About measures for ensuring independence and increase in efficiency of activities of divisions of internal anti-corruption control of state bodies and the organizations

For the purpose of effective realization of the main objectives on the organization of activities of divisions of internal anti-corruption control of the state bodies and the organizations on the basis of new system determined at the enlarged meeting of National council by anti-corruption on March 5, 2025 and also forming of the intolerant relation to corruption on the basis of "respectability vaccine" in state bodies and the organizations, I decide:

I. Priority tasks

1. Determine priority tasks of divisions of internal anti-corruption control of state bodies and organizations, economic societies, in authorized fund (authorized capital) of which the state share constitutes 50 percent and more (further - state bodies and the organizations):

(a) early identification and the prevention of corruption manifestations, eradication of the reasons and conditions promoting them;

(b) elimination of corruptogenic factors when rendering the state services, the prevention of household corruption, including development of offers on digitalization, reducing bureaucracy;

(c) conducting anti-corruption examination of departmental regulatory legal acts and introduction of the offer on cancellation of the corruption regulations revealed following the results;

(d) taking measures to non-admission of conflict of interest when implementing public procurements, and also carrying out preventive studying on public procurements;

(e) regular submission to the Agency on anti-corruption (further - the Agency) electronic reports on the carried-out work on anti-corruption;

(e) forming of the list of corruption risks in the respective spheres and industries, development and ensuring approval of the measures directed to their elimination;

(g) introduction of offers on the organization of activities of the situational centers giving opportunity of implementation of internal anti-corruption control and identification of corruption risks in state bodies and the organizations;

(h) conducting propaganda and explanatory activities on forming of the intolerant relation to corruption, non-admission of conflict of interest and observance of rules of ethics in labor collectives;

(i) introduction of offers on promoting and implementation of positive experiment on anti-corruption.

II. Measures for enhancement of system of internal anti-corruption control

2. Determine that:

(a) the division of internal anti-corruption control in the activities submits also to accountably directly first head of the organization, in economic societies, in authorized fund (authorized capital) of which the state share constitutes 50 percent and more, - to the Supervisory board (in the absence of the Supervisory board - to the director);

(b) the first heads of state bodies and organizations of republican level appoint to position and perform coordination of activities of heads and employees of divisions of internal anti-corruption control of territorial subdivisions and structural organizations of state bodies and organizations;

(c) consideration of ideas of the Agency of material stimulation of employees of divisions of internal anti-corruption control is obligatory for the organizations in which the specified workers perform activities.

3. Approve the Minimum criteria of creation of divisions of internal anti-corruption control in state bodies and the organizations, and also economic societies, in authorized fund (authorized capital) of which the state share constitutes 50 percent and more, according to appendix No. 1.

To the agency jointly with Audit Chamber, Agency on management of the state assets, and also other responsible ministries and departments annually to perform monitoring of creation of divisions of internal anti-corruption control in state bodies and the organizations on the basis of the minimum criteria, by results to enter information in National council on anti-corruption.

III. Legal experiment on increase in system effectiveness of internal anti-corruption control

4. Implement as legal experiment for a period of up to January 1, 2027 system according to which:

(a) employees of the Agency are appointed to position of the division manager of internal anti-corruption control of the Ministry of Health, Ministry of Construction and Housing and Communal Services, Ministry of water economy, JSC Uzbekneftegaz, JSC Uzsuvtajminot (further - the organizations of carrying out experiment);

(b) division managers of internal anti-corruption control of the organizations of carrying out experiment submit directly to the Agency;

(c) the organization, coordination and monitoring of activities of divisions of internal anti-corruption control of the organizations of carrying out experiment are performed by the Agency and the organizations of carrying out experiment jointly.

5. For the purpose of effective ensuring execution of the tasks determined within the legal experiment:

(a) established posts of division managers of internal anti-corruption control of the organizations of carrying out experiment are transferred to the Agency for legal experiment;

(b) the payment terms of work, material stimulation and social protection established for the head of department of the Agency extend to these established posts. At the same time expenses on compensation for this position, and also difference in the amount of the salary paid for this position in the Agency and the organizations of carrying out experiment become covered for the account:

(i) means of the Government budget - for the employees of the Agency performing activities in the Ministry of Health, the Ministry of Construction and Housing and Communal Services, the Ministry of water economy;

(ii) the means of JSC Uzbekneftegaz, JSC Uzsuvtajminot transferred into off-budget treasurer personal account of the Agency - for the employees of the Agency performing activities in these joint-stock companies.

6. To the agency (A. Burkhanov) together with the organizations of carrying out experiment:

(a) in a month to determine key performance indicators of activities (KPI) of employees of division of internal anti-corruption control of the organizations of carrying out experiment for legal experiment;

(b) each half a year to provide in National council on anti-corruption information on the course of realization of legal experiment;

(c) in two-month time to make the joint decision on regulation of the course of carrying out legal experiment;

(d) on the basis of the analysis of results of legal experiment to introduce till January 1, 2027 reasonable offers on implementation of this system also in other state bodies and the organizations.

IV. Advanced training and efficiency evaluation of activities of employees of divisions of internal anti-corruption control

7. Determine the Agency the special representative body for coordination and methodical ensuring activities of divisions of internal anti-corruption control of state bodies and the organizations, holding training, certification and advanced training of their workers.
