Some questions of maintaining Unified registers of licensees on production and turnover of alcohol ethyl, the spirit distillates, alcoholic beverages, tobacco products, tobacco raw materials and liquids used in electronic cigarettes, licensees and places of the address of fuel

According to articles 34 and 35 of the Law of Ukraine "About state regulation of production and turnover of alcohol ethyl, spirit distillates, bioethanol, alcoholic beverages, tobacco products, tobacco raw materials, liquids used in electronic cigarettes and fuel" the Cabinet of Ministers of Ukraine decides:

1. Approve enclosed:

Procedure for maintaining the Unified register of licensees on production and turnover of alcohol ethyl, the spirit distillates, alcoholic beverages, tobacco products, tobacco raw materials and liquids used in electronic cigarettes;

Procedure for filling of statements concerning licenses for the right of production of alcohol ethyl, spirit distillates, bioethanol, alcoholic beverages, tobacco products, liquids used in electronic cigarettes, cultivation of tobacco, fermentation of tobacco raw materials;

extraction form from the Unified register of licensees on production and turnover of alcohol ethyl, the spirit distillates, alcoholic beverages, tobacco products, tobacco raw materials and liquids used in electronic cigarettes (concerning licenses for the right of production of alcohol ethyl, spirit distillates, bioethanol, alcoholic beverages, tobacco products, liquids used in electronic cigarettes, cultivation of tobacco, fermentation of tobacco raw materials);

Procedure for filling of statements concerning licenses for the right of wholesale trade by alcohol ethyl, spirit distillates, alcoholic beverages, cider and Perry (without alcohol addition), the tobacco products, liquids used in electronic cigarettes;

Procedure for filling of statements concerning licenses for the right of retail trade by alcoholic beverages, cider and Perry (without alcohol addition), the tobacco products, liquids used in electronic cigarettes;

Procedure for maintaining the Unified register of licensees and places of the address of fuel;

Procedure for filling of statements concerning licenses for the fuel production right;

statement form from the Unified register of licensees and places of the address of fuel (concerning licenses for the fuel production right);

Procedure for filling of statements concerning licenses for the right of wholesale trade by fuel;

statement form from the Unified register of licensees and places of the address of fuel (concerning licenses for the right of wholesale trade by fuel);

Procedure for filling of statements concerning licenses for the right of retail trade by fuel;

statement form from the Unified register of licensees and places of the address of fuel (concerning licenses for the right of retail trade by fuel);

Procedure for filling of statements concerning licenses for the fuel storage right;

statement form from the Unified register of licensees and places of the address of fuel (concerning licenses for the fuel storage right).

2. Declare invalid Item 1 of the resolution of the Cabinet of Ministers of Ukraine of June 19, 2019 No. 545 "About approval of the Procedure for maintaining the Unified state register of the subjects of managing who obtained licenses for the right of production, storage, wholesale and retail trade by fuel and production sites, storage, wholesale and retail trade by fuel and introduction of amendments to some resolutions of the Cabinet of Ministers of Ukraine" (The Official Bulletin of Ukraine, 2019, No. 54, the Art. 1878).

Procedure for maintaining the Unified register of licensees on production and turnover of alcohol ethyl, the spirit distillates, alcoholic beverages, tobacco products, tobacco raw materials and liquids used in electronic cigarettes

1. This Procedure determines procedure of creation and maintaining the Unified register of licensees for production and turnover of alcohol ethyl, the spirit distillates, alcoholic beverages, tobacco products, tobacco raw materials and liquids used in electronic cigarettes (further - the Register), and also the mechanism of inclusion in the Register and exceptions of the Register of subjects of managing to which licenses for the right of production and/or for the right of wholesale trade by alcohol ethyl are provided the spirit distillates, bioethanol, alcoholic beverages, tobacco products, liquids used in electronic cigarettes and/or on the right of retail trade by the alcoholic beverages, tobacco products, liquids used in electronic cigarettes and/or on the tobacco cultivation right, and/or on the right of fermentation of tobacco raw materials (further - the licensee).

The register is component of the GNS information and communication system.

In this Procedure terms are used in the value given in the Law of Ukraine "About state regulation of production and turnover of alcohol ethyl, spirit distillates, bioethanol, alcoholic beverages, tobacco products, tobacco raw materials, liquids used in electronic cigarettes and fuel" (further - the Law) and the Law of Ukraine "About public electronic registers".

2. The register is kept electronically in state language.

3. The data provided by part four of article 34 of the Law, in particular about are entered in the Register:

1) licensees:

for legal entities - the name, the location, code according to EGRPOU;

for physical persons - entrepreneurs-surname, own name, middle name (in the presence), the location (the address of the registered/declared residence (stay) on which communication with physical person is performed - registration number of accounting card of the taxpayer or series (in the presence) and/or passport number of the citizen of Ukraine (for physical persons which because of the religious beliefs refuse adoption of registration number of accounting card of the taxpayer and officially reported about it to the relevant monitoring body and have mark in the passport), unique number of entry in the Unified state demographic register (in the presence);

for persons authorized on accounting of activities for cooperation agreements without formation of legal entity and persons responsible for content and entering of taxes into the budget during execution of agreements, - the name and code of the authorized person according to EGRPOU and the tax number provided to such person in case of registration of the agreement according to Item 63.6 of Article 63 and Item 64.6 of article 64 of the Tax Code of Ukraine (dalee-Kodeks);

for foreign subjects of economic activities name and the tax number of the nonresident in the territory of Ukraine assigned by the relevant tax authority in case of registration;

2) details (number and date) of the statement for receipt of the license for the right of implementation of the corresponding type of economic activity, the statement for modification of the data containing in the Register, statements for cancellation of the license for the right of implementation of the corresponding type of economic activity;

3) the name and code of body of the licensing which made the decision on provision or cancellation of the license for the right of implementation of the corresponding type of economic activity or which makes changes to the data containing in the Register by results of consideration of the corresponding statement of the licensee;

4) decision of body of licensing:

details (number and date) of the decision on provision or on refusal in provision of the license for the right of implementation of the corresponding type of economic activity;

details (number and date) of the decision on cancellation of the license for the right of implementation of the corresponding type of economic activity;

5) registration license number on the right of implementation of the corresponding type of economic activity (system sequence number of entry in the Register about provision of the license for the right of implementation of the corresponding type of economic activity).

Registration number of each license is assigned automatically by Register software;

6) type of the provided license for the right of implementation of the corresponding type of economic activity;

7) addresses of places of implementation of economic activities / storage locations of alcohol ethyl, spirit distillates, bioethanols/storage locations of tobacco raw materials:

addresses of production sites and identifiers of the taxation objects - for licenses for the right of production of alcohol ethyl, spirit distillates, bioethanol, alcoholic beverages, tobacco products, liquids used in electronic cigarettes;

addresses of storage locations of alcohol ethyl, spirit distillates, bioethanol and identifiers of the taxation objects - for licenses for the right of production of alcohol ethyl, spirit distillates, bioethanol, alcoholic beverages for which production are used alcohol ethyl and/or spirit distillates;

the place of cultivation of tobacco and the identifier of object of the taxation - for the license for the tobacco cultivation right;

addresses of storage locations of tobacco raw materials and identifiers of objects of the taxation - for licenses for the tobacco cultivation right, for the right of fermentation of tobacco raw materials, for the right of tobacco products manufacture if storage locations of tobacco raw materials are located at other address, than the location of tobacco products manufacture;

addresses of places of retail trade and identifiers of the taxation objects - for licenses for the right of retail trade by the alcoholic beverages, tobacco products, liquids used in electronic cigarettes.

If production of alcohol ethyl, spirit distillates, bioethanol, alcoholic beverages, tobacco products, liquids used in electronic cigarettes or storage of alcohol ethyl, spirit distillates, bioethanol, tobacco raw materials is performed in the territory of the single (complete) property complex located more than to one address in the Register all addresses at which such single (complete) property complex is located are specified.

The address is specified in format: The autonomous republic the Sevastopol Kiev/g Crimea/area/g, the area, the settlement (except Kiev and Sevastopol), the street, number of house/office; cadastral number of the parcel of land on which tobacco is grown up and is stored tobacco raw materials, - for licenses for the right of cultivation of tobacco or for the right of fermentation of tobacco raw materials;

8) codes of administrative and territorial units or the territories of territorial communities according to the codifier of administrative and territorial units and the territories of territorial communities on which are located:

production sites, - for licenses for the right of production of alcohol ethyl, spirit distillates, bioethanol, alcoholic beverages, tobacco products, liquids used in electronic cigarettes;

storage locations of alcohol ethyl, spirit distillates, bioethanol, - for licenses for the right of production of alcohol ethyl, spirit distillates, bioethanol, alcoholic beverages for which production are used alcohol ethyl and/or spirit distillates;

the place of cultivation of tobacco, - for the license for the tobacco cultivation right;

storage locations of tobacco raw materials, - for licenses for the tobacco cultivation right, for the right of fermentation of tobacco raw materials, for the right of tobacco products manufacture if storage locations of tobacco raw materials are located at other address, than the location of tobacco products manufacture;

places of retail trade, - for licenses for the right of retail trade by the alcoholic beverages, tobacco products, liquids used in electronic cigarettes;

9) about arrangement of the place of retail trade outside the inhabited Items administrative centers of areas, Kiev and Sevastopol at distance to 50 kilometers and about availability of trade floor more than 500 quarter of meters - for licenses for the right of retail trade by alcoholic beverages (except cider and Perry (without alcohol addition), the tobacco products, liquids used in electronic cigarettes;

10) the list of commodity codes (products) which will be made, according to UKTVED, provided in the statement for receipt of the license for the right of implementation of the corresponding type of economic activity, - for licenses for the right of production of alcohol ethyl, spirit distillates, bioethanol, alcoholic beverages, tobacco products, liquids used in electronic cigarettes on the tobacco cultivation right, on the right of fermentation of tobacco raw materials;

11) sign of small production (1 - small production of distillates, 2 - small production of wine-making products, 3-small production of beer);

12) code of classification of budget receipts, the amount of made payment, number and date of the payment instruction confirming introduction of the next (annual/quarterly) payment for the provided license for the right of implementation of the corresponding type of economic activity;

13) the list of fiscal numbers of registrars of settlement transactions, program registrars of settlement transactions, books of accounting of the settlement transactions and pay books which are available in the place of retail trade, date of introduction/exception of fiscal numbers of such registrars of settlement transactions / program registrars of settlement transactions in/from the Register-for of licenses for the right of retail trade by the alcoholic beverages, tobacco products, liquids used in electronic cigarettes;

14) effective date of the license for the right of implementation of the corresponding type of economic activity;

15) date of modification of the data containing in the Register;

16) date of cancellation of the license for the right of implementation of the corresponding type of economic activity;

17) the bases of cancellation of the license for the right of implementation of the corresponding type of economic activity according to part two of article 46 of the Law;

18) date of the judgment which took legal effect, and file number in which the decision on recognition illegal and cancellation of the decision of body of licensing on cancellation of the license for the right of implementation of the corresponding type of economic activity is made;

19) the fact that the decision of body of licensing on cancellation of the license for the right of implementation of the corresponding type of economic activity is stopped based on the judgment with indication of date of the judgment which took legal effect and file number in which the decision on suspension of action of the decision of body of licensing on cancellation of the license for the right of implementation of the corresponding type of economic activity is made.

4. Data in Reestr are entered, change or excluded from it by the official of GNS which is determined by the public registrar Reestra (further - the public registrar), on the basis:

1) statements of the subject of managing (further - the applicant) about:

modification of the data containing in the Register;

introduction of the next (annual/quarterly) payment for the provided license for the right of implementation of the corresponding type of economic activity;

2) the decision, the licensing accepted by body, about:

provision of the license for the right of implementation of the corresponding type of economic activity based on the statement for receipt of the license for the right of implementation of the corresponding type of the economic activity (except licenses, which provision is performed in the automatic mode) provided by part three of article 43 of the Law, and copies of documents which are provided by parts four and the sixth article 43 of the Law;

cancellation of the license for the right of implementation of the corresponding type of economic activity based on the application submitted according to part six of Article 34 and Item of 1 part two of article 46 of the Law;

3) the Judgment which took legal effect.

The statement for receipt of the license for the right of implementation of the corresponding type of economic activity, for modification of the data containing in the Register on cancellation of the license for the right of implementation of the corresponding type of economic activity, about introduction of the next (annual/quarterly) payment for the provided license for the right of implementation of the corresponding type of economic activity moves the applicant/licensee in paper or electronic form according to the procedure, determined by article 42 of the Code.

The application for receipt of the license in the automatic mode is submitted by the applicant through the Single state web portal of electronic services for the right of implementation of the corresponding type of economic activity or electronically according to the procedure, stipulated in Clause 42 Codes.

Procedures for filling of statements for receipt of the license for the right of implementation of the corresponding type of economic activity, about modification of the data containing in the Register on cancellation of the license for the right of implementation of the corresponding type of economic activity and their form are approved by the resolution of the Cabinet of Ministers of Ukraine of April 4, 2025 No. 374 "Some questions of maintaining unified registers of licensees on production and turnover of alcohol ethyl, the spirit distillates, alcoholic beverages, tobacco products, tobacco raw materials and liquids used in electronic cigarettes, licensees and places of the address of fuel".

5. In case of lack of the bases for refusal in provision of the license in the automatic mode for the right of retail trade by the alcoholic beverages, tobacco products, liquids used in electronic cigarettes, the software of GNS in the automatic mode:

1) the subject of managing joins in the Register and the corresponding data are entered in the Register;

2) the statement is created of the Register electronically which goes to the licensee according to the procedure, stipulated in Clause 42 Codes.

6. The public registrar not later than during the next working day following behind day of decision making about provision or about refusal in provision of the license for the right of implementation of the corresponding type of economic activity:

1) enters data on provision of the license for the right of implementation of the corresponding type of economic activity in the Register and sends to the licensee the statement from the Register electronically according to the procedure, determined by article 42 of the Code;

2) is sent to the applicant by the decision electronically on refusal in the provision of the license for the right of implementation of the corresponding type of economic activity according to the procedure determined by article 42 of the Code with indication of in the solution of the basis for refusal in provision of the license.
