About approval of the Regulations on procedure for selection of the national operator of the sea register of the Kyrgyz Republic

1. Approve Regulations on procedure for selection of the national operator of the sea register of the Kyrgyz Republic (further - the national operator) according to appendix 1.

2. Approve structure of the interdepartmental commission on selection of the national operator according to appendix 2.

3. Interdepartmental commission on selection of the national operator:

1) to make selection of the national operator according to the Provision specified in Item 1 of this resolution;

2) following the results of selection within 3 (three) working days to send the decision on determination of the national operator to the Ministry of Economy and Trade of the Kyrgyz Republic.

4. To the Ministry of Economy and Trade of the Kyrgyz Republic within 7 (seven) working days from the date of receipt of the decision on determination of the national operator to introduce the draft of the relevant decision of the Cabinet of Ministers of the Kyrgyz Republic to Administration of the President of the Kyrgyz Republic.

5. To the national operator (under approval) to establish the cost of the rendered services, including the registration fees and payments for provision of certificates or other documents in the procedure established by the legislation.

6. To impose control of execution of this resolution on management of control of execution of decisions of the President and the Presidential Administration Cabinet of Ministers of the Kyrgyz Republic.

7. This resolution becomes effective after seven days from the date of official publication.

Regulations on procedure for selection of the national operator of the sea register of the Kyrgyz Republic

Chapter 1. General provisions

1. The regulations on procedure for selection of the national operator of the sea register of the Kyrgyz Republic (further - the Provision) are developed according to the Law of the Kyrgyz Republic "About accession (acceptance) of the Kyrgyz Republic to the Convention on the International Maritime Organization accepted in Geneva on March 6, 1948" of January 30, 2023 No. 29.

2. The provision establishes conditions of selection of the national operator.

3. Selection of the national operator of the sea register of the Kyrgyz Republic (further - the national operator) is carried out by the interdepartmental commission created by the Cabinet of Ministers of the Kyrgyz Republic.

4. In the Provision the following terms and determinations are used:

the participant of selection - the legal entity of the Kyrgyz Republic created according to the legislation of the Kyrgyz Republic;

the application for participation in selection - the document package containing the proposal of the participant, and also information confirming compliance of the participant to requirements imposed to participants of selection.

Chapter 2. Main conditions of selection of the national operator

5. The national operator determines the legal entity of the Kyrgyz Republic created according to the legislation of the Kyrgyz Republic in the field of registration of legal entities.

6. The main conditions of selection of the legal entity applying for implementation of activities as the national operator are:

1) absence on the date of the address of unexecuted obligation on customs and tax payments, and also debt on insurance assignments according to the legislation of the Kyrgyz Republic in the field of the customs and tax case;

2) availability of the qualified personnel having the corresponding education and experience in the field of maritime law, navigation, logistics or technical advice behind courts;

3) the obligation of the company to provide integration into the international sea conventions and systems, including development and support of the technical documentation used in the international practice of navigation;

4) at least 51% of the authorized capital of the company shall belong to citizens of the Kyrgyz Republic who act as founders.

Chapter 3. Interdepartmental commission on selection of the national operator

7. The interdepartmental commission on selection of the national operator (further - the commission) is guided by the legislation of the Kyrgyz Republic and this Provision.

8. The commission consists of the chairman, vice-chairmen, members and the secretariat. The secretariat of the commission has no right to vote.

9. The secretariat of the commission are responsibles of the Ministry of Economy and Trade of the Kyrgyz Republic.

10. The chairman directs activities of the commission, approves the agenda and presides over commission sessions.

11. In the absence of the commission chairman its functions are performed by one of vice-chairmen.

12. The secretariat carries out work on preparation and holding meeting, takes the minutes of the commission.

13. Commission chairman:

1) directs activities and will organize work of the commission;

2) determines date and the venue of commission session, the agenda;

3) puts proposals of members of the commission and drafts of decisions to the vote;

4) sums up the results of vote and announces the made decisions.

14. Secretariat of the commission:

1) is published by the announcement of selection of the national operator;

Accepts 2) and registers requests of participants of selection of the national operator;

3) prepares necessary documents (materials) according to the agenda of meeting;

4) notifies members of the commission on date of meeting and directs them materials for meeting;

5) is prepared by the minutes and the decision of the commission;

6) is provided by accounting, storage of information and documents of the commission according to the Law of the Kyrgyz Republic "About National Archive Fund of the Kyrgyz Republic".
