1. Approve the enclosed list of some orders of the Ministry of Agriculture of the Republic of Kazakhstan to which changes and additions are made.

2. To provide to department of financial instruments and microcredit of the Ministry of Agriculture of the Republic of Kazakhstan in the procedure established by the legislation:

1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

2) placement of this order on Internet resource of the Ministry of Agriculture of the Republic of Kazakhstan after its official publication.

3. To impose control of execution of this order on the supervising vice-Minister of Agriculture of the Republic of Kazakhstan.

4. This order becomes effective after day of its official publication.

The list of some orders of the Ministry of Agriculture of the Republic of Kazakhstan to which changes and additions are made

1. In the order of the Minister of Agriculture of the Republic of Kazakhstan of January 30, 2015 No. 9-1/71 "About approval of Rules of subsidizing within guaranteeing and loans insurance of subjects of agro-industrial complex" (it is registered in the Register of state registration of regulatory legal acts No. 12183):

in Rules of subsidizing within guaranteeing and loans insurance of the subjects of agro-industrial complex approved by the specified order:

1) of Item 3 to state the subitem in the following edition:

"1) issued by banks, the affiliated organizations, credit partnerships and the microfinancial organizations on investment and replenishment of current assets (including on renewable basis), at the same time the size of current assets constitutes no more than 50 (fifty) percent (further – %) from credit amount;";

2) of Item 3-1 to state the subitem in the following edition:

"2) loan term – no more than 18 (eighteen) months, with possibility of prolongation;";

add with Item 3-2 of the following content:

"3-2. Subsidizing of part of the commission on guarantee is performed on types of activity according to appendix 1 to these rules and according to credit agreements, the corresponding following conditions:

1) issued by creditors on replenishment of current assets;

2) loan term – no more than 18 (eighteen) months, with possibility of prolongation;

3) the rate of remuneration or return rate applied to financing on the Islamic principles in the amount of no more base rate of remuneration established by National Bank of the Republic of Kazakhstan with increase at 7,5 (seven whole five tenth) % per annum;

4) loan currency – tenge;

5) loan repayment – implementation of payments in accordance with the terms of the credit agreement;

6) the maximum amount of the credit is determined by the guarantor based on internal documents of the guarantor;

7) guarantee period – the term exceeding for 4 (four) months of term of the credit agreement with possibility of prolongation;

8) the guarantee size – to 85 (eighty five) % (inclusive) of the amount of principal debt;

9) the guaranteeing commission constitutes no more than 10 (ten) % of the guarantee amount, at the same time one-time subsidizing in the amount of 9,99 (nine whole ninety nine 100-th) % of the amount of guarantee is performed and the borrower pays 0,01 (zero whole one 100-th) % of the guarantee amount.

The guarantor applies method of portfolio guaranteeing according to credit agreements on replenishment of current assets with the conclusion with the creditor of the agreement on portfolio guaranteeing and in accordance with the terms of these rules determines in the agreement maximum amount of the credit and guarantee for the borrower based on internal documents of the guarantor.

The creditor independently, according to the procedure established by internal documents of the creditor considers the application of the borrower on financing.

In case of adoption by the creditor of the positive decision on loan granting on replenishment of current assets with the guarantor's guarantee, the creditor within 5 (five) working days from the date of signing of the credit agreement provides to the guarantor the copy of the credit agreement, the decision of authorized body of the creditor on financing, the document on payment of part of the commission on guarantee according to these rules.

The procedure for drawing of the requirement for guarantee and its execution by the guarantor according to warranty obligations are made by the guarantor according to the agreement on portfolio guaranteeing with observance of the requirements established by these rules.";
