1. Approve Regulations on procedure for technical investigation of the reasons of accidents and incidents in the field of industrial safety it (is applied).

2. This resolution becomes effective from the date of publication in the Official monitor of the Republic of Moldova.

Regulations on procedure for technical investigation of the reasons of accidents and incidents in the field of industrial safety

I. General provisions

1. The regulations on procedure for technical investigation of the reasons of accidents and incidents in the field of industrial safety (further – the Provision) establish the mechanism of the message on accidents and incidents and their classification and procedure for technical investigation of the reasons of the accidents and incidents which are taking place on potentially hazardous production facilities or technical installations / technology systems.

2. Classification of the accidents and incidents which are taking place on potentially hazardous production facilities and technical installations / technology systems is provided in appendices No. 1-4.

3. For the purposes of this provision the concepts determined in the Law No. 151/2022 on safe functioning potentially of hazardous production facilities and technical installations, the Law No. 108/2020 on control of danger of emergence of the major accidents caused by dangerous substances and also the following concepts are used:

accident – destruction of constructions and (or) technical installations / the technology systems used on potentially hazardous production facilities, and also social and utility objects, the spontaneous explosion and (or) emission of dangerous substances creating threat of life and to human health and causing environmental damage;

the operational report – information on the accident which happened on potentially hazardous production facility and (or) potentially dangerous technical installation / to technology system according to appendix No. 5;

technical investigation of causes of accident – establishment and documentation of circumstances and causes of accident on potentially hazardous production facility or on potentially dangerous technical installation / to technology system, establishment of the officials responsible for emergence of accident, development of measures for the prevention of similar accidents;

materials of technical investigation – the set of documents on circumstances and causes of accident prepared by results of technical investigation of causes of accident taking into account requirements of the regulating documentation and provisions in the field of industrial safety;

the protocol of technical investigation – the document developed by the commission on technical investigation of causes of accident, according to requirements of this provision, containing the reasoned conclusions about circumstances and causes of accident, about persons responsible for emergence of accident, information on measures for the prevention of similar accidents. The protocol of technical investigation is integral part of materials of technical investigation.

4. The accidents which resulted from violations of the safety requirements provided by provisions of the Law No. 151/2022 on safe functioning potentially of hazardous production facilities and technical installations, regulations and rules of industrial safety in use on potentially hazardous production facilities or potentially dangerous technical installations / technology systems which led to destruction of the constructions and (or) technical installations used at the company and potentially dangerous technical installations used on social and utility objects, to spontaneous explosions and (or) emissions of dangerous substances, poisonings, pollution with these substances are subject to technical investigation.
