Chapter 1. General provisions

1. These rules of removal at consideration of the Republican budget commission of questions of reduction of the amount of payments or exemption of receipts in the republican budget of dividends or part of net income for the list of the state companies, joint-stock companies, limited liability partnerships, the state blocks of shares (shares in the authorized capital) which are in republican property (further – Rules) are developed according to the subitem 1) of Item 3 of Article 56 of the Budget code of the Republic of Kazakhstan (further – the Budget code) and determine procedure for removal at consideration of the Republican budget commission (further – the Commission) questions of reduction of the amount of payments or exemption of receipts in the republican budget of receipts of dividends or part of net income by the list of the republican state companies, and also joint-stock companies and limited liability partnerships, the state blocks of shares (shares in the authorized capital) which are in republican property (further – the Organizations).

2. In these rules the following basic concepts are used:

1) authorized body on the budget policy – the central executive body performing management and also in limits, stipulated by the legislation the Republic of Kazakhstan, cross-industry coordination in the field of the budget policy, including in the field of development of the budget system, management of public finances and forecasting of the income, economic policy, policy of investment attraction, public-private partnership, the state investment projects, the interbudget relations, the state and guaranteed by the state borrowing and debt, management of the state assets, attraction and within the competences established by the Budget code, uses of grants;

2) the central authorized body on budget implementation – the central executive body performing management and also in limits, stipulated by the legislation the Republic of Kazakhstan, cross-industry coordination in the field of budget implementation, conducting financial accounting, the budget accounting and budget reports on execution of the republican budget and within the competence – local budgets, off-budget funds;

3) authorized body on management of the corresponding industry (sphere) of public administration (further – authorized body of the corresponding industry) – the central executive body or department of the central executive body determined by the Government of the Republic of Kazakhstan, which are performing management of the corresponding industry (sphere) of public administration and having rights concerning republican property on the conditions provided by the Law of the Republic of Kazakhstan "About state-owned property" and other laws of the Republic of Kazakhstan.

Chapter 2. Procedure for removal at consideration of the Republican budget commission of questions of reduction of the amount of payments or exemption of receipts in the republican budget of dividends or part of net income for the list of the state companies, joint-stock companies, limited liability partnerships, the state blocks of shares (shares in the authorized capital) which are in republican property

3. The authorized body of the corresponding industry sends to authorized body on budget implementation and authorized body on the budget policy through electronic document management system the petition for reduction of the amount of payments or for exemption of receipts in the republican budget of dividends or part of net income of the Organizations.

The petition is submitted no later than the beginning of forming of the draft of the republican budget and (or) refining of the republican budget in time.

The petition the reductions of the amount of payments or remission of receipts provided in the course of budget implementation and providing in the republican budget of dividends or part of net income of the Organizations in the current financial year are not subject to consideration.
