Based on the paragraph of the fourteenth of Article 14, of Item 10 of article 38 of the Law of the Republic of Belarus of July 22, 2002 No. 133-Z "About state registration of real estate, the rights to it and transactions with it", subitem 5.1 of Item 5 of the Regulations on the State committee on property of the Republic of Belarus approved by the resolution of Council of Ministers of the Republic of Belarus of July 29, 2006 No. 958, the State committee on property of the Republic of Belarus DECIDES:

1. Approve the Instruction about procedure for the organization of implementation of state registration of real estate, the rights to it and transactions with it, entering of corrections into the single state register of real estate, the rights to it and transactions with it it (is applied).

2. This resolution becomes effective since June 11, 2025.

The instruction about procedure for the organization of implementation of state registration of real estate, the rights to it and transactions with it, entering of corrections into the single state register of real estate, the rights to it and transactions with it

1. This Instruction determines procedure for the organization of implementation of state registration of real estate, the rights to it and transactions with it (further - state registration), entering of corrections into the single state register of real estate, the rights to it and transactions with it (further - introduction of corrections) concerning the parcels of land, capital structures (buildings, constructions), the incomplete preserved capital structures, the isolated rooms, parking places, the companies as property complexes in case of personal giving or giving electronically by means of the single portal of electronic services of the nation-wide automated information system of documents for implementation of state registration and introduction of corrections, and also the direction by the notary of documents according to part one of Item 1 and Item 2 of article 7 of the Law of the Republic of Belarus "About state registration of real estate, rights to it and transactions with it".

2. The documents submitted for implementation of state registration and (or) introduction of corrections concerning the parcels of land, capital structures (buildings, constructions), the incomplete preserved capital structures, the isolated rooms, parking places (further - real estate units) move the citizen, including the individual entrepreneur, the legal entity authorized on signing of the statement for state registration and (or) introduction of corrections (his representative) (further - the applicant (the applicant's representative)), in any territorial organization for state registration of real estate, the rights to it and transactions with it (further - the territorial organization for state registration).

The documents submitted for implementation of state registration and (or) introduction of corrections concerning the companies as property complexes move the applicant (the applicant's representative) in the republican organization for state registration of real estate, the rights to it and transactions with it (further - the republican organization for state registration).

Documents acceptance is provided with the registrar or the other person authorized on acceptance of such documents by the head of the republican organization for state registration, the territorial organization for state registration (further - the authorized person).

3. The subsequent stages of making of registration actions and (or) introduction of corrections concerning real estate units are performed by the registrar of the territorial organization for the state registration performing activities in the respective registration district, except as specified, provided in items 4 and the 8th this Instruction.

The subsequent stages of making of registration actions and (or) introduction of corrections concerning the companies as property complexes are performed by the registrar of the republican organization for state registration.

The documents submitted for implementation of state registration and (or) introduction of corrections, accepted by the authorized person are transferred for making of the subsequent stages of registration actions and (or) introduction of corrections to the registrar of the republican organization for state registration or the territorial organization for state registration taking into account terms of making of registration actions and (or) introduction of corrections.

4. In case of submission of documents in the republican unitary enterprise "Minsk City State Registration Agency and Land Cadastre" or the republican unitary enterprise "Minsk Regional State Registration Agency and Land Cadastre" concerning the real estate units located in the territory of Minsk city or Minsk regional registration districts, state registration and (or) introduction of corrections are performed by the registrar of the territorial organization for state registration to which documents are filed.

5. The applicant (the applicant's representative) to personal documents acceptance is informed by the registrar or the authorized person about:

the size and method of introduction of payment for implementation of state registration and (or) introduction of corrections and details of the relevant territorial organization for state registration for its introduction;

the amount of the state tax for issue (registration) of right certifying documents on the parcels of land and the details necessary for its payment.

6. In case of implementation of state registration and (or) introduction of corrections according to part one of Item 3 of this Instruction the payment is deposited to account the territorial organization for state registration which registrar makes registration action and (or) introduction of corrections. The territorial organization for state registration which received the specified payment transfers twenty percent from the received amount of the territorial organization for the state registration which provided documents acceptance.

7. Storage of originals of the statements created on paper is performed in the territorial organization for state registration, the registrar or the authorized person of which perform documents acceptance.

8. The documents directed by the notary, and which are the basis for state registration and (or) introduction of corrections are distributed by the state information system "Unified Register of Property" in:
