1. Approve Rules of interaction of Committee of telecommunications of the Ministry of digital development, innovations and the aerospace industry of the Republic of Kazakhstan and Committee of state revenues of the Ministry of Finance of the Republic of Kazakhstan on provision of confidential information in the field of customs regulation on subscriber devices of cellular communication.

2. To committee of telecommunications of the Ministry of digital development, innovations and aerospace industry of the Republic of Kazakhstan, and Committee of state revenues of the Ministry of Finance of the Republic of Kazakhstan, in the procedure established by the legislation of the Republic of Kazakhstan to provide placement of this joint order on Internet resources of Committees.

3. To impose control of execution of this joint order on the supervising deputy chairmen of Committee of telecommunications of the Ministry of digital development, innovations and the aerospace industry of the Republic of Kazakhstan and Committee of state revenues of the Ministry of Finance of the Republic of Kazakhstan

4. This joint order becomes effective from the date of signing its the last of heads of state body.

Chapter 1. General provisions

1. These rules of interaction of Committee of telecommunications of the Ministry of digital development, innovations and aerospace industry of the Republic of Kazakhstan and Committee of state revenues of the Ministry of Finance of the Republic of Kazakhstan on provision of confidential information in the field of customs regulation on subscriber devices of cellular communication (further - Rules) are developed according to the subitem 3) of Item 3 of article 19 of the Code of the Republic of Kazakhstan "About customs regulation in the Republic of Kazakhstan" and with the subitem 8) of Item 15 of the Regulations on republican public institution "Committee of telecommunications of the Ministry of digital development, innovations and the aerospace industry of the Republic of Kazakhstan", the acting minister of digital development, innovations approved by the order and the aerospace industry of the Republic of Kazakhstan of August 9, 2019 No. 189/Tax Code.

2. These rules establish order of interaction on provision of confidential information in the field of customs regulation on subscriber devices of cellular communication (further - Data), from information systems of Committee of state revenues of the Ministry of Finance of the Republic of Kazakhstan (further – KGD) in information system of monitoring and identification of subscriber devices of Committee of telecommunications of the Ministry of digital development, innovations and the aerospace industry of the Republic of Kazakhstan.

3. The information is provided according to the list according to appendix 1 to these rules.

4. In these rules the following basic concepts and reducings are used:

1) the subscriber structure of cellular communication (the subscriber device) – the means of communication of individual use creating signals of electric communication for transfer or acceptance of information, connected to network of cellular communication. For the purposes of these rules subscriber devices are understood as the goods imported into the Republic of Kazakhstan by codes to the commodity nomenclature of foreign economic activity of the Eurasian Economic Union (further – the CN FEA EEU) according to appendix 2 to these rules;

2) the database of Association of global system of mobile communication (further – GSMA) – the international information resource intended for unambiguous identification of the producer and model of the subscriber device on its identification code, containing including data on the blocked mobile devices included in the black list of GSMA at the international level;

3) verification of the subscriber structure of cellular communication – verification of data on the subscriber structure of cellular communication in the way:

identifications of the subscriber structure of cellular communication in GSMA;

monitoring of data on production and (or) repair of subscriber devices of cellular communication in the territory of the Republic of Kazakhstan in the procedure established by the legislation of the Republic of Kazakhstan, and (or) data on import of subscriber devices of cellular communication to the territory of the Republic of Kazakhstan according to the customs legislation of the Republic of Kazakhstan;
