About modification and amendments in the order of the Minister of Agriculture of the Republic of Kazakhstan of March 15, 2019 No. 108 "About approval of Rules of subsidizing of development of breeding livestock production, increase in productivity and product quality of livestock production"

I ORDER:

1. Bring in the order of the Minister of Agriculture of the Republic of Kazakhstan of March 15, 2019 No. 108 "About approval of Rules of subsidizing of development of breeding livestock production, increase in productivity and product quality of livestock production" (it is registered in the Register of state registration of regulatory legal acts No. 18404) the following changes and amendments:

in the Rules of subsidizing of development of breeding livestock production, increase in productivity and product quality of livestock production approved by the specified order:

add with Item 1-1 of the following content:

"1-1. Main objective of subsidizing is development of breeding livestock production, increase in productivity and product quality of livestock production, including increase in availability of breeding animals, products (material) and services, and also reduction in cost of production costs of the made livestock products.";

in Item 2:

state subitem 1-1) in the following edition:

"1-1) special commissions – the commission created at the level of areas, the cities of republican value and the capital which is created of representatives: regional chamber of entrepreneurs of National chamber of entrepreneurs of the Republic of Kazakhstan of Atameken (further – NPP Atameken), the public industry unions / associations / republican chambers and specialists of structural division of local executive body of areas, the cities of republican value and the capital (further – MIO (service provider)), and performing determination of production capacity and reconciliation on availability of the corresponding infrastructure, issue and withdrawal of the conclusions at producer;";

6) to exclude the subitem;

8) to state the subitem in the following edition:

"8) uterine livestock – the livestock which reached polovozrely age (on cattle breeding: breeding animals – of 13 months, commodity animals – of 18 months, on sheep breeding – of 12 months, on horse breeding – of 36 months; on maralovodstvo (reindeer breeding) – of 24 months, on pig-breeding: breeding and commodity – of 8 months, repair livestock – of 4 months), used for reproduction of herd;"

12) to exclude the subitem;

state Item 6 in the following edition:

"6. Forming and distribution of amounts of subsidies are performed by MIO (service providers) according to the types and standard rates of subsidies established in appendix 1 to these rules within the allocated budgetary funds for the corresponding financial year, taking into account:

information provided by local executive bodies of the areas/cities about requirement of amounts of subsidies the current year;

total about the mastered amounts of subsidies in previous year;

regional features;

the prevailing specialization of agricultural production in the region, including the import-dependent directions, the determined quantity and share of the companies which are engaged in production of agricultural products.

Amounts of subsidies are determined by multiplication of quantity of units (the heads, kilograms, doses, pieces) on the corresponding standard rate of subsidies established according to appendix 1 to these rules.

In the presence of the debt on unexecuted obligations to producers formed as a result of nonpayment of subsidies according to the submitted and approved applications last financial year(s), the corresponding outstanding amount is subject to inclusion in calculation when planning amount of subsidies for the current financial year.

The total amount of need for subsidies in all directions of subsidizing is determined by summing of requirements by each type of subsidies.

The offered amounts of subsidies with appendix of the decision of maslikhat on approval of the regional budget for the corresponding period no later than January 10 of the corresponding year are signed by the EDS of the head of MIO (service provider) and sent by means of GISS for approval in the Ministry.

In the presence of the basis for the adjustment of total amount of means providing redistribution or growth in volumes of financing, allocation of additional resources for types of subsidies, MIO (service provider) makes corresponding changes to GISS and sends them by means of GISS for approval in the Ministry.

In case of the insufficient number of requests by separate types of the subsidies specified in appendix 1 to these rules and also in the presence of unused means, within financial year of MIO (service provider) redistributes the specified funds for other types of the subsidies specified in appendix 1 to these rules according to which there is shortage of means.

MIO (service provider) for subsidizing monitoring annually, till February 1 of the year following reporting represent to the Ministry:

summary information on use of subsidies on the types of subsidies established in appendix 1 to these rules, with indication of amounts of the allocated and mastered funds, and also not development reasons in the presence of remaining balance;

analytical information on efficiency of use of subsidies on types, with assessment of achievement of results of key indicators of development of livestock production (increase in number of livestock of the cattle and bird, surplus of breeding livestock, growth in volumes of production of agricultural products, productivity growth, improvement of quality of products), influences of subsidies for decrease in importozavisimost and development of the export potential, efficiency of use of budgetary funds by industries.";

state Item 10 in the following edition:

"10. Standard rates of subsidies, and also criteria, forms of requests and submission due dates of requests affirm the resolution MIO (service provider) according to subitem 1-4) of Item 1 of article 27 of the Law of the Republic of Kazakhstan "About local public administration and self-government as the Republic of Kazakhstan" in the following directions:

on reduction in cost of cost of costs for forages to livestock of farm animals;

on acquisition of breeding manufacturing stallions of the riding direction of foreign selection by the breeding centers;

on cost recovery on content of breeding livestock of breeds of horses of the riding and riding and draft directions removed in the territory of the Republic of Kazakhstan.

Standard rates of subsidies in the "reduction in cost of cost of costs for forages to livestock of farm animals" direction, and also standard rates of subsidies and criteria "acquisition of breeding manufacturing stallions of the riding direction of foreign selection by the breeding centers", "cost recovery on content of breeding livestock of breeds of horses of the riding and riding and draft directions removed in the territory of the Republic of Kazakhstan" are established on the basis of recommendations of the specialized profile scientific organization for livestock production.";

1) of Item 14 to state the subitem in the following edition:

"1) applications in electronic form by means of interaction of the web portal of "the electronic government" with GISS:

on receipt of subsidies for acquisition: breeding uterine number of cattle (the milk, milk and meat, meat and meat-and-milk directions), breeding manufacturing bull (the meat and meat-and-milk directions), breeding sheep, breeding manufacturing ram, breeding manufacturing stallion of the productive direction, breeding manufacturing camel, breeding manufacturing male pig, breeding pigs, breeding uterine livestock of goats, breeding daily young growth parent / прародительской forms of the meat direction of birds and daily young growth of final form of the egg referral got from breeding bird in form 1 according to appendix 3 to these rules;

on receipt of subsidies by the breeding centers, distribyyuterny centers for realization of seed and embryos of breeding animals and technicians-osemenatorami for services in artificial insemination of uterine livestock of the large horned cattle / sheep of producers and in agricultural cooperatives in form 2 according to appendix 3 to these rules;

on receipt of subsidies for the acquired same-sex and bisexual seed of breeding bulls milk / молочно-мясного and the meat/meat-and-milk directions in form 3 according to appendix 3 to these rules;

on receipt of subsidies for reduction in cost of acquisition value of embryos of cattle and sheep in form 4 according to appendix 3 to these rules;

on receipt of subsidies for reduction in cost of manufacturing cost of meat of chicken in form 5 according to appendix 3 to these rules;

on receipt of subsidies for reduction in cost of manufacturing cost of milk (cow, mare's, camel) in form 6 according to appendix 3 to these rules;

on receipt of subsidies for reduction in cost of manufacturing cost of milk by agricultural production cooperatives in form 7 according to appendix 3 to these rules;

on receipt of subsidies for reduction in cost of cost of the realized beef by the meat-processing companies, engaged in slaughter and primary conversion of beef in form 8 according to appendix 3 to these rules;

on receipt of subsidies for reduction in cost of cost of cattle of the men's individuals realized on fattening to feedlots or on slaughter in the meat-processing companies for form 9 according to appendix 3 to these rules;

on receipt of subsidies for reduction in cost of cost of small cattle of the men's individuals realized on fattening to feedlots or on slaughter in the meat-processing companies for form 10 according to appendix 3 to these rules;

on receipt of subsidies for reduction in cost of cost of small cattle of the men's individuals realized on fattening to feedlots or on slaughter in the meat-processing companies (seasonal deliveries) for form 11 according to appendix 3 to these rules;

on receipt of subsidies for reduction in cost of cost of the pigs implemented or moved on slaughter to the meat-processing companies or on lethal Items in form 12 according to appendix 3 to these rules;

on receipt of subsidies for conducting selection and breeding work with breeding uterine livestock of domestic breeds of horses of the riding and riding and draft directions in form 13 according to appendix 3 to these rules;

on receipt of subsidies for reduction in cost of cost of the thin and semi-thin/rough and semi-rough wool realized for conversion in form 14 according to appendix 3 to these rules;

on receipt of subsidies for reduction in cost of manufacturing cost of honey in form 15 according to appendix 3 to these rules;

on receipt of subsidies for reduction in cost of costs in case of cultivation of breeding young growth of cattle of the meat direction / small cattle in form 16 according to appendix 3 to these rules;";

state Item 14-1 in the following edition:

"14-1. The producers receiving subsidies need to observe obligations on providing to growth/preserving at the level of previous year of amount of gross output (goods or services) of agro-industrial complex, in terms of money (thousands of tenges).

The amount of gross output (goods or services) of agro-industrial complex is determined by the following formula:

Amount of gross output (goods or services) of agro-industrial complex for previous year, thousands of tenges = amount of the made products (goods or services) of agro-industrial complex for previous year in kind, tons/heads/pieces x the price for products (goods or service) of agro-industrial complex, thousands of tenges.

In case of non-execution of obligations owing to force majeure (deterioration in climatic conditions, phytosanitary and epizootic situations), the producer places in GISS the document confirming this fact (the certificate of weather conditions issued by the republican state company on the right of economic maintaining Kazgidromet of the Ministry of Ecology and Natural Resources of the Republic of Kazakhstan and (or) the solution of MIO on establishment of quarantine or restrictive actions and (or) the appraisal certificate (test report) on detection of disease of animals and (or) the act of damage of crops by wreckers, diseases of plants and weeds).

The counter obligation is considered unexecuted in case of negative variance (the column 8 of form 1 of appendix 4-1 to these rules) which is calculated by means of difference between amount of gross output (goods or services) of agro-industrial complex in the current year and amount of gross output (goods or services) of agro-industrial complex in previous year. In case of primary adoption of counter obligations the variation is equal to zero.

In case of non-execution of obligations during 2 (two) previous years in a row for the first time and lack of the documents confirming approach of force majeure circumstances the possibility of application for receipt of subsidies current calendar year for 1 (one) will be stopped. In case of lack of data on the prices in official statistical information data from alternative sources or average price of 5 (five) subjects of agro-industrial complex of area, city of republican value, the capital making this type of products will be used.

Information on amount of the made gross output (goods or services) of agro-industrial complex is filled in with producer in the Personal account in form 1 according to appendix 4-1 to these rules (further – the form 1) before application for subsidizing in time since January 20 and until the end of the current year and is confirmed by the digital signature. Data on counter obligations are reflected in the register of counter obligations in form 2 according to appendix 4-1 to these rules and are public for users.

At the same time the producers who underwent state registration in the current year the amount of gross output for previous year is specified in value "0".

In case of assumption the producer of mistakes (technical, arithmetic, in case of data transfer from source documents) when filling form 1, allows to adjust once data on amount of gross output (goods or services) of agro-industrial complex before application for receipt of subsidies.

Accomplishment level is fixed by producer of obligations in GISS.";

state Item 17 in the following edition:

"17. Annually local executive bodies of areas and cities of republican value and the capital create the special commission. The structure of the special commission is created taking into account exception of conflict of interest in activities of the special commission.

Poultry farms / feeding platforms / молочно-товарные farms / agricultural production cooperatives which are engaged in milk procurement / the meat-processing companies with lethal capacity from 50 heads of cattle or 300 heads of sheep / the meat-processing companies which are engaged in slaughter and primary conversion of beef / the meat-processing companies with lethal capacity at least 100 heads of pigs in change / the lethal Items which are engaged in slaughter of the pigs / company for conversion of wool receive the decision of the special commission on compliance of production capacity and infrastructure of the company applying for receipt of subsidies in form according to appendix 5 to these rules.

At least 3 (three) specialists determined by the special commission go to each producer.

Survey is performed in the presence of producer or his authorized representative.";

state Item 21 in the following edition:

21. After signing of the EDS producer, the request becomes available in the Personal account of MIO (service provider). MIO (service provider) within 2 (two) working days from the moment of receipt of the request performs its check on completeness of the data and the enclosed documents specified in appendix 3 to these rules. In case of compliance, the request is subject to approval, the EDS of the executive in charge of MIO (service provider) is signed and arrives in the register of the approved requests (waiting list), and also MIO (service provider) directs the notification on results of consideration of the request for receipt of subsidies in form according to appendix 6 to these rules.

Consideration of requests and payment of subsidies for the approved requests are performed according to the procedure of priority according to date and time of registration of requests.

The period of finding of the request in the register of the approved requests (waiting list) does not enter rendering the state service in time.";

state Item 25 in the following edition:

"25. District departments of agricultural industry (further – ROSH) by means of GISS quarterly perform monitoring of safety of the pro-subsidized livestock. Monitoring is carried out in the Section "Obligation Fulfillment Monitoring" on the retention period of livestock established in appendix 2 to these rules.

Obligation fulfillment monitoring, and also actions for return of means in the cities of republican value and the capital are performed by MIO (service providers) of these administrative and territorial units.

By results of the carried-out quarterly monitoring of ROSH provides information in MIO (service provider) of area no later than the 10th following reporting quarter including data on the sizes of the subsidies which are subject to return.

In case of establishment of ROSH of violation by producer of undertaken obligation on ensuring safety of the declared livestock (except for rates of natural loss (case)) and its target use within the submitted application for receipt of subsidies, ROSH within thirty working days from the date of factual determination (ов) violations by producer of undertaken obligation within the submitted application for receipt of subsidies are directed to producer by the return note of the received subsidy amount of the local budget, with indication of the amount, the term of return, code of budget classification of the Republic of Kazakhstan on which return of means, bank account details shall be performed, on which funds shall be transferred.

The return note of the received amount of subsidy goes the letter in place of registration of producer, and also to GISS "personal account". The notification is considered delivered from the moment of receipt of the letter or reading of the notification in electronic system.

In case of violation confirmation by producer of undertaken obligation within the submitted application for receipt of subsidies, the amount of means for each not kept head is subject to return. The amount of the received subsidy is subject to return by producer in the local budget within ninety working days from the moment of receipt of the notification by it.

In case of complete or partial not transfer of the amounts specified in the notification, ROSH directs materials to MIO (service provider) of area for taking measures to return of means judicially.

In case of violation by producer of the obligations provided within the submitted application, the producer has opportunity to submit the new application only after accomplishment of the previous obligations (after return of subsidies for not kept livestock).";

appendices 1, 2, 3, 4, 4-1, 5 and 6 to the specified Rules to be reworded as follows according to appendices 1, of 2, of 3, of 4, of 5, 6 and 7 to this order.

2. To provide to department of livestock production of the Ministry of Agriculture of the Republic of Kazakhstan in the procedure established by the legislation:

1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;
