About establishment of criteria by which the companies, organizations, the organizations are determined important for industry of national economy in the sphere of banking activity

According to Articles 7, of 15, 56 Laws of Ukraine "About the National Bank of Ukraine", Criteria and procedure by which determination of the companies, organizations and organizations which are crucial for functioning of economy and ensuring activity of the population during the special period is performed and also crucial for ensuring needs of the Armed Forces, other military forming during the special period approved by the resolution of the Cabinet of Ministers of Ukraine of January 27, 2023 No. 76 (in edition of the resolution of the Cabinet of Ministers of Ukraine of June 05, 2024 No. 650) (with changes), for the purpose of establishment of criteria by which the companies, organizations, the organizations are determined important for industry of national economy in the sphere of banking activity the Board of the National Bank of Ukraine decides:

1. Establish criteria by which the companies, organizations, the organizations (further - the company) are determined important for industry of national economy in the sphere of banking activity (except the company which is the bank referred to category insolvent):

1) the company is the bank determined by the National Bank of Ukraine as systemically important;

2) the company is bank which share in total amount of the loans granted to clients by the companies which are banks of Ukraine (except the companies which are banks which 75 percent and more authorized capital belong to the state and the companies which are the banks referred to category insolvent), without the amount of the loans granted to the companies which are banks exceeds four percent and which share in the total amount of means on customer accounts of the companies which are banks of Ukraine (except the companies, which are banks which 75 percent and more authorized capital belongs to the state, and the companies, which are banks, carried to category insolvent), without the amount of obligations to the companies which are banks, are exceeded by four percent;

3) the company is bank which share in total amount of the guaranteed household deposits in bank system (except the companies which are banks which 75 percent and more authorized capital belong to the state and the companies which are the banks referred to category insolvent) exceeds four percent.

2. The basis for determination of the company it that is important for industry of national economy in the sphere of banking activity, is compliance to one or more criteria specified in Item 1 of this resolution.

3. The National Bank of Ukraine perfroms measure calculation, 3 Items 1 of this resolution specified in subitems 2,, according to procedure of payments of indicators for determination of the companies, organizations, the organizations which are important for industry of national economy in the sphere of banking activity, determined in appendix to this resolution.

4. To impose control over the implementation of this resolution on the vice-chairman of the National Bank of Ukraine Dmitry Oleynik.

5. The resolution becomes effective from the date of, its official publication following behind day.

to the Resolution of Board of the National Bank of Ukraine of March 28, 2025 No. 38

Procedure of payments of indicators for determination of the companies, organizations, the organizations which are important for industry of national economy in the sphere of banking activity

1. Measure calculation for determination of the companies, organizations, organizations (further - the company) which are important for industry of national economy in the sphere of banking activity is performed annually till July 01 according to the reporting of the companies which are banks of Ukraine (except the companies which are banks which 75 percent and more authorized capital belong to the state, and the companies which are the banks referred to category insolvent) as of January 01 of year in which such calculation is perfromed.

Measure calculation for determination of the company which is the bank which is important for industry of national economy in the sphere of banking activity till July 01, 2025 is performed based on the companies this to the reporting which are banks of Ukraine (except the companies which are banks which 75 percent and more authorized capital belong to the state, and the companies which are the banks referred to category insolvent) as of January 01, 2024.

2. Measure calculation is perfromed based on data of such reporting:

1) for indicators "Share of the company which is bank, in the total amount of the loans granted to clients by the companies which are banks of Ukraine" and "Share of the company which is bank, in the total amount of means on customer accounts of the companies which are banks of Ukraine" - according to the file 02x "Data on the turnovers and account balances" given in appendix 5 to Rules of the organization of the statistical reporting which moves in the National Bank of Ukraine, approved by the resolution of Board of the National Bank of Ukraine of November 13, 2018 No. 120 (with changes), without off-balance assets and liabilities;

2) for indicator "Share of the company which is bank, in the total amount of the guaranteed household deposits in bank system" - according to the report on household deposits in members of Fund of guaranteeing household deposits - form of the reporting No. 1F, the submission of the reporting by members of Fund of guaranteeing the physical persons approved by the decision of executive directorate of Fund of guaranteeing the household deposits of June 18, 2020 No. 1158, established by appendix 3 to Rules registered in the Ministry of Justice of Ukraine on August 31, 2020 at No. 831/35114 (with changes).

3. The indicator "Share of the company which is bank in the total amount of the loans granted to clients by the companies which are banks of Ukraine" is calculated as the relation of the amount of the loans granted by the company which is bank to clients to the total amount of the loans granted to clients by the companies which are banks of Ukraine (except the companies which are banks which 75 percent and more authorized capital belong to the state, and the companies which are the banks referred to category insolvent).
