About the Commission on monitoring of expenditure of the funds allocated from National fund of the Republic of Kazakhstan

According to item 4 of Article 59 of the Budget code of the Republic of Kazakhstan and for the purpose of implementation of monitoring of target, legal and effective use of the funds allocated from National fund of the Republic of Kazakhstan, POSTANOVLYAYU:

1. Create the Commission on monitoring of expenditure of the funds allocated from National fund of the Republic of Kazakhstan (further - the Commission).

2. Approve enclosed:

1) provision and operating procedure of the Commission;

2) structure of the Commission.

3. Recognize invalid some acts of the President of the Republic of Kazakhstan according to appendix to this Decree.

4. This Decree becomes effective from the date of its signing.

Provision and operating procedure of the Commission on monitoring of expenditure of the funds allocated from National fund of the Republic of Kazakhstan

Chapter 1. General provisions

1. The commission on monitoring of expenditure of the funds allocated from National fund of the Republic of Kazakhstan (further - the Commission), is advisory advisory body concerning control of use of means of National fund of the Republic of Kazakhstan.

2. The commission in the activities is guided by the Constitution, legal acts of the Republic of Kazakhstan, acts of the President of the Republic of Kazakhstan, and also this Provision and operating procedure.

3. Decisions of the Commission have advisory nature.

4. Task of the Commission is implementation on permanent basis of monitoring of target, legal and effective use of the funds allocated from National fund of the Republic of Kazakhstan including by means of carrying out monitoring of realization and audit of financial part of the crucial objects, projects of all-country value and other projects financed by means of National fund of the Republic of Kazakhstan (further - National fund), including by bonded borrowing.

5. The commission has the right:

1) to involve external experts (auditors) to carrying out monitoring of realization and audit of financial part of the crucial objects, projects of all-country value and other projects financed by means of National fund;

2) to direct materials for the solution of question of disciplinary and other responsibility of officials of the relevant state bodies and organizations with participation of the state;

3) to send information to law enforcement agencies and bodies of homeland security for consideration in the procedure established by the legislation of the Republic of Kazakhstan.

6. Members of the commission shall:

To carry out 1) within the competence intermediate monitoring following the results of the first half of the year and annual assessment of expenditure of the funds allocated from National fund;

2) to participate in forming of the annual statement of the Commission;

3) to represent results of the monitoring performed within the competence to Working body of the Commission.

7. Members of the commission in the procedure established by the legislation of the Republic of Kazakhstan and within the competence have the right to request from the necessary reporting, information, documents and other materials state bodies, the organizations with participation of the state and officials, including oral and written explanations from the corresponding officials.

Chapter 2. Organization and operating procedure of the Commission

8. The commission is headed by the chairman.

Commission chairman:

1) performs the common directorship of activities of the Commission;

2) determines the agenda, the place and time of carrying out commission sessions;

3) presides over commission sessions. In the absence of the chairman according to its order one of members of the commission presides over meetings;

Distributes 4) between members of the commission of task and if necessary gives them obligatory for execution of the order on carrying out monitoring within their competence;

5) submits to the President of the Republic of Kazakhstan the annual statement of the Commission no later than June 1 of the year following reporting.

9. Commission sessions are held at least once a year and drawn up by the protocol. At the request of the commission chairman removal and consideration of unplanned questions by initiation of correspondence voting is allowed.

The meeting is considered competent if at it at least a half from total number of members of the commission participate. Delegation by members of the commission of the powers to other officials is not allowed.

10. The commission makes decisions by a majority vote from total number of the members of the commission participating at meeting. In case of equality of votes, accepted is considered the decision for which the commission chairman voted.

11. Decisions of the Commission if necessary go to the relevant state bodies and the organizations.

12. Working body of the Commission is the Highest auditor chamber of the Republic of Kazakhstan.

The working body performs organizational support of activities of the Commission and monitoring of execution of its decisions.

13. For the purpose of the effective organization of activities of the Commission the secretary is appointed.

14. The secretary of the Commission is the representative of working body of the Commission. The secretary is not member of the commission and has no right to vote in case of adoption of decisions by the Commission.
