1. Approve the enclosed Rules of establishment of cost and subject of the capital expenditures performed within the agreement of leasing of vehicles and (or) motorized vehicles.

2. To provide to committee of the industry of the Industry ministry and construction of the Republic of Kazakhstan in the procedure established by the legislation:

1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

2) placement of this order on Internet resource of the Industry ministry and construction of the Republic of Kazakhstan.

3. To impose control of execution of this order on the supervising vice-Minister of Industry and construction of the Republic of Kazakhstan.

4. This order becomes effective after ten calendar days after day of its first official publication.

Rules of establishment of cost and subject of the capital expenditures performed within the agreement of leasing of vehicles and (or) motorized vehicles

Chapter 1. General provisions

1. These rules of establishment of cost and subject of the capital expenditures performed within the agreement of leasing of vehicles and (or) motorized vehicles (further - Rules), are developed according to item 4 of Article 14 of the Budget code of the Republic of Kazakhstan and determine procedure for establishment of cost and subject of the capital expenditures performed within the agreement of leasing of vehicles and (or) motorized vehicles.

2. In these rules the following basic concepts are used:

1) the vehicle - the device intended for transportation across roads of people, freights or the equipment installed on it;

2) the motorized vehicle - the self-propelled road vehicle set in motion by the engine, except for electric scooters, small electric vehicles and rail vehicles. The concept extends also to tractors and self-propelled machines with their participation in traffic.

Within these rules the subject of the capital expenditures performed within the agreement of leasing of vehicles and (or) motorized vehicles (further - subject of capital expenditures), is understood as the services of the legal entities and physical persons who are individual entrepreneurs, performing leasing activities as the lessor in provision in leasing of the vehicles and (or) motorized vehicles made by the legal entities of the Republic of Kazakhstan who signed the relevant agreements on industrial assembly.

In case of predostvaleniye of garbage trucks and fire trucks in leasing, such garbage trucks and fire trucks shall be made with use of the musorovozny equipment or the fire superstructure made within the signed agreement on industrial assembly of components to vehicles on the musorovozny equipment and fire superstructure.

Chapter 2. Procedure for establishment of cost and subject of the capital expenditures performed within the agreement of leasing of vehicles and (or) motorized vehicles

Administrators of the budget programs (further - ABP) send inquiries to the Industry ministry and constructions of the Republic of Kazakhstan (further - the Ministry) with indication of technical characteristics of the vehicles and (or) motorized vehicles planned to purchase within the agreement of leasing.

4. The ministry within 5 working days from the date of receipt of request of ABP sends to the producers of vehicles and (or) motorized vehicles which signed the relevant agreements on industrial assembly, request on provision of information on the vehicles and (or) motorized vehicles corresponding to the technical characteristics provided in request of ABP.

5. Producers of vehicles and (or) motorized vehicles within 5 working days from the date of receipt of request send the answer to the Ministry with indication of technical characteristics, names of brand and model, and also cost of the vehicles and (or) motorized vehicles made by them.

6. The ministry within 5 working days from the date of receipt of answers from producers of vehicles and (or) motorized vehicles performs the general code of the arrived information and sends the consolidated information to ABP.

7. ABP within 5 working days from the date of receipt from the Ministry of reply to the request places on the official Internet resource the announcement of collection of offers from the legal entities and physical persons who are individual entrepreneurs, performing leasing activities as the lessor on the cost of services in provision in leasing of vehicles and (or) motorized vehicles.

In the announcement the cost of vehicles and (or) motorized vehicles according to information provided by the Ministry according to Item 6 of these rules is specified.

8. The legal entities and physical persons who are individual entrepreneurs, performing leasing activities as the lessor within 10 working days from the date of placement on the website of ABP provide announcements in ABP of the offer on cost of services in provision in leasing of vehicles and (or) motorized vehicles taking into account the cost of the vehicles and (or) motorized vehicles specified in the announcement.

9. The cost of the capital expenditures performed within the agreement of leasing of vehicles and (or) motorized vehicles is determined by the departmental budget commission of ABP on the basis of the smallest cost of services in provision in leasing of the vehicles and (or) motorized vehicles specified in the offers provided according to Item 8 of these rules.
