1. Approve requirements to the equipment of special places / rooms for tobacco smoking and nicotine (the tobacco and nicotinocontaining products) according to appendix.

2. To state bodies, plenipotentiaries of the President of the Kyrgyz Republic in areas, local government bodies of the Kyrgyz Republic (in coordination):

1) to take the necessary measures following from this resolution;

2) to perform execution of this resolution within the budgets and the number of staff approved for the corresponding years.

3. To impose control of execution of this resolution on management of control of execution of decisions of the President and the Presidential Administration Cabinet of Ministers of the Kyrgyz Republic.

4. This resolution becomes effective after fifteen days from the date of official publication.

Requirements to the equipment of special places / rooms for tobacco smoking and nicotine (the tobacco and nicotinocontaining products)

Chapter 1. General provisions

1. Requirements to the equipment of special places / rooms for tobacco smoking and nicotine (the tobacco and nicotinocontaining products) (further - requirements) determine sanitary and hygienic and fire protection regulations to the equipment of special places / rooms for smoking of tobacco products (including products with the heated tobacco by means of electronic systems of heating of tobacco), tobacco or tobacco mix (by means of hookah) and the nicotinocontaining liquid or gel with nicotine content (by means of electronic systems of delivery of nicotine) according to the Law of the Kyrgyz Republic "About protection of health of citizens of the Kyrgyz Republic against consequences of consumption of tobacco, nicotine and impact of environmental tobacco smoke and aerosol" (further - the Law).

2. Regulations of these requirements do not extend to places in which the Law establishes prohibition on smoking of all types of the tobacco and nicotinocontaining products.

3. Smoking in public places is allowed in the open air, except for places where the prohibition according to the Law is established.

4. These requirements are the fundamental document for legal entities and individual entrepreneurs in case of the equipment of special rooms for tobacco smoking and nicotine (the tobacco and nicotinocontaining products) in the cases established by the Law.

Chapter 2. Requirements to special rooms

5. In the cases provided by the Law, tobacco smoking and nicotine (the tobacco and nicotinocontaining products) can be organized in special rooms.

6. The special room for tobacco smoking and nicotine (the tobacco and nicotinocontaining products) shall:

1) to be placed indoors, equipped with forced-air and exhaust system of the ventilation with mechanical motivation providing assimilation of the pollution allocated in the course of tobacco smoking and nicotine, and also interfering penetration of the polluted air into adjacent rooms, ventilation, separate from general exhaust system;

2) to be isolated from the main rooms (rooms) of the building where smoking is forbidden, to have the confined area, walls from floor to ceiling, door or the similar device interfering penetration of the pollution allocated in the course of tobacco smoking and nicotine to adjacent placements, including to sanitary and household rooms for the purpose of exception of contact non-smoking with the pollution allocated in the course of tobacco smoking and nicotine (the tobacco and nicotinocontaining products). It is allowed to place the rooms which are specially allocated for smoking in the form of cabins at least 6 sq.m in size;

3) to be equipped with ashtrays and (or) ballot boxes for collection of stubs, filling of ballot boxes with sand and other nonflammable absorbing materials for ensuring suppression of stubs and matches and placement in the means allowing to get rid of tobacco smoke and (or) smell and the fire extinguisher is allowed (amount at least 5 kilograms);

4) to be placed the text or the sign "The Room for Smoking" in a visible place from outer side of the room;

5) to be carried out daily damp cleaning using washing and disinfectants, ballot box and ashtray daily and in process of filling to be exempted from stubs and garbage, to wash daily using washing and disinfectants.

Chapter 3. Requirements to special places

7. Special smoking areas of tobacco and nicotine (the tobacco and nicotinocontaining products) are allocated in the open air:

1) in the territories of the organizations and companies irrespective of patterns of ownership;

2) on the open areas during cultural and mass, sporting events, meetings, shares, in borders of the territories occupied with beaches;

3) in the public places in the open air determined by local government bodies.

8. Special smoking areas of tobacco and nicotine (the tobacco and nicotinocontaining products) takes place far from windows and entrance to premises of the organizations for the purpose of exception of distribution of tobacco smoke or aerosol to inside buildings and it is equipped with ballot box.

9. State bodies, local government bodies, legal entities irrespective of patterns of ownership, individual entrepreneurs provide carrying out daily cleaning of ballot boxes of stubs and garbage.
