About carrying out experiment on provision of services of guest houses

Article 1. General provisions

1. For the purpose of creation of the mechanism of special legal regulation of activities for provision of services of guest houses, creating favorable conditions for development of the tourist industry to make experiment on provision of services of guest houses in individual apartment houses (further - experiment).

2. The experiment is made in the territories of Altai Republic, the Republic of Dagestan, Republic of Crimea, Altai Krai, Krasnodar Krai, Primorsky Krai, Stavropol Krai, the Arkhangelsk region, the Vladimir region, the Ivanovo region, the Irkutsk region, the Kaliningrad region, the Kemerovo region - Kuzbass, the Leningrad region, the Rostov region, the Kherson region, the federal city of Sevastopol (further - subjects of the Russian Federation), and also in the federal territory Sirius.

3. Participants of experiment - authorized bodies of the government of subjects of the Russian Federation, the public power of the federal territory Sirius in which territories the experiment, owners of guest houses is made.

4. The experiment becomes effective in the territory of the subject of the Russian Federation, in the federal territory Sirius, participating in experiment according to this Federal Law, the law of the subject of the Russian Federation, the decision of Council of the federal territory Sirius which are becoming effective not later than one year before the termination of term of carrying out the experiment provided by this Federal Law.

Article 2. Basic concepts

1. For the purposes of this Federal Law the following basic concepts are applied:

1) the guest house - the type of means of placement representing the individual apartment house or part of the individual apartment house in which rooms are used for provision of services of the guest house. The part of the individual apartment house for the purposes of this Federal Law is understood as part of the individual apartment house with separate entrance (exit) to the parcel of land on which the guest house, and access to rooms public in such house is located;

2) services of the guest house - service in provision of places for temporary residence of physical persons in the guest house, and also other services in servicing of the physical persons living in the guest house provided by the owner of the guest house according to the regulations on classification of guest houses approved by the Government of the Russian Federation (further - regulations on classification of guest houses);

3) classification of the guest house - assignment to the individual apartment house like means of placement "the guest house" based on assessment of conformity of such house and services provided in it to requirements, the established this Federal Law and regulations on classification of guest houses;

4) the owner of the guest house - the physical person who is the owner of the individual apartment house or part of the individual apartment house, performing provision of services of the guest house according to requirements of this Federal Law.

2. Other concepts used in this Federal Law are applied in the values determined by other legal acts of the Russian Federation.

Article 3. Term of carrying out experiment

The experiment is made from September 1, 2025 to December 31, 2027.

Article 4. Requirements to the guest house

1. For assignment to the individual apartment house like means of placement "the guest house" such house shall conform to the following requirements:

1) the individual apartment house is placed on the parcel of land which is referred to category of lands of settlements and which type of the permitted use provides individual housing construction, maintaining personal subsidiary farm (the home parcel of land), conducting gardening by citizens for own needs;

2) concerning the individual apartment house there is no decision of local government bodies or court on demolition of unauthorized construction or the decision on demolition of unauthorized construction or its reduction in compliance with the established requirements;

3) the individual apartment house belongs on the property right to physical person, at the same time data on the state cadastral registration of such house and state registration of the property right to such house are entered in the Single state real estate register;

4) to other requirements established by regulations on classification of guest houses.

2. Public authorities of subjects of the Russian Federation, representative body of the federal territory Sirius for the purpose of assignment to individual apartment houses like means of placement "the guest house" can establish additional requirements taking into account regional (local) features, including the requirement to date of entering into the Single state real estate register of data, stipulated in Item 3 parts of 1 this Article.

3. Discrepancy of the guest house to the requirements established by this Article, regulations on classification of guest houses to additional requirements to the guest houses established respectively by public authority of the subject of the Russian Federation, representative body of the federal territory Sirius is the basis for refusal in entering of data on the guest house into the unified register of subjects to classification in the field of the tourist industry provided by the Federal Law of November 24, 1996 No. 132-FZ "About bases of tourist activities in the Russian Federation" (further - the register of the classified means of placement).

4. Provision of services of the guest house in guest houses, data on which are not entered in the register of the classified means of placement, placement of information on provision of services of the guest house without specifying of identification number of the guest house assigned in the register of the classified means of placement, and the reference on the Internet to the entry in the register of the classified means of placement containing data on the guest house according to requirements, the stipulated in Clause 5.1 Federal Laws of November 24, 1996 No. 132-FZ "About bases of tourist activities in the Russian Federation" are prohibited.

Article 5. Classification of the guest house

1. Classification of the guest house includes:

1) carrying out assessment of conformity of the individual apartment house by the owner of the guest house to the requirements to the guest house established according to article 4 of this Federal Law;

2) inclusion of data on the guest house, and also the documents and (or) data confirming compliance of the individual apartment house or part of the individual apartment house to requirements to the guest house, in the register of the classified means of placement based on the specified assessment of conformity according to the procedure, established by regulations on classification of guest houses.
