About approval of Rules of provision of the reporting by the members of Fund of guaranteeing household deposits and recognition who voided decisions of executive directorate of Fund of guaranteeing household deposits of July 9, 2012 No. 4 and 5

According to Item 10 parts one, to item 4 of part four of article 12 of the Law of Ukraine "About system of guaranteeing household deposits" executive directorate of Fund of guaranteeing household deposits of RESHILA:

1. Approve Rules of provision of the reporting as members of Fund of guaranteeing household deposits which are applied.

2. Recognize invalid:

the decision of executive directorate of Fund of guaranteeing household deposits of July 9, 2012 No. 4 "About approval of Rules of provision of the reporting by members of Fund of guaranteeing household deposits", registered in the Ministry of Justice of Ukraine on July 27, 2012 for No. 1269/21581 (with changes);

the decision of executive directorate of Fund of guaranteeing household deposits of July 9, 2012 No. 5 "About procedure for creation of the report on household deposits in members of Fund of guaranteeing household deposits - reporting No. 1F form", registered in the Ministry of Justice of Ukraine on August 2, 2012 for No. 1314/21626 (with changes).

3. To provide to department of methodology, strategic planning and European integration together with legal department provision of this decision in the Ministry of Justice of Ukraine for implementation of its state registration.

4. For public relations and the international organizations to provide to management placement of this decision on the official site of Fund of guaranteeing household deposits on the Internet after its state registration.

5. This decision becomes effective in 30 calendar days after day of its official publication.

6. Control over the implementation of this decision to assign to the deputy managing director Bilay of E.S.

Rules of provision of the reporting by members of Fund of guaranteeing household deposits

I. General provisions

1. These Rules determine the list of forms/files of the reporting, procedure and frequency of their creation, terms and methods of provision in Fund of guaranteeing household deposits (further - Fund).

2. In these rules the terms below are used in such value:

the web portal of Fund - the centralized circle of provision of the automated services of Fund (the portal of the reporting of Fund) which is placed according to the reference https://report.fg.gov.ua;

non-working day - output, festive or other non-working day;

rules of work with the web portal of Fund - the electronic documents placed according to the reference https://report.fg.gov.ua/instructions;

The register of files of the reporting Fund - the ordered and systematized information system of the requirement description to the reporting which banks create directly for Fund;

the authorized person - the employee of bank which has powers and on its own behalf or at the request of person who it represents on legal causes imposes the corresponding digital signature on the file of the reporting;

The XSD scheme - the standard of the description of structures of data in the XML format.

The term" the special period "is used in the value given in the Law of Ukraine "About defense of Ukraine".

3. These Rules are obligatory for execution by members of Fund. The transitional bank submits the reporting taking into account the features established by appendices to these rules.

II. General requirements to creation and provision of the reporting

1. Members of Fund create forms/files of the reporting for Fund according to the procedure, determined by these rules, taking into account the requirements established by Regulations on procedure of payments, charges and payments of charges in Fund of guaranteeing household deposits, approved by the decision of executive directorate of Fund of guaranteeing household deposits of July 2, 2012 No. 1, registered in the Ministry of Justice of Ukraine on July 27, 2012 for No. 1273/21585.

2. The list of forms/files of the reporting provided by members of Fund in fund, method, frequency and term of its provision are given in appendix 1 to these rules.

3. For creation of forms/files of the reporting accounting data taking into account analytics parameter values are used.

4. Data of forms/files of the reporting are specified in units installed for each form / file of the reporting separately with rounding of the amounts to units, with preserving final and/or balance sheet data.

5. The participant Fonda creates and sends to Fund forms/files of the reporting with aggregated data under organization in general taking into account all separate divisions of bank.

6. Forms/files of the reporting in the form of electronic documents move:

through the web portal of Fund - for files of the reporting in the XML format;

means of electronic communication of the National Bank of Ukraine - for files of the reporting "The reporting file of the register of transactions of "RO" (further - fayl_ro) and "The reporting file of the register of contracts (agreements, agreements, transactions) "RC" (further - fayl_rc) (further together - reporting files N).

7. Members of Fund submit the forms/files of the reporting created to Fund:

according to the requirements established by Fund for forms/files of the reporting which are created directly for Fund;

according to the requirements established by the National Bank of Ukraine - for forms/files of the reporting which are created for the National Bank of Ukraine and move in Fund.

8. The general description of forms/files of the reporting which members of Fund create directly for Fund is given in appendices 2 - 8 to these rules.

9. For the files of the reporting in the XML format given in appendices 3 - 6 to these rules which members of Fund create directly for Fund and give through the web portal of Fund, XSD schemes are used.

XSD schemes, descriptions kontroly and compound measure codes for forms/files of the reporting affirm as the XML format which banks create directly for Fund, and changes in them the decision of executive directorate of Fund.

Information on XSD schemes, descriptions kontroly and compound measure codes for forms/files of the reporting in the XML format which banks create directly for Fund and information on introduction of changes in them with indication of the term (terms) of their introduction, is posted on the official website of Fund in the Section "For Banks/list Reporting/register of Files of the Reporting of Fund" (further - the page of the Register of files of the reporting of Fund) not later than 30 calendar days before date of their introduction. The fund notifies members of Fund on the specified changes by the letter.

10. Members of Fund create reporting files N, requirements to which forming are given in appendices 7 and 8 to these rules, directly for Fund and give means of electronic communication of the National Bank of Ukraine.

Descriptions and control of information lines (measure codes and their values) by component of measure code of RRR of reporting files N (for fayla_rc), and changes in them, affirm the decision of executive directorate of Fund.

Information concerning the description and control of information lines (measure codes and their values) by component of measure code of RRR of reporting files H (for fayla_rc) and information on introduction of changes in them with indication of the term (terms) of their implementation can be found on the page of the Register of files of the reporting of Fund not later than 30 calendar days before date of their introduction.

The fund notifies members of Fund on the specified changes by the letter.

When forming measure codes and code values of indicators of files H members of Fund use data from ABS (ODB) and other corresponding program complexes which are used by them in activities.

Members of fund shall provide possibility of forming of reporting files H as of any reporting date on which the file with indicators of the statistical reporting 01x "data on account balances" which is created according to the rules of the organization of the statistical reporting submitted to the National Bank of Ukraine, approved by the resolution of Board of the National Bank of Ukraine of November 13, 2018 No. 120 moves.

11. Provision of the reporting by members of Fund on papers, and also other information (upon the demand of Fund) is performed by the registered mail by means of mail service, mail and messenger service or the courier.

12. If the reporting or other information (upon the demand of Fund) is provided in Fund on papers, date of provision of the reporting in Fund is considered:

in case of provision by mail and messenger service or the courier - date of its registration in Fund;

in case of giving by means of mail service - date on postage stamp of the company (department) of communication serving the sender.

13. If the reporting is provided in Fund in the form of files or electronic documents, as time and date of provision of the reporting are considered:

in case of provision by means of electronic communication of the National Bank of Ukraine - time and date of its obtaining by Fund which are fixed in the magazine of statistics of means of electronic communication of the National Bank of Ukraine;

in case of giving through the web portal of Fund - time and date of its obtaining by Fund fixed on the web portal of Fund.

14. The reporting which members of Fund create directly for Fund with daily frequency of representation moves with reporting date which the next calendar day is (as of 00 hours 00 minutes).

15. The reporting which members of Fund create directly for Fund with indicators for forms/files of the reporting on remaining balance for the end of day with daily frequency of representation moves:

1) for each working day;

2) for the last calendar day of month (the working day or non-working day).

16. The reporting which members of Fund create directly for Fund with indicators for forms/files of the reporting on turnovers from daily frequency of representation moves and includes:

1) for working puts-includes turnovers for such working day and for the non-working day, non-working days preceding such working day (except non-working day, non-working days for which turnovers move according to subitem 2 of this Item);

2) for the last calendar day of month (the working day or non-working day) - includes turnovers for such last calendar day of month and for the non-working day, non-working days preceding it.

17. The reporting which members of Fund create directly for Fund and which moves with the each decade frequency determined in appendix 1 to these rules moves with reporting date 01, of 11, 21 dates (as of 00 hours 00 minutes), except cases when the 10 or 20 falls on non-working day.

The reporting which members of Fund create directly for Fund and which moves with the each decade frequency determined in appendix 1 to these rules if the 10 or 20 falls on non-working day, moves with reporting date which the next calendar day (as of 00 hours 00 minutes) after the last working day in the corresponding decade is (from 01 to 10 dates, from 11 to 20 dates).

The reporting which members of Fund create directly for Fund and which moves with the each decade frequency determined in appendix 1 to these rules with reporting date 01 dates moves irrespective of, the last calendar day of month for the working day or non-working day falls.

18. The reporting which members of Fund create directly for Fund with the monthly, quarter frequency of representation determined in appendix 1 to these rules moves with reporting date 01 numbers after the accounting period.

19. The participant Fonda has the right to make changes to the reporting submitted to them to Fund and, respectively, independently to replace the given/submitted form/file of the reporting:

1) for the reporting which is submitted daily and ezhedekadno - no later than the next working day after the termination of the term (terms) of provision of the reporting;

2) for other reporting - no later than the second working day after the termination of the term (term) of provision of the reporting.

20. In case of adoption by the National Bank of Ukraine of the decision on postponement of provision of the reporting by banks in the National Bank of Ukraine the Fund has the right the decision of executive directorate of Fund to postpone the date of provision of the reporting in Fund.

21. If the deadline of submission of the reporting falls on non-working day, the date of submission of the reporting is postponed on the first behind it the working day.

If the reporting date of the reporting which moves daily or ezhedekadno falls on non-working day, the deadline (term) of submission of such reporting is postponed on the second behind it the working day.

22. In case of modification of the form/file of the reporting, method of its provision, determined by these rules, or introductions of new form / the new file of the reporting the executive directorate of Fund can make the decision on establishment of the test period for creation and giving by all members of Fund of the corresponding/corresponding form/file of the reporting in Fund.

For creation and giving in Fund by the member of Fund of reporting files N establishes the test period within thirty calendar days from the date of reference of such member of Fund in category of problem.

During the test period of the requirement concerning creation and provision in Fund of forms/files of the reporting, established procedure of error correction during filling of forms/files of the reporting do not change.

The assumption of mistakes in the reporting files N provided to Fund during the test period and the reporting under the changed / new forms / files or methods of provision is not considered violation of procedure for creation or provision of data in Fund or submission of false information by bank of Fund for which the Fund inflicts administrative penalties and administrative sanctions.

23. In case of provision in the National Bank of Ukraine according to its requirement or based on its permission of the corrected reporting from structure of the reporting which is created for the National Bank of Ukraine and moves in Fund, the participant Fonda shall submit to Fund such corrected reporting no more than two working days from the date of its provision in the National Bank of Ukraine together with explanation of the reasons and the bases of correction in time.

If the correction of the reporting specified in paragraph one of this Item is caused by the reasons which are not depending on the member of Fund, assumption of errors in primary reporting which were corrected upon the demand of or based on permission of the National Bank of Ukraine, and also provision of the corrected reporting outside the term (terms), stipulated in Item 19 these rules, it is not considered violation of Item of 1 part two of article 33 of the Law of Ukraine "About system of guaranteeing household deposits" or provision of false information by bank of Fund for which the Fund inflicts administrative penalties and administrative sanctions.

24. The forms/files of the reporting which are separately determined in appendix 1 to these rules are provided by bank through the National Bank of Ukraine according to the Agreement on cooperation between the National Bank of Ukraine and Fund concluded according to articles 55 and 56 of the Law of Ukraine "About system of guaranteeing household deposits".

25. Features of creation of forms/files of the reporting by members of Fund, procedure for their submission to Fund during the special period are determined according to the laws of Ukraine and the regulatory legal act of fund on features of functioning of system of guaranteeing household deposits during the special period regarding submission of the reporting by members of Fund.

III. Signing and sending the forms/files of the reporting represented to Fund

1. Heads of participating bank of Fund are responsible for reliability, completeness and timeliness of provision of forms/files of the reporting.

The procedure for authority delegation is determined by bank in its internal documents by signing by authorized persons of forms/files of the reporting.

Determination of persons, representatives to sign forms/files of the reporting, and persons who temporarily fulfill duties on signing of forms/files of the reporting on absence period of authorized persons it is performed depending on distribution of their functional obligations.

2. The authorized person for confirmation of authenticity and integrity imposes one of such types of the digital signature on the form/file of the reporting:

1) qualified digital signature;

2) digital signature of the National Bank of Ukraine.

3. The existing qualified certificate of open key of the authorized person, except obligatory details of subscriber, shall have certificate accessory signs to bank which representative is this authorized person (the full or official abbreviated name and identification code in the Unified state register of the companies and organizations of Ukraine).

4. Sending forms/files of the reporting to Fund is performed according to rules of work with the web portal of Fund.

IV. Verification of forms/files of the reporting on compliance to the requirements established by Fund

1. Verification of forms/files of the reporting on compliance to the requirements established by Fund is performed in the way:

1) control of structure of files of the reporting (technological) which is performed at the level of bank and Fund. Such control for files in the XML format is implemented in the XSD scheme;

2) control which is exercised at the level of Fund during acceptance of the file of the reporting and provides information on results of control, including logical and arithmetic;

3) the control exercised by Fund of timeliness and completeness of submission of the reporting.

2. The fund can apply expert control - control of quality of the received these forms / files of the reporting on their integrity, reliability, comparability to data of other sources of information.

3. Control of observance of these rules is exercised by Fund:

remotely;

during implementation of checks of banks by Fund.

4. The fund has the right to oblige the member of Fund to submit the corrected reporting in case of identification by results of the carried-out control of mistakes or discrepancies in data of the reporting.

5. The bank, in case of availability at Fund of notes to the reporting under results of control, shall provide explanation on request of Fund.

V. Features of submission of the reporting by joint-stock company "Government savings bank of Ukraine"

1. Before giving by "Government Savings Bank of Ukraine" joint-stock company (further - Sberbank) the reporting of Fund within three years from the date of receipt of participant status of Fund by Sberbank regulations of the Sections I-IV of these rules taking into account the features determined by this Section are applied.

2. The form/file of the reporting "Calculation of the amount of the initial charge which is subject to payment in Fund of guaranteeing household deposits", provided in Item 2 of the Section I of appendix 1 to these rules, goes Sberbank to Fund one-timely in paper or electronic form within 80 calendar days from the date of receipt of participant status of Fund by Sberbank.

3. The form/file of the reporting "Calculation of the amount of regular collection which is subject to payment in Fund of guaranteeing household deposits" (GCCX file), provided in Item 3 of the Section I of appendix 1 to these rules, goes Sberbank to Fund through the web portal of Fund in the form of the file in the XML format, according to the description given in appendices 2 and 4 to these rules and according to the XSD scheme, kontrolyam and the descriptions of the constituting measure codes placed on the page of the Register of files of the reporting of Fund.

4. The form/file of the reporting "Calculation of regular collection in the form of the differentiated collection which is subject to payment in Fund of guaranteeing household deposits" (GLLX file), provided in item 4 of the Section I of appendix 1 to these rules, does not move Sberbank.
