1. Determine that:

1.1. the qualification requirements imposed to the heads of the microfinancial, factoring, leasing organizations, persons fulfilling their duties more than four months, to heads of the operator of service of online borrowing, the foreign organization performing leasing activities in the Republic of Belarus through permanent mission are:

availability of the higher education as legal or economic profile or other higher education on condition of passing of retraining at the level of the higher education as legal or economic profile – for the head of the microfinancial organization, person fulfilling its duties more than four months;

the requirement specified in the paragraph the second this subitem or availability of other higher education as any profile and a length of service at least three years as the head of the organization (the division manager in the organization), but at least one year as the head of the organization performing financial transactions – for heads of the factoring, leasing organizations, persons fulfilling their duties more than four months, the head of the foreign organization performing leasing activities in the Republic of Belarus through permanent mission;

the requirement specified in the paragraph the second this subitem or availability of the higher education as technical profile or other higher education on condition of passing of retraining at the level of the higher education as technical profile – for the head of the operator of service of online borrowing;

1.2. requirements to goodwill imposed to the heads of the microfinancial, factoring, leasing organizations, persons fulfilling their duties more than four months, heads of the foreign organization performing leasing activities in the Republic of Belarus through permanent mission, the operator of service of online borrowing are:

1.2.1. lack of the outstanding or not removed criminal record. For heads of the leasing organization, the foreign organization performing leasing activities in the Republic of Belarus through permanent mission – lack of the outstanding or not removed criminal record for crime execution against property and procedure of economic activity;

1.2.2. lack of the resolution of criminal prosecution authority on initiation of legal proceedings concerning person or attraction it as the suspect or the person accused on criminal case;
