About approval of Rules of marking of separate types of construction materials in consumer packaging by means of identification and the features of implementation of the state information system of monitoring of turnover of goods which are subject to obligatory marking by means of identification concerning separate types of construction materials in consumer packaging

The government of the Russian Federation decides:

1. Approve the enclosed Rules of marking of separate types of construction materials in consumer packaging by means of identification (further - Rules).

2. Determine that participants of turnover of separate types of construction materials in consumer packaging (further - construction materials) according to Rules:

a) give to the state information system of monitoring of turnover of goods, subject to obligatory marking by means of identification (further - information system of monitoring), the statement for registration in information system of monitoring since September 1, 2025, but no later than 7 calendar days from the date of emergence of need of implementation by the participant of turnover of construction materials of the activities connected with input in turnover and (or) turnover, and (or) conclusion from turnover of construction materials concerning which the input prohibition in turnover, and (or) turnover, and (or) conclusion from turnover not marked by means of identification (except for participants of turnover of construction materials is established, the provisions of Items 3 and 7 of article 2 of the Federal law "About Use of the Control and Cash Equipment when Implementing Calculations in the Russian Federation" falling under action (further - participants of turnover of construction materials in the remote or remote areas). At the same time participants of turnover of construction materials in the remote or remote areas submit to information system of monitoring the application for registration in information system of monitoring within 30 calendar days from the date of emergence of need of implementation of the activities connected with input in turnover by them and (or) turnover, and (or) conclusion from turnover of construction materials;

b) provide no later than 15 calendar days from the date of registration in information system of monitoring readiness of own software and hardware for information exchange with information system of monitoring and direct to the operator of information system of monitoring the request electronically to passing of testing of information exchange of own software and hardware and information system of monitoring electronically;

c) for work on ensuring readiness of own software and hardware for information exchange with information system of monitoring and for passing of testing of such information exchange electronically after registration in information system of monitoring direct to the operator of information system of monitoring the request electronically to provision of remote access to the issue registration device placed in infrastructure of information system of monitoring;

d) pass test of information exchange of own software and hardware and information system of monitoring according to the procedure posted on the official site of the operator of information system of monitoring on the Internet concerning the transactions connected with marking of construction materials means of identification, their input in turnover, turnover and conclusion from turnover according to Rules no later than 15 calendar days from the date of the direction to the operator of information system of monitoring of the notification of the readiness of own software and hardware to information exchange with information system of monitoring on condition of the direction of the request according to the subitem "b" of this Item.

3. Determine that:

a) participants of turnover of construction materials concerning the construction materials relating to codes of the single Commodity nomenclature of foreign economic activity of the Eurasian Economic Union 2520, 2523 (except for 2523 10 000 0), 3816 00 000 0, 3824 50 900 0 and to codes of the All-Russian Product Classifier by types of economic activity 23.20. 13, 23.51. 12, 23.52. 20, 23.64.10, performing input in turnover of the specified construction materials, is put by means of identification and represent to information system of monitoring of the data on drawing means of identification and input in turnover of the specified construction materials according to Rules since October 1, 2025;

b) participants of turnover of construction materials concerning the construction materials relating to code of the single Commodity nomenclature of foreign economic activity of the Eurasian Economic Union 3214 (except for 3214 90 000 1) and to codes of the All-Russian Product Classifier by types of economic activity 20.30.22.120, 20.30.22.160, 20.30.22.170, 20.30.22.180, 20.30.22.210, 23.64.10.110, performing input in turnover of the specified construction materials, put means of identification and represent to information system of monitoring of the data on drawing means of identification and input in turnover of the specified construction materials according to Rules since December 1, 2025;

c) the participants of turnover of construction materials performing turnover and (or) conclusion from turnover of construction materials (as in case of conclusion from turnover when implementing calculations using the control and cash equipment, and different ways), represent to information system of monitoring of the data on turnover and about conclusion from turnover of construction materials according to Rules since December 1, 2026;

d) participants of turnover of construction materials within 1 month after approach of the corresponding dates established by subitems "an" and "b" of Item 3 of this resolution from which drawing means of identification becomes obligatory perform drawing funds of identification for the construction materials specified in item 4 of this resolution to their offer to realization (sale) and represent to information system of monitoring of the data on drawing means of identification according to Rules;

e) participants of turnover of construction materials in the remote or remote areas have the right to represent the data specified in the Section VIII of Rules within 30 calendar days:

from the date of shipment (transfer or acceptance) construction materials by transfer (acceptance) of construction materials within the transactions providing transition of the property right to the specified construction materials and also within commission agreements, and (or) agency agreements, and (or) works agreements, and (or) agreements of the order;

from the date of conclusion of construction materials from turnover in case of such conclusion;

from the date of return of construction materials to turnover in case of such return;

from the date of modification of the data provided by Sections III, IV and VIII of Rules, according to the procedure, provided by the Section IX of Rules (if changes were made to such data).

4. Within 1 month after approach of the corresponding dates established by subitems "an" and "b" of Item 3 of this resolution from which drawing means of identification becomes obligatory release by customs authorities imported (imported) into the Russian Federation and placed under customs procedures of release for internal consumption or reimport of the construction materials which are not marked by means of identification, the acquired earlier corresponding dates established by subitems "an" and "b" of Item 3 of this resolution is allowed.

5. In the presence as of the corresponding dates established by subitems "an" and "b" of Item 3 of this resolution from which drawing means of identification becomes obligatory in the territory of the Russian Federation of the unrealized construction materials made or imported into the Russian Federation before the specified dates their realization not marked means of identification it is allowed before the termination of warranty period of storage and (or) warranty period (concerning the construction materials relating to code of the single Commodity nomenclature of foreign economic activity of the Eurasian Economic Union 2523 (except for 2523 10 0) LLC and to code of the All-Russian Product Classifier by types of economic activity 23.51.12 according to requirements of the document for standardization) the specified construction materials.

At the same time delivery by producers of the construction materials which are not marked by means of identification specified in paragraph one of this Item is allowed till May 1, 2026.

6. Registration in the information system used for the purpose of carrying out experiment on marking by means of identification of separate types of construction materials in consumer packaging according to the order of the Government of the Russian Federation of March 12, 2024 No. 287 "About carrying out in the territory of the Russian Federation experiment on marking by means of identification of separate types of construction materials in consumer packaging" (further - experiment), legal entities and individual entrepreneurs who as of August 31, 2025 were participants of experiment is equated to registration in information system of monitoring according to the subitem "an" of Item 2 of this resolution.

If the data provided within the experiment by participants of turnover of construction materials to the information system used for the purpose of carrying out experiment do not meet the requirements of Rules, participants of turnover of construction materials represent to information system of monitoring missing and (or) urgent data before the corresponding dates established by subitems "an" and "b" of Item 3 of this resolution from which drawing means of identification and representation in information system of monitoring of data on drawing means of identification become obligatory.

7. Determine that the operator of information system of monitoring provides:

a) the organization of testing of information exchange of software and hardware of participants of turnover of construction materials and information system of monitoring no later than 15 calendar days from the date of obtaining from participants of turnover of the construction materials registered in information system of monitoring, the notification of the readiness to information exchange of the specified software and hardware with information system of monitoring;

b) provision to participants of turnover of construction materials of remote access to the issue registration devices placed in infrastructure of information system of monitoring on the conditions provided by Rules no later than 30 calendar days from the date of obtaining from participants of turnover of the construction materials registered in information system of monitoring, the request electronically for provision of remote access to the issue registration device placed in infrastructure of information system of monitoring.

8. Determine that in the territory of the Russian Federation input of construction materials in turnover without drawing means of identification and representation in information system of monitoring of data on marking of construction materials is allowed by means of identification before the corresponding dates established by subitems "an" and "b" of Item 3 of this resolution from which drawing means of identification becomes obligatory, except as specified, specified in items 4 and 5 these resolutions.

9. Operation of this resolution does not extend to construction materials to which according to Rules and international treaties of the Russian Federation requirements about obligatory marking by means of identification do not extend.

10. Determine what with approach of the corresponding dates established by subitems "an" and "b" of Item 3 of this resolution from which drawing means of identification becomes obligatory, provision for the participant of turnover of construction materials of the codes of marking necessary for forming of means of identification (further - marking codes) is performed by the operator of information system of monitoring on paid basis according to Rules.

11. From the date of entry into force of this resolution according to the decision of the participant of turnover of construction materials provision to it codes of marking can be performed by the operator of information system of monitoring before the corresponding dates established by subitems "an" and "b" of Item 3 of this resolution from which drawing means of identification becomes obligatory. Such codes of marking are provided by the operator of information system of monitoring on a grant basis. At the same time the participant of turnover of construction materials who received the specified marking codes on a grant basis provides their transformation to means of identification and submits in information system of monitoring the report on drawing means of identification and data on input of construction materials in turnover before the corresponding dates established by subitems "an" and "b" of Item 3 of this resolution from which drawing means of identification becomes obligatory.

If the participant of turnover of construction materials who received marking codes on a grant basis did not provide their transformation to means of identification and did not submit in information system of monitoring the report on drawing means of identification and data on input of construction materials in turnover before the corresponding dates established by subitems "an" and "b" of Item 3 of this resolution from which drawing means of identification becomes obligatory such codes of marking are paid by the participant of turnover of construction materials or cancelled according to Rules.

12. Participants of turnover of construction materials have the right to put means of identification and to represent to information system of monitoring of the data on drawing means of identification, input in turnover, about turnover and about conclusion from turnover of construction materials according to Rules from the date of entry into force of this resolution.

13. This resolution becomes effective since September 1, 2025.
