requirements to contents of the obligation of the Russian Federation in case of re-export or transfer to the third countries of military products of foreign production and the statement on its obtaining;

Rules of submission of documents for receipt of the obligation of the Russian Federation in case of re-export or transfer to the third countries of military products of foreign production.

2. This resolution becomes effective from the date of its official publication.

Requirements to contents of the obligation of the Russian Federation in case of re-export or transfer to the third countries of military products of foreign production and the statement on its obtaining

I. General provisions

1. The concepts used in these requirements mean the following:

"the obligation of the Russian Federation in case of re-export or transfer to the third countries of military products of foreign production" - the document containing the obligation of the Russian Federation not to agree to foreign state in which re-export or transfer of military products, is planned for its further re-export or transfer to other countries without the consent of foreign state from which import to the Russian Federation of military products was performed;

"buyer" - the Russian organization having in accordance with the legislation of the Russian Federation the right to implementation of foreign trade activity concerning military products and which signed the purchase contract of military products of foreign production with the supplier;

"supplier" - authorized body of foreign state or the foreign legal entity or physical person having according to the legislation of the state the right to implementation of foreign trade activity concerning military products and which signed the delivery contract of military products of foreign production with the buyer;

"consumer" - the Russian organization - developer and producer of military products for which needs the military products of foreign production are imported;

"the end user of products" - foreign state to which the military products of foreign production are re-exported or transferred from the Russian Federation;

"authorized body of foreign state" - the state body given according to the legislation of the state authority to make decisions on export of military products;

"military products of foreign production" - the military products belonging to foreign state.

II. Requirements to contents of the obligation of the Russian Federation in case of re-export or transfer to the third countries of military products of foreign production

2. The obligation of the Russian Federation in case of re-export or transfer to the third countries of military products of foreign production (further - the obligation of the Russian Federation) is drawn up in one copy in form according to appendix No. 1.

3. The obligation of the Russian Federation is drawn up on number forms, signed by the Director of the Federal Service for Military-Technical Cooperation or the official authorized by it and makes sure seal of Service.

4. Number of the obligation of the Russian Federation consists of 10 figures and is created as follows:

The 1st - the 5th figures - figures from code of the authorized body of the Russian Federation which issued the obligation under the All-Russian Classifier of Governmental Authorities OK 006-2011;

The 6th and 7th figures - the last figures of year of issue of the obligation of the Russian Federation;

The 8th - the 10th figures - the registration number of the obligation of the Russian Federation assigned to it by Federal Service for Military-Technical Cooperation.

5. The obligation of the Russian Federation is filled in based on the data specified in the statement.

6. In case of need modification of the issued obligation of the Russian Federation it is subject to renewal.

III. Requirements to execution of the statement on receipt of the obligation of the Russian Federation in case of re-export or transfer to the third countries of military products of foreign production

7. The statement on receipt of the obligation of the Russian Federation (further - application) is issued by the organization which is the subject of military and technical cooperation (further - the organization applicant), in form according to appendix No. 2.

8. The application is signed by the head of the organization applicant or person authorized by it whose specimen signatures together with sample of seal of the organization applicant are represented to Federal Service for Military-Technical Cooperation.
