RESOLUTION OF THE CABINET OF MINISTERS OF UKRAINE

About implementation of the pilot project on creation, implementation and ensuring functioning of the Management system by apartment houses
(Extraction)

Cabinet of Ministers of Ukraine decides:

1. Agree with the offer of the Ministry of development of communities and the territories concerning realization within two years from the date of entry into force of this resolution of the pilot project on creation, implementation and ensuring functioning of the Management system by apartment houses (further - the pilot project).

2. Approve enclosed:

Procedure for implementation of the pilot project on creation, implementation and ensuring functioning of the Management system by apartment houses;

Procedure for maintaining the Management system by apartment houses in case of implementation of the pilot project on creation, implementation and ensuring functioning of the Management system by apartment houses.

3. Determine that the Management system apartment houses and the Register of management of apartment houses begin to function not later than in three months from the date of entry into force of this resolution.

4. Bring the enclosed changes in resolutions of the Cabinet of Ministers of Ukraine.

5. To the ministry of development of communities and territories:

1) to provide electronic information exchange between the Management system by apartment houses and Single state electronic system in the sphere of construction regarding the data necessary for implementation of the pilot project;

2) to provide filling of the Register of management of apartment houses of the Management system of apartment houses of data about:

the certified persons which passed professional certification as "the manager (managing) of the apartment house (group of houses)" not later than in six months after entry into force of this resolution;

certification bodies of personnel as "the manager (managing) the apartment house (group of houses)" not later than in year after entry into force of this resolution;

3) tax not later than in two months after completion of implementation of the pilot project to the Cabinet of Ministers of Ukraine the report on results of its realization and the offer on feasibility of modification of legal acts.

6. To provide to the Ministry of Justice at the request of the Ministry of development of communities and the territories not later than in four months after entry into force of this resolution one-time unloading from the Unified State Register of Legal Entities, physical persons - entrepreneurs and public forming in the Management system with apartment houses of data on consolidation of co-owners of the apartment houses registered in the procedure established by the legislation and concerning which record about state registration of the termination is not made.

7. To provide to the ministry of development of communities and territories and the Ministry of Justice not later than in four months after entry into force of this resolution electronic information exchange between the Management system by apartment houses and the State register of the corporeal rights to real estate, the Unified State Register of Legal Entities, physical persons - entrepreneurs and public forming regarding the data necessary for implementation of the pilot project, and the State register of acts of civil status of citizens regarding data on state registration of death of physical persons.

8. Recommend to local government bodies:

1) to take part in implementation of the pilot project;

2) to provide provision to officials of local government bodies of access to electronic offices of the Management system by apartment houses;

3) to provide filling of the Register of management of apartment houses according to the procedures approved by this resolution, data on consolidation of co-owners of apartment houses and managers of apartment houses.

9. This resolution becomes effective from the date of its publication, except paragraphs two - the fifth, eighth, tenth, eleventh subitem 2 Items 1, of subitems 2, 3 Items 2, of paragraphs of third - the fifth subitem 1 and subitems 3-9 of Item of 3 changes approved by this resolution which become effective in year from the date of publication of this resolution.

According to the procedure of maintaining Single state electronic system in the sphere of construction, No. 681 "Some questions of ensuring functioning of Single state electronic system in the sphere of construction" approved by the resolution of the Cabinet of Ministers of Ukraine of June 23, 2021 (The Official Bulletin of Ukraine, 2021, No. 55, Art. 3401; 2022, No. 54, Art. 3173; 2023, No. 70, Art. 4065; 2024, No. 16, Art. 1028):

1) Item 45 to add with the subitem 32 following of content:

"32) Management system apartment houses.";

2) Item 125 to add with the subitem 52 following of content:

"52) chairman of the board of consolidation of co-owners of the apartment house, managing director of the apartment house.";

Item 127 to add 3) with the paragraph of the following content:

"Receipt of access to electronic office by the chairman of the board of consolidation of co-owners of the apartment house and to the managing director of the apartment house can be also performed by means of software of the Management system of the apartment house in case of passing of the procedure of electronic identification and authentication by them through the state integrated system of electronic identification in such System.";

4) to add the Procedure with Item 174-15 of the following content:

"174-15. Through electronic office of the chairman of the board consolidation of co-owners of the apartment house, managing apartment house is performed:

1) creation of basic data about apartment houses for the Register of buildings and constructions;

2) viewing and copying of data on the apartment house from the Register of construction activities and the Register of buildings and constructions in case of their availability;

3) Creation, loading and signing of documents.".

The procedure for implementation of the pilot project on creation of the Unified state register of administrative and territorial units and the territories of territorial communities, the Unified state Register of addresses, the register of buildings and constructions as a part of Single state electronic system in the sphere of construction approved by the resolution of the Cabinet of Ministers of Ukraine of March 5, 2024 No. 254 (Official Bulletin of Ukraine, 2024, No. 26, Art. 1673), to add with Item 23-1 of the following content:
