About approval of Rules of the choice of auditing organization for carrying out annual external audit of National fund of the Republic of Kazakhstan

According to Item 1 of Article 64 of the Budget code of the Republic of Kazakhstan the Government of the Republic of Kazakhstan DECIDES:

1. Approve the enclosed Rules of the choice of auditing organization for carrying out annual external audit of National fund of the Republic of Kazakhstan.

2. Recognize invalid:

1) the order of the Government of the Republic of Kazakhstan of May 8, 2013 No. 474 "About approval of Rules of the choice of auditing organization for carrying out annual external audit of National fund of the Republic of Kazakhstan";

2) the order of the Government of the Republic of Kazakhstan of February 6, 2020 No. 43 "About modification and amendments in the order of the Government of the Republic of Kazakhstan of May 8, 2013 No. 474 "About approval of Rules of the choice of auditing organization for carrying out annual external audit of National fund of the Republic of Kazakhstan".

3. This resolution becomes effective after ten calendar days after day of its first official publication and extends to the legal relationship which arose since January 1, 2025.

Rules of the choice of auditing organization for carrying out annual external audit of National fund of the Republic of Kazakhstan

Chapter 1. General provisions

1. These rules of the choice of auditing organization (further – Rules) are developed for carrying out annual external audit of National fund of the Republic of Kazakhstan according to Item 1 of Article 64 of the Budget code of the Republic of Kazakhstan and determine procedure for the choice of auditing organization for carrying out annual external audit of National fund of the Republic of Kazakhstan (further – National fund).

2. The basic concepts used in these rules:

1) voting ballot – voting bulletin at the correspondence meeting of the contest committee on the questions put to the vote;

2) working body (the organizer of tender) – the central authorized body on budget implementation performing all actions for the organization and carrying out tender at the choice of auditing organization for carrying out annual external audit of National fund (further – tender), and also authorized by the Government of the Republic of Kazakhstan on agreement signature on carrying out external audit of National fund of the Republic of Kazakhstan;

3) the contest committee – the collegiate organ created for the purpose of carrying out tender and determination of the winner;

4) the participant of tender – the legal entity who showed willingness to participate in tender;

5) the tender documentation – the documentation submitted to the participant of tender for preparation of the bid, consisting of the copy of these rules and the announcement of carrying out tender;

6) the bid – the list of the documents submitted by the participant of tender on participation in tender in accordance with the terms and the requirements provided by these rules.

3. The choice of auditing organization is performed by carrying out the tender directed to identification of optimum conditions of carrying out external audit of National fund.

4. Competition is held each 2 (two) years for determination of auditing organization with representation of results of annual audit of National fund in the form of the audit report to the financial reporting and the analytical report.

Chapter 2. Procedure for the organization of activities of the contest committee

5. For carrying out tender on representation of members of council on management of National fund of the Republic of Kazakhstan (further – Council for management of National fund) the contest committee, in number of 9 (nine) people which part members of council on management of National fund or their representatives are is created.

The structure of the contest committee includes the chairman, the vice-chairman, members of the contest committee who affirm the order of the Government of the Republic of Kazakhstan, and also the secretary of the contest committee who is the employee of working body is elected.

The secretary of the contest committee is determined from among officials of structural division of the working body responsible for the organization and carrying out tender, according to the order of the first head of working body.

The secretary of the contest committee is not member of the contest committee and has no right to vote in case of adoption of decisions by the contest committee.

In the order of the Government of the Republic of Kazakhstan are reflected:

1) structure of the contest committee;

2) the order about carrying out tender and determination by its results of the winner of tender;

3) terms of carrying out tender.

6. Meetings of the contest committee are held in internal or correspondence forms.

Full-time of meetings of the contest committee is carried out in case of:

1) opening of envelopes with bids;

2) to assessment of technical and financial proposals of participants of tender;

3) summing up tender.

The correspondence form of meetings of the contest committee is carried out in case of:

1) approval by members of the contest committee of the text of the announcement of carrying out tender, and also the text of the announcement on carrying out repeated tender;

2) tender recognition by cancelled;

3) adoption by the contest committee of the decision on signing of standard form of the contract for carrying out external audit of National fund of the Republic of Kazakhstan (further – the agreement), according to appendix 1 to these rules, with the participant of tender or with other participant of tender if the participant of tender who is recognized as the winner of tender does not sign the agreement at the scheduled time.

7. All organizational actions for carrying out tender are assigned to working body.

The working body till June 1 of the corresponding year introduces to the Government of the Republic of Kazakhstan the draft of the order of the Government of the Republic of Kazakhstan about education of the contest committee in accordance with the terms of Item 5 of these rules.

The working body within 10 (ten) working days from the date of adoption of the order of the Government of the Republic of Kazakhstan about education of the contest committee approves with members of the contest committee the text of the announcement of carrying out tender taking into account requirements of Item 14 of these rules.

8. The chairman of the contest committee (further – the chairman) or in case of its absence the vice-chairman of the contest committee (further – the vice-chairman):

1) direct activities of the commission;

2) preside over commission sessions;

3) plan work of the commission.

The chairman of the contest committee or in case of its absence the vice-chairman hold meetings of the contest committee, approve the text of the announcement of carrying out tender or the text of the announcement of carrying out repeated tender.

In case of tender recognition cancelled according to Item 77 of these rules the chairman of the contest committee or in case of its absence the vice-chairman hold the regular meeting at which the question of approval of the text of the announcement of carrying out repeated tender is considered.

After acceptance by the chairman of the contest committee or in case of its absence the vice-chairman of the decision on holding meeting of the contest committee on approval of the text of the announcement of carrying out tender or the text of the announcement of carrying out repeated tender the working body sends to members of the contest committee of the notification in writing with appendix of the draft of the text of the announcement of carrying out tender or the draft of the text of the announcement of carrying out repeated tender.

In case of holding the correspondence meeting of the contest committee about approval of the text of the announcement of carrying out tender or the text of the announcement of carrying out repeated tender the voting ballot (further – the bulletin) in form according to appendix 2 to these rules is applied to the notification in writing with appendix of the draft of the text of the announcement of carrying out tender or the draft of the text of the announcement of carrying out repeated tender by working body.

After coordination of the text of the announcement of carrying out tender or the text of the announcement of carrying out repeated tender the working body provides its publication in republican periodic printing editions and placement on the website of working body.

9. Organizational activities of the contest committee are provided with the secretary of the contest committee who:

1) is created by the text of the announcement of carrying out tender according to requirements of Item 14 of these rules;

2) submits to participants of tender the tender documentation;

3) is conducted by the magazine of registration of participants of tender, the tender documentation and bids for carrying out annual external audit of National fund of the Republic of Kazakhstan (further – the magazine of registration) in form according to appendix 3 to these rules;

4) accepts from participants of tender envelopes with bids;

5) creates the agenda of meeting of the contest committee, provides the contest committee with necessary documents, will organize holding meeting of the contest committee;

Draws up 6) and signs protocols of meetings of the contest committee (further – the protocol) according to appendix 4 to these rules;

7) ensures safety of documents of tender from the moment of opening of bids.

10. In the protocol of internal meeting all data on the held meeting, including notes, offers and opinions of members of the contest committee are fixed. The protocol is signed by the chairman, the vice-chairman, and also the present members of the contest committee and the secretary of the contest committee.

11. Meetings of the contest committee in internal or correspondence form are considered competent if at least two thirds of members of the contest committee of structure of the contest committee took part in vote. In case of equal separation of number of votes during the vote the voice of the chairman of the contest committee or in case of its absence of the vice-chairman is considered decisive.
