About approval of Rules of forming, maintaining and use of the register of investors

According to Item 5 of article 282-3 of the Entrepreneurial code of the Republic of Kazakhstan, PRIKAZYVAYU:

1. Approve the enclosed Rules of forming, maintaining and use of the register of investors.

2. To provide to committee on investments of the Ministry of Foreign Affairs of the Republic of Kazakhstan in the procedure established by the legislation:

1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

2) placement of this order on Internet resource of the Ministry of Foreign Affairs of the Republic of Kazakhstan after its official publication;

3) within ten working days after state registration in the Ministry of Justice of the Republic of Kazakhstan of this order submission to Department of legal service of the Ministry of Foreign Affairs of the Republic of Kazakhstan of data on execution of the actions provided by subitems 1) and 2) of this Item.

3. To impose control of execution of this order on the supervising deputy minister of foreign affairs of the Republic of Kazakhstan.

4. This order becomes effective after ten calendar days after day of its first official publication.

Rules of forming, maintaining and use of the register of investors

Chapter 1. General provisions

1. These rules of forming, maintaining and use of the register of investors (further - Rules) are developed according to Item 5 of article 282-3 of the Entrepreneurial code of the Republic of Kazakhstan and determine procedure for forming, maintaining and use of the register of investors.

2. The basic concepts used in these rules:

1) national pool of investment projects - the list of the realized and studied investment projects in all industries of economy, worth over hundred fifty the thousandfold monthly settlement indicator established by the law on the republican budget and operating for January 1 of the corresponding financial year and also the investment projects realized based on investment contracts as which initiators subjects of private entrepreneurship (domestic and foreign investors) act;

2) it is excluded according to the Order of the deputy. The Minister of Foreign Affairs of the Republic of Kazakhstan of 07.08.2025 No. 11-1-4/475;

3) the register of investors - the electronic database containing the information about investors about the amounts of investments, types of investment projects, stages of their realization and other data on investing activities in the territory of the Republic of Kazakhstan;

3-1) common regional pool of investment projects - the list of the realized and studied investment projects in all industries of economy, the thousandfold monthly settlement indicator worth up to hundred fifty established by the law on the republican budget and operating for January 1 of the corresponding financial year as which initiators subjects of private entrepreneurship (domestic and foreign investors) act, created by local executive bodies, on condition of their compliance to the criteria approved by the solution of the regional investment staff;

4) national digital investment platform (further - NTsIP) - unified information system of comprehensive support of investment projects which creation, management and technical support is performed by authorized body on investments.

Chapter 2. Procedure for forming and maintaining register of investors

3. Forming and maintaining the register of investors is performed in the automatic mode in NTsIP based on data on the investment projects included in national and common regional pools of investment projects.

4. Inclusion of data in the register of investors is performed in the automatic mode after forming of the passport of the investment project in NTsIP.

5. Forming of national and common regional pools of investment projects are performed according to Rules of the organization of "one window" for the investors, and also order of interaction in case of investment attraction approved by the order of the Minister of Foreign Affairs of the Republic of Kazakhstan of June 26, 2023 No. 11-1-4/327 (it is registered in the Register of state registration of regulatory legal acts at No. 32910).

Chapter 3. Procedure for use of the register of investors

The physical person or legal entity uses the Section "Register of Investors" in NTsIP for verification of presence of physical person and legal entity in the register of investors by input in the field "Search" of individual identification number for physical person or business and identification number for the legal entity and receipt of data on inclusion or absence of this person in the register of investors.
