About some questions of the budget crediting

According to the subitem 3) Item 6 and Items 8, 13 and 16 Articles 154, Item 2 of Article 156 and Item 1 of Article 161 of the Budget code of the Republic of Kazakhstan PRIKAZYVAYU:

1. Approve:

1) Procedures for provision of budget credits, including the list of the documents necessary in case of their representation, and also methods of provision of budget credit, the repayment schedule and servicing of budget credit, the procedure of restructuring of budget credit and replacement of the borrower, condition of limitation period, condition of the translation of debt on budget credit, the termination of requirements of creditors and the termination of guarantee on budget credits, control procedures on budget credits according to appendix 1 to this order (further – Appendix 1);

2) Rules of determination of powers of the confided (agent), the size and payment terms of its remuneration, according to appendix 2 to this order (further – Appendix 2);

3) Rules of control of use of budget credits on purpose and availability of ensuring obligation fulfillment on it, according to appendix 3 to this order (further – Appendix 3);

4) Criteria of creditworthness of the borrower, according to appendix 4 to this order;

5) Rules of inclusion of the financial agencies in the list of the financial agencies, the receiving budget credits from the republican budget without ensuring obligation fulfillment, according to appendix 5 to this order (further – Appendix 5).

2. To provide to department of the budget crediting, National fund of the Republic of Kazakhstan and interaction concerning the financial sector of the Ministry of Finance of the Republic of Kazakhstan in the procedure established by the legislation of the Republic of Kazakhstan:

1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

2) placement of this order on Internet resource of the Ministry of Finance of the Republic of Kazakhstan after day of its official publication;

3) within ten working days after state registration of this order in the Ministry of Justice of the Republic of Kazakhstan submission to Department of legal service of the Ministry of Finance of the Republic of Kazakhstan of data on execution of the actions provided by subitems 1) and 2) of this Item.

3. This order becomes effective after ten calendar days after day of its first official publication.

At the same time to determine that Items 20, of 22, 35 and 37 Appendices 1 to this order, Item 8 of Appendix 2 to this order, items 4 and 7 Appendices 3 to this order and Item 3 of Appendix 5 to this order are effective till December 31, 2025 inclusive.

Chapter 1. General provisions

1. These Procedures for provision of budget credits, including the list of the documents necessary in case of their provision, and also methods of provision of budget credit, the repayment schedule and servicing of budget credit, the procedure of restructuring of budget credit and replacement of the borrower, conditions of limitation period, condition of the translation of debt on budget credit, the terminations of requirements of creditors and the termination of guarantee on budget credits, control procedures on budget credits (further – Procedures) are developed in realization of Item 16 of Article 154 and Item 2 of Article 156 of the Budget code of the Republic of Kazakhstan (further – the Budget code) and determine procedure for provision, use, servicing, repayment of budget credit, monitoring of use of budget credit, and also methods of provision of budget credit, the repayment schedule and servicing of budget credit, the procedure of restructuring of budget credit and replacement of the borrower, conditions of limitation period, condition of the translation of debt on budget credit, the termination of requirements of creditors and the termination of guarantee on budget credits, control procedures on budget credits.

The budget crediting is performed by provision of budget credits from republican and local budgets to borrowers, including for the subsequent crediting of final borrowers.

2. Budget credits are granted on the purpose and within the amounts provided by the appropriate budget programs:

in the approved republican budget for the current financial year;

in the maslikhats approved by decisions local budgets the current financial year.

3. In these Procedures the following concepts are used:

1) development of budget credit – transfer process and uses of budgetary funds for achievement of effective objectives and tasks by the parties of the credit agreement;

2) efficiency of use of means of budget credit – ratio of actually achieved results with planned, taking into account the resources used for their achievement and industry features of development plans for the administrator of the budget program;

3) monitoring of use of budget credits is process of regular observation, collection and information analysis about expenditure of means of budget credit, achievement of indicators of direct and final results, for the purpose of efficiency evaluation of use of means of budget credit;

4) the integrated automated information system E-Ministry of Finance (further – IAIS "E-Ministry of Finance") – the information system intended for complex automation of business processes of the Ministry of Finance of the Republic of Kazakhstan on execution of the state functions and provision of the state services;

5) the creditor – the party of the credit agreement granting budget credit according to the budget and civil legislation of the Republic of Kazakhstan;

6) the borrower – the party of the credit agreement obtaining budget credit which incurs obligations on repayment of principal debt and payment of remuneration, and also other payments according to the credit agreement;
