RESOLUTION OF THE CABINET OF MINISTERS OF UKRAINE

About transformation of registers of certificates of approval of type and certificates of conformity of wheel vehicles and the equipment and introduction of amendments to some Resolutions of the Cabinet of Ministers of Ukraine

According to part two of article 27 of the Law of Ukraine "About public electronic registers" the Cabinet of Ministers of Ukraine decides:

1. Determine that:

the register of certificates of approval of type and the certificates of conformity of wheel vehicles and the equipment issued by producers and the State register of the certificates of conformity of vehicles issued by authorized bodies or certification bodies turn into the register of certificates of approval of type and the certificates of conformity of wheel vehicles and the equipment issued by producers (further - the register of certificates) by consolidation;

transformation of the register of certificates of approval of type and the certificates of conformity of wheel vehicles and the equipment and the State register of the certificates of conformity of vehicles issued by authorized bodies or certification bodies issued by producers on the register of certificates is performed after its input in operation and registration in the register of public electronic registers;

subjects of the register of certificates is information on certificates of approval of type and certificates of conformity of wheel vehicles, batches of the parts and the equipment issued by producers, authorized bodies on certification and certification bodies for individual approval of wheel vehicles, batches of parts and the equipment;

transformation of the register of certificates of approval of type and the certificates of conformity of wheel vehicles and the equipment and the State register of the certificates of conformity of vehicles issued by authorized bodies or certification bodies issued by producers is provided using the certified means of technical and cryptographic information security;

Public service on safety on transport is holder of the register of certificates and provides open access in real time for users to information on certificates of approval of type and certificates of conformity of wheel vehicles and/or the equipment containing in the register of certificates, on a grant basis;

all paper certificates of approval of type and certificates of conformity of wheel vehicles, batches of parts and the equipment issued by producers, authorized bodies on certification and certification bodies for individual approval of wheel vehicles, batches of parts and the equipment before creation of the register of certificates are considered as operating and are not subject to replacement;

information from the registers transformed according to the paragraph to the second this Item containing on papers is transferred to the register of certificates;

transfer in the register of certificates of information on certificates of approval of type and certificates of conformity of wheel vehicles, batches of parts and the equipment, issued before creation of the register of certificates, is performed within 180 calendar days after creation of the register of certificates according to part two of article 8 of the Law of Ukraine "About public electronic registers";

information from the registers transformed according to the paragraph to the second this Item before its transfer in the register of certificates in the time established by this resolution has identical legal force with information which is created in the register of certificates electronically;

transfer in the register of certificates of information on certificates of type and certificates of conformity of wheel vehicles and the equipment issued by producers issued before creation of the register of certificates is performed by Public service on safety on transport by implementation of digitization of the existing information and its carriers;

transfer in the register of the certificates of information on certificates of conformity issued by authorized bodies on certification and certification bodies for individual approval of wheel vehicles, batches of parts and the equipment before creation of the register of certificates is performed by responsible persons of authorized bodies on certification and certification bodies for individual approval of wheel vehicles, batches of parts and the equipment by implementation of digitization of the existing information and its carriers;

the procedure and amounts of transfer in the register of certificates of information on certificates of approval of type and certificates of conformity of wheel vehicles, batches of parts and the equipment issued before creation of the register of certificates are determined by the Ministry of development of communities and territories;

informing the public on transformation of registers is performed in week time after registration of the register of certificates in the register of public electronic registers by promulgation on the official website of the Ministry of development of communities and the territories.

2. Make changes which are applied to resolutions of the Cabinet of Ministers of Ukraine.

Changes which are made to Resolutions of the Cabinet of Ministers of Ukraine

1. According to the procedure of state registration (re-registration), removal from accounting of cars, buses, and also the self-propelled machines designed on the chassis of cars, motorcycles of all types, brands and models, trail cars, semitrailer trucks, microcars, other vehicles and mopeds equated to them, No. 1388 approved by the resolution of the Cabinet of Ministers of Ukraine of September 7, 1998 (The Official Bulletin of Ukraine, 1998, No. 36, Art. 1327; 2009, No. 101, Art. 3521; 2021, No. 1, Art. 39; 2023, No. 60, Art. 3387, No. 78, Art. 4426):

Shall be replaced with words 1) in Item 10 and paragraph one of Item 15 of the word "The State Register of the Certificates of Conformity of Vehicles Issued by Authorized Bodies or Certification Bodies, and the Register of the Issued Certificates like Vehicles and the Equipment Which Is Created according to Messages of Authorized Bodies, and the Certificates of Conformity of New Vehicles Issued by the Producer" in all cases "the register of certificates of approval of type and certificates of conformity of wheel vehicles and the equipment issued by producers" in the corresponding case;

Second and third Item 37 of the word "The state register of the certificates of conformity of vehicles issued by authorized bodies on certification or certification bodies" shall be replaced with words 2) in paragraphs "the register of certificates of approval of type and the certificates of conformity of wheel vehicles and the equipment issued by producers".
