboratory researches with the name of accredited laboratory.

12. If packaging of product does not allow to attach the label or the product is delivered by embankment, the relevant information is printed on paper and it is represented together with the accompanying documentation.

13. Information is specified in Romanian. In the course of trade in import products in the domestic market provision of information in other languages is allowed, and near it transfer into Romanian is placed.

14. Means of placement of information shall ensure safety of information specified on trade packaging throughout storage, transportation and sale of solid biofuel.
