Based on part (2) Article 20 and part (6-2) articles 24 of the Law No. 221/2007 on veterinary and sanitary activities, parts (1) article 24 of the Law No. 50/2013 on official control for the purpose of check of compliance to the fodder and food legislation and the rules concerning health and wellbeing of animals and based on the Veterinary sanitary standard establishing requirements to health of animals, regulating production, processing, placement and import to the market of some animal products intended for consumption by the person, approved by appendix No. 1 to the Order of the Government No. 1408/2008 about approval of some veterinary sanitary standards, I ORDER:

1. Approve Regulations on procedure for carrying out audit and agreement signature on equivalence of competent authority of the third country intending to export products and offal of animal origin, live animals, seed material, ova and germs to the Republic of Moldova according to appendix No. 1.

2. Approve the List of the countries and the companies for import of the products and offal of animal origin which are subject to veterinary health control, live animals, seed material, ova and germs to the Republic of Moldova according to appendix No. 2.

3. Oblige inspectors of boundary inspection posts during control when importing to check whether have the countries/companies from which it is supposed to perform import, the export right to the market of community of the European Union or whether there are they in appendix No. 2.

4. This order becomes effective from the date of publication in the Official monitor of the Republic of Moldova.

5. To impose control of execution of this order on the deputy director general by sanitary and veterinary part and the deputy director general on safety of foodstuff.

Regulations on procedure for carrying out audit and agreement signature on equivalence of competent authority of the third country intending to export products and offal of animal origin, live animals, seed material, ova and germs to the Republic of Moldova

I. Introduction, purpose, tasks and scope

1. This Provision is developed for the purpose of establishment of technical regulations for realization of part (6) article 24 of the Law No. 221/2007 on veterinary and sanitary activities, and for the purpose of protection of public health and health of animals of the Republic of Moldova.

2. This Provision establishes special regulations about carrying out audit and agreement signature about equivalence of competent authority of the third country intending to export products and offal of animal origin, live animals, seed material, ova and germs to the Republic of Moldova.

3. The purpose of audit is check if official control and other official activities regulated by the Law No. 50/2013 on official control for the purpose of check of compliance to the fodder and food legislation and the rules concerning health and wellbeing of animals take root effectively, and conform to requirements of the relevant legislation, including for ensuring compliance to national veterinary requirements and requirements for safety of foodstuff.

4. The third country will be included in the list of Appendix No. 2 to this Provision from which import of foodstuff of animal origin, live animals, seed material, ova and germs will be resolved provided that the competent authority of the respective country proves that it provides the corresponding guarantees concerning their compliance to the legislation of the Republic of Moldova.

5. According to part provisions (2) article 20 of the Law No. 221/2007, import of foodstuff of animal origin, live animals, seed material, ova and germs from the company of the third country can be performed only if this company is included in Appendix No. 2 to this Provision.

6. In departure from Items 3. and 4., foodstuff of animal origin, live animals, seed material, the ova and germs from the third countries having the export right to the market of community of the European Union can be exported to the Republic of Moldova, for lack of audit and the agreement on equivalence, but only after bilateral approval of sanitary and veterinary certificates between competent authorities.

7. Approval of certificates of competent authority of the exporting country for import of foodstuff of animal origin, live animals, seed material, ova and germs to the Republic of Moldova comes to the end with bilateral initialing by the representatives of both countries delegated by members of World Organization of health protection of animals (English WOAH).

8. After initialing samples of certificates affirm the Order of the Agency and are published on the official site of the Agency.

II. Applicable legislation

9. For the purpose of this provision the following legislation is applied:

1) the Law No. 50/2013 on official control for the purpose of check of compliance to the fodder and food legislation and the rules concerning health and wellbeing of animals;

2) Law No. 221/2007 on veterinary and sanitary activities;
