About modification of the technical regulation of the Customs union "About safety of perfumery and cosmetic products" (TR CU 009/2011)"

According to article 52 of the Agreement on the Eurasian Economic Union of May 29, 2014 and Item 29 of appendix № 1 to the Regulations of work of the Eurasian economic commission approved by the Decision of the Supreme Eurasian economic council of December 23, 2014 № 98, Council of the Eurasian economic commission decided:

1. Bring in the technical regulation of the Customs union "About safety of perfumery and cosmetic products" (TR CU 009/2011) accepted by the Decision of the Commission of the Customs union of September 23, 2011 No. 799, of change according to appendix (further - changes in the technical regulation).

2. This Decision becomes effective after 12 months from the date of its official publication, except for:

a) the paragraph of the sixth Item of 2 changes in the technical regulation which becomes effective after inclusion in the list of the international and regional (interstate) standards, and in case of their absence - the national (state) standards containing rules and methods of researches (testing) and measurements, including the rules of sampling necessary for application and execution of requirements of the technical regulation of the Customs union "About safety of perfumery and cosmetic products" (TR CU 009/2011) and implementation of assessment of conformity of objects of technical regulation, No. approved by the Decision of Board of the Eurasian economic commission of December 22, 2020 177, interstate standards on ensuring application and execution of the requirements established in the technical regulation for products applied on products;

b) the paragraph of the third subitem "v" of Item 5 and the subitem "d" of Item of 11 changes in the technical regulation which become effective since July 1, 2026.

The changes made to the technical regulation of the Customs union "About safety of perfumery and cosmetic products" (TR CU 009/2011)

1. In the text of the word "state member of TS", "state member of the Eurasian Economic Union", "state member of the Customs union" in the corresponding number and case shall be replaced with words "state member" in the corresponding number and case, the words "this technical regulation of TS" in corresponding case shall be replaced with words "this technical regulation" in the corresponding case.

"Article 1. Scope

1. This technical regulation extends on:

the finished perfumery and cosmetic goods (including on carriers) released in the territories of state members of the Eurasian Economic Union (further respectively - state members, the Union);

the perfumery and cosmetic products applied on the products of light industry released in the territories of state members which do not belong to perfumery and cosmetic products on carriers;

the perfumery and cosmetic products applied on the products (except products of light industry) released in the territories of state members which do not belong to perfumery and cosmetic products on carriers.

2. On perfumery and cosmetic products which are applied on the products released in the territories of state members and does not treat perfumery and cosmetic products on carriers, only requirements of Items 2 - 6, 9.1, 9.3 and 10, and also Item 9.2 (regarding information on special precautionary measures (if necessary) and data on methods of application of perfumery and cosmetic products which lack can lead to misuse by the consumer of perfumery and cosmetic products (if necessary)) Article 5 of this technical regulation extend.

3. This technical regulation does not extend to the following products:

1) products intended for proglatyvaniye, inhalation, injection or implantation in body of the person;

2) the means for permanent make-up put with violation of integument;

3) products applied to diagnostics (gel for ultrasonography, etc.) and treatments, including registered as medicine, either medical product, or folk remedy;

4) products intended for anesthesia, the rassasyvaniya of bruises, removals of puffiness of legs, treatments of bruises and wounds, removals of high-quality new growths (warts, papillomas, etc.) influencing veins and joints;

5) products intended for acoustical pass, mucous membrane of nose, mucous membrane of eyes;

6) disinfecting and antiseptics, repellents;

7) products intended for detection of dental plaque;

8) lubricants, intimate gels-lubricants;

9) fluoric varnishes for teeth;

10) wet toilet paper;

11) products intended for mucous membrane of genitals and back pass;

12) glue for gluing of eyelashes, pastes, tips.

4. This technical regulation establishes requirements to products, and also to the related production processes for the purpose of protection of life and health of the person, property, environmental protection, and also the prevention of the actions misleading consumers concerning its appointment and safety.".
