About some questions of the alienation of the state-owned property which is outside the Republic of Kazakhstan and assigned to bodies of diplomatic service abroad

According to Item 2 of Article 93 and Item 5 of article 94 of the Law of the Republic of Kazakhstan "About state-owned property" the Government of the Republic of Kazakhstan DECIDES:

1. Determine the Ministry of Foreign Affairs of the Republic of Kazakhstan the seller concerning the state-owned property which is outside the Republic of Kazakhstan and assigned to bodies of diplomatic service abroad.

2. Approve the enclosed Rules of the alienation of the state-owned property which is outside the Republic of Kazakhstan and assigned to bodies of diplomatic service abroad.

3. This resolution becomes effective after ten calendar days after day of its first official publication.

The rule of alienation of the state-owned property which is outside the Republic of Kazakhstan and assigned to bodies of diplomatic service abroad

Chapter 1. General provisions

1. These rules of the alienation of the state-owned property which is outside the Republic of Kazakhstan and assigned to bodies of diplomatic service abroad (further – Rules), are developed according to Item 5 of article 94 of the Law of the Republic of Kazakhstan "About state-owned property" (further – the Law), subitem 214-24) of Item 15 of the Regulations on the Ministry of Foreign Affairs of the Republic of Kazakhstan approved by the order of the Government of the Republic of Kazakhstan of October 28, 2004 No. 1118, and regulate procedure for the alienation of the state-owned property which is outside the Republic of Kazakhstan and assigned to bodies of diplomatic service abroad (further – subject to privatization), at the biddings in the form of auction and the tender taking into account the legislation of adoptive state.

Action of these rules does not extend to the subjects to privatization transferred based on international treaties of the Republic of Kazakhstan.

2. In these rules the following basic concepts are used:

1) current price – the price of subject to privatization developing during trading in the form of auction on advance in price, or the announced price developing during trading in the form of auction on reduction in price;

2) the initial price – the price of subject to privatization determined based on the valuation report of project cost of privatization submitted by independent consultants or the appraiser, and established according to the decision of the commission on questions of alienation of subjects to privatization (further – the commission) in the amount of book or estimated value depending on what cost will be the greatest;

3) auction – form of the biddings in case of which participants declare the offers publicly;

4) the salesroom – the room intended for holding the auction;

5) auction number – number assigned by foreign institution of the Republic of Kazakhstan to the participant for participation in auction;

6) the auctioneer – the personnel of foreign institution of the Republic of Kazakhstan holding auction;

7) the starting price – the price with which the biddings on each subject to privatization begin;

8) minimum price – the price below which subject to privatization cannot be sold;

9) subject to privatization – the personal and real estate which is outside the Republic of Kazakhstan and assigned to bodies of diplomatic service abroad;

10) the winner – the bidder who offered top price for subject to privatization;

11) the guarantee fee – the sum of money given by the payer of the guarantee fee to the receiver of the guarantee fee to ensuring obligation fulfillment according to the conclusion of the purchase and sale agreement during the biddings or execution of other obligation;

12) the commission – the collegiate organ created by the seller for consideration of the questions connected with alienation of subjects to privatization;

13) foreign institution of the Republic of Kazakhstan – the diplomatic and equated to it representation being abroad, and also consular establishment of the Republic of Kazakhstan;

14) the participant – the physical person or legal entity registered in accordance with the established procedure for participation at the biddings;

15) selling price – the final price of subject to privatization established as a result of the biddings;
