About approval of the Instruction for complex estimation of systemically important payment systems

According to Articles 7, of 15, 56 Laws of Ukraine "About the National Bank of Ukraine", article 82 of the Law of Ukraine "About payment services" and for the purpose of enhancement of approaches to implementation of complex estimation systemically of the important Board of the National Bank of Ukraine payment service providers decide:

1. Approve the Instruction for complex estimation of systemically important payment systems which is attached.

2. To department of payment systems and innovative development (Andrey Podderegin) after official publication to inform operators systemically of important payment systems information on adoption of this resolution.

3. To impose control over the implementation of this resolution on the vice-chairman of the National Bank of Ukraine Alexey Shaban.

4. The resolution becomes effective from the date of, its official publication following behind day.

Instruction for complex estimation of systemically important payment systems

I. General provisions

1. This Instruction determines methodology and criteria of complex estimation of the payment systems recognized by the National Bank of Ukraine (further - National Bank) systemically important, on compliance to international standards of oversight and to the requirements established by the legislation of Ukraine.

2. Terms in this Instruction are used in the following value:

1) division of oversight division of the National Bank performing oversight of payment infrastructure according to the legislation of Ukraine;

2) Principles - The principles for infrastructures of the financial market establishing international standards of oversight.

Other terms in this Instruction are used according to the definitions given in the Law of Ukraine "About payment services", other legal acts of Ukraine, Regulations on the procedure of oversight of payment infrastructure in Ukraine approved by the resolution of Board of the National Bank of Ukraine of August 24, 2022 No. 187 (further - No. Provision 187).

3. This Instruction is obligatory for National Bank.

Operators systemically of important payment systems perform self-assessment systemically of important payment system with use of methodology and the criteria of estimation determined by this Instruction.

Processes of self-assessment and assessment for systemically important payment systems which operator is the National Bank are identical.

4. This Instruction is developed taking into account requirements of the international standards of oversight of infrastructure of the financial market accepted by International settlements bank and International Organization of Securities Commissions.

5. The National Bank performs complex estimation systemically of important payment system, using:

1) the questionnaire for implementation of complex estimation (self-assessment) of systemically important payment systems given in appendix 1 to this Instruction;

2) the results of self-assessment of systemically important payment system which are drawn up in the form given in appendix 2 to this Instruction;

3) documents of systemically important payment system;

4) information and documents received from the operator of systemically important payment system at the request of National Bank;

5) results of monitoring of systemically important payment system / information from structural divisions of National Bank;

6) information arriving from public authorities;

7) information arriving from subjects and users of systemically important payment system;

8) conclusions of external auditors;

9) internal reports of governing bodies of object of oversight, and also reports on results of internal audit;

10) protocols by results of bilateral and multilateral negotiations of National Bank with subjects of systemically important payment system;

11) publicly available information on systemically important payment system;

12) results of interviewing of employees of operator of payment system.
