About approval of Rules for apportionment of reserve on initiatives of the President of the Republic of Kazakhstan

1. Approve the enclosed Rules for apportionment of reserve on initiatives of the President of the Republic of Kazakhstan.
1) the order of the Government of the Republic of Kazakhstan of August 5, 2021 No. 528 "About approval of Rules for apportionment of reserve on initiatives of the President of the Republic of Kazakhstan";
2) the order of the Government of the Republic of Kazakhstan of January 24, 2024 No. 30 "About modification of the order of the Government of the Republic of Kazakhstan of August 5, 2021 No. 528 "About approval of Rules for apportionment of reserve on initiatives of the President of the Republic of Kazakhstan".
3. This resolution becomes effective after ten calendar days after day of its first official publication.

1. These rules of distribution of reserve to initiatives of the President of the Republic of Kazakhstan (further - Rules) are developed according to Item 3 of Article 18 of the Budget code of the Republic of Kazakhstan and determine procedure for distribution of reserve to initiatives of the President of the Republic of Kazakhstan.
2. The reserve on initiatives of the President of the Republic of Kazakhstan is created as a part of the republican budget for the first year of planning period in the amount of at least one and a half and no more than three percent from the planned amount of the income of the republican budget for the next financial year without receipts of transfers for financing of the unforeseen and requiring immediate financing in the current financial year costs connected with implementation of annual president's letters of the Republic of Kazakhstan to the people of Kazakhstan and other initiatives of the President of the Republic of Kazakhstan.
3. The reserve on initiatives of the President of the Republic of Kazakhstan is provided according to the separate distributed budget program administered by the central authorized body on budgetary planning and is distributed within the current financial year.
4. Based on orders of the President of the Republic of Kazakhstan, within implementation of annual president's letters of the Republic of Kazakhstan to the people of Kazakhstan and other initiatives of the President of the Republic of Kazakhstan connected with unforeseen costs, requiring immediate financing in the current financial year, the corresponding administrator of the budget programs sends to the central authorized body on budgetary planning the petition with calculations and reasons according to the budget legislation of the Republic of Kazakhstan.
5. Consideration of the petition with calculations and reasons by the central authorized body for budgetary planning provided by the administrator of the budget programs is performed within 5 (five) working days from the date of its receipt.
6. In cases of representation of incomplete packet and (or) availability of notes according to the submitted documents the central authorized body on budgetary planning returns them on completion.
The administrator of the budget programs represents modifed materials to the central authorized body on budgetary planning within 5 (five) working days from the date of their return.
7. The administrator of the budget programs provides completeness and accuracy of the information and calculations.
8. The central authorized body on budgetary planning following the results of consideration of materials creates the conclusion on the petition and within 5 (five) working days introduces the conclusion with materials on coordination in Administration of the President of the Republic of Kazakhstan.
After receipt of the conclusion approved by Administration of the President of the Republic of Kazakhstan, the administrator of the budget programs prepares the draft of the order of the Government of the Republic of Kazakhstan about assignment from reserve for initiatives of the President of the Republic of Kazakhstan.
In case of the negative conclusion of Administration of the President of the Republic of Kazakhstan assignment from reserve for initiatives of the President of the Republic of Kazakhstan is not performed.
In case of simultaneous distribution of means to several administrators of the budget programs the draft of the order of the Government of the Republic of Kazakhstan about assignment from reserve for initiatives of the President of the Republic of Kazakhstan is developed by the central authorized body on budgetary planning.
9. After decision making by the Government of the Republic of Kazakhstan about assignment from reserve for initiatives of the President of the Republic of Kazakhstan in course of execution of the budget administrators of the budget programs within 5 (five) working days make changes to the corresponding funding plans.
10. Use of the funds allocated from reserve for initiatives of the President of the Republic of Kazakhstan is performed according to the requirements of the Budget code of the Republic of Kazakhstan, procedures of treasurer budget implementation and their cash servicing determined by the central authorized body by budget implementation (further - procedures of treasurer budget implementation).
11. In case of non-use within financial year of the money allocated from reserve for initiatives of the President of the Republic of Kazakhstan, the corresponding administrator of the budget program provides return of the allocated money by recovery of reserve for initiatives of the President of the Republic of Kazakhstan till December 20 of the current financial year.
The administrator of the budget program provides return of money, unused within financial year, economy of budgetary funds and (or) remaining balance of unused part of the allocated money from reserve for initiatives of the President of the Republic of Kazakhstan by recovery of reserve on initiatives of the President of the Republic of Kazakhstan till December 20 of the current financial year and modification of the corresponding funding plans according to the procedure, determined by procedures of treasurer budget implementation.
