About territorial defense of the Republic of Kazakhstan

This Law governs the public relations in the field of territorial defense of the Republic of Kazakhstan.

Chapter 1. General provisions

Article 1. The basic concepts used in this Law

In this Law the following basic concepts are used:

1) zone of territorial defense - the part of the territory of the Republic of Kazakhstan determined by borders of the respective areas, cities of republican value, the capital;

2) the plan of territorial defense - the set of the interconnected documents determining procedure for holding actions for preparation, expansion and functioning of territorial defense;

3) the volunteer - the citizen of the Republic of Kazakhstan enlisted on voluntary basis in self-defense forming, except as specified, established by the laws of the Republic of Kazakhstan;

4) territorial authorities of territorial troops of Armed Forces of the Republic of Kazakhstan - the tactical bodies of military management of areas, cities of republican value, the capital and their division functioning in peace time as military units of Armed Forces of the Republic of Kazakhstan;

5) territorial troops of Armed Forces of the Republic of Kazakhstan (further - territorial troops) - the bodies of military management, military units and their divisions which are component of Armed Forces of the Republic of Kazakhstan, created within border of administrative and territorial unit and intended for accomplishment of tasks of territorial defense of the Republic of Kazakhstan;

6) subjects to territorial defense of the Republic of Kazakhstan (further - subjects to territorial defense) - objects of military and state value, and also other objects irrespective of patterns of ownership;

7) territorial defense of the Republic of Kazakhstan (further - territorial defense) - set of the military and nation-wide measures in system of defense performed by forces of territorial defense during mobilization, warlike situation and in wartime;

8) self-defense forming - the forming formed and completed by bodies of military management in the period of warlike situation and in wartime from among volunteers for participation in preparation and accomplishment of tasks of territorial defense.

Article 2. The legislation of the Republic of Kazakhstan in the field of territorial defense

1. The legislation of the Republic of Kazakhstan in the field of territorial defense is based on the Constitution of the Republic of Kazakhstan and consists of this Law and other regulatory legal acts of the Republic of Kazakhstan.

2. The international agreements ratified by the Republic of Kazakhstan have priority before this Law. The procedure and conditions of action in the territory of the Republic of Kazakhstan of international treaties which participant is the Republic of Kazakhstan are determined by the legislation of the Republic of Kazakhstan.

Article 3. Purpose and tasks of territorial defense

1. The purpose of territorial defense is protection of the population, subjects to territorial defense and the territory of the Republic of Kazakhstan against actions of the opponent during mobilization, warlike situation and in wartime.

2. Tasks of territorial defense are:

1) protection and defense of the territory of the Republic of Kazakhstan, settlements, protection of the population;

2) protection and defense of subjects to territorial defense according to plans of territorial defense;

3) participation in providing the mode of warlike situation in all territory of the Republic of Kazakhstan or in its certain areas;

4) participation in fighting, including in boundary space of the Republic of Kazakhstan;

5) participation in fight against landing and diversionary and prospecting forces of the opponent and terrorist groups;

6) conducting armed struggle on temporarily taken (occupied) opponent territory of the Republic of Kazakhstan;

7) other tasks according to the laws of the Republic of Kazakhstan.

Article 4. Principles of territorial defense

The principles of territorial defense are:

1) legality;

2) one-man management;

3) territoriality and mass character;

4) unity of approaches to the organization of territorial defense;

5) obligation of holding actions of territorial defense;
