About modification and amendments in some orders of the Minister of Energy of the Republic of Kazakhstan

I ORDER:

1. Approve the list of some orders of the Minister of Energy of the Republic of Kazakhstan to which changes and additions are made (further – the list), according to appendix to this order.

2. To provide to committee of atomic and energy supervision and control of the Department of Energy of the Republic of Kazakhstan in the procedure established by the legislation of the Republic of Kazakhstan:

1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

2) placement of this order on Internet resource of the Department of Energy of the Republic of Kazakhstan after its official publication;

3) within ten working days after state registration of this order in the Ministry of Justice of the Republic of Kazakhstan submission to Department of legal service of the Department of Energy of the Republic of Kazakhstan of data on execution of the actions provided by subitems 1) and 2) of this Item.

3. To impose control of execution of this order on the supervising vice-Minister of Energy of the Republic of Kazakhstan.

4. This order becomes effective after ten calendar days after day of its first official publication, except for Items 1 and 4 of the list which become effective after sixty calendar days after day of its first official publication.

The list of some orders of the Minister of Energy of the Republic of Kazakhstan to which changes and additions are made

1. "1. These rules of obtaining by the power making, power transferring organizations and heatmaking, are developed by the heattransporting subjects of the passport of availability for service during the autumn and winter period (further – Rules) compliance with the subitem 1) of article 10 of the Law of the Republic of Kazakhstan "About the state services" (further – the Law on the state services) and the subitem 250) of Item 15 of the Regulations on the Department of Energy of the Republic of Kazakhstan approved by the order of the Government of the Republic of Kazakhstan of September 19, 2014 No. 994, and determine procedure for rendering the state service "Issue of the Passport of Readiness of the Power Making, Power Transferring Organizations and Heatmaking Heattransporting Subjects to Work during the Autumn and Winter Period" (further – the State service).

2. In these rules the following basic concepts are used:

1) the passport of readiness – annually issued document confirming readiness of the power making, power transferring organizations and heatmaking heattransporting subjects to work during the autumn and winter period;

2) individual system of heat supply – the system of heat supply providing the single consumer with heat energy from autonomous source of heat energy without connection to thermal networks of centralized and local systems of heat supply for needs of heating of the individual apartment house;

3) local system of heat supply – the system of heat supply which is belonging to one physical person or legal entity, or being part of common property of object of condominium and functioning for one or several consumers of heat energy from one or several sources of heat energy on the thermal networks which are not networks of centralized system of heat supply;

4) the system operator – the national company exercising centralized supervisory control, ensuring parallel work with power supply systems of other states, maintenance of balance in single electric utility system of the Republic of Kazakhstan, rendering system services and acquisition of support services at subjects of the wholesale market of electrical energy, and also maintenance and maintenance in operational readiness of national power grid and providing its development;

5) the heatmaking subject – the individual entrepreneur or the legal entity performing activities for production of heat energy according to the Law of the Republic of Kazakhstan "About heat-and-power engineeering";

6) the heattransporting subject – the individual entrepreneur or the legal entity performing activities for transportation and (or) realization of heat energy according to the Law of the Republic of Kazakhstan "About heat-and-power engineeering";

7) the heatconsuming installations – complex of devices, held for use heat energy, the heat carrier for needs of the consumer of heat energy;

8) source of heat energy – the combined heat and power plant, boiler and other devices and (or) installations intended for production of heat energy;

9) the autumn and winter period – heating season which beginning and completion are established by local executive bodies;

10) centralized system of heat supply – system of heat supply from one or several sources of heat energy with transportation of the heat carrier to consumers on thermal networks with the total connected load of consumers exceeding twenty megawatts;

11) the power transferring organization – the organization rendering service in transfer of electrical energy on the basis of agreements;

12) the power making organization – the organization performing production of electrical and (or) heat energy for own needs and (or) realization, except for net - the consumers who are those according to the legislation of the Republic of Kazakhstan in the field of support of use of renewable energy resources.

Other concepts used in these rules are applied according to the legislation of the Republic of Kazakhstan in the fields of power industry and heat-and-power engineeering.";

"Chapter 2. Procedure for receipt of the power making, power transferring organizations and heatmaking heattransporting subjects of the passport of availability for service during the autumn and winter period";

3, of 4, of 5, 6 and 7 to be reworded as follows Items:

"3. Passports of readiness to the power making, power transferring organizations to work during the autumn and winter period (further – the Passport of readiness) with the established electric power over 5 (five) Megawatts (further – MW), and also (hundred ten) kilovolts having power networks of 110 on the balance (further – kV) and above, to the heatmaking subjects (heating boiler rooms over 100 G / кал belonging to centralized systems of heat supply), to the heattransporting subjects (to thermal networks belonging to centralized systems of heat supply) in the regional centers, the capital and the cities of republican value are issued by state body on the state energy supervision and control in forms, according to appendices 1, of 2, of 3, of 4, of 5, of 6, 7 and 8 to these rules.

4. Passports of readiness of sources of heat energy and the thermal networks relating to local systems of heat supply are issued by local executive bodies of the capital and the cities of republican value, areas and cities of regional value (further – Local executive body) in forms, according to appendices 5, of 6, 7 and 8 to these rules.

5. To the power transferring organizations incorporating power networks of 35 (thirty five) kV and below, the power making organizations with the established electric power of 5 (five) MW and less and also the power making organizations using renewable energy resources with the established electric power up to 35 (thirty five) MW inclusive, and also the heatmaking subjects (heating boiler rooms it is lower than 100 G / кал belonging to centralized systems of heat supply), the heattransporting subjects (to thermal networks belonging to centralized systems of heat supply) except for the regional centers and the cities of republican value of the Passport of readiness issue territorial subdivisions of state body on the state energy supervision and control in forms, according to appendices 1, of 2, of 3, of 4, of 5, of 6, 7 and 8 to these rules.

6. Documents acceptance from the power making, power transferring organizations and heatmaking heattransporting subjects (further – Uslugopoluchatel) on receipt of the Passport of readiness is performed annually during the period with 15 on the (fifteenth) of August on the (thirtieth) of September 30 inclusive through the web portal of "the electronic government" www.egov.kz (further – the Portal).

7. The main requirements to rendering the State service are provided in the List of the main requirements to rendering the state service "Issue of the Passport of Readiness of the Power Making, Power Transferring Organizations and Heatmaking Heattransporting Subjects to Work during the Autumn and Winter Period" according to appendix 9 to these rules (further – the List of the main requirements to rendering the state service).";

In case of submission of all necessary documents by Uslugopoluchatel by means of the Portal – in "personal account" of Uslugopoluchatel the status about acceptance of request for rendering the State service with indication of the date of receipt of result of the State service is displayed.

Within 1 (one) working day from the moment of document registration in Uslugodatel's office by the head of the structural unit determines the executive in charge Uslugodatelya.

Within 2 (two) working days the executive in charge checks completeness of the submitted documents.

In case of representation of incomplete document package by Uslugopoluchatel according to the list according to these rules, and (or) documents with the expired effective period, the Service provider refuses reception of an application, in form according to appendix 10 to these rules.

In case of completeness of the submitted documents, the executive in charge Uslugodatelya within 7 (seven) working days performs the analysis of compliance of Uslugopoluchatel to the requirements established by these rules necessary for issue of the Passport of readiness, or availability of the bases for refusal in issue of the Passport of readiness, stipulated in Item 9 Lists of the main requirements to rendering the state service, prepares the corresponding conclusion and introduces this conclusion on approval to the head of the structural unit Uslugodatelya.

Within 1 (one) working day the head of the structural unit approves the conclusion of the executive in charge and this conclusion is submitted for consideration of the commission of the Service provider on consideration of the applications on receipt of the passport of readiness of the power making, power transferring organizations and heatmaking heattransporting subjects to work during the autumn and winter period (further – the Commission of the service provider).";

"21. The commission chairman of the service provider formed by Local executive body designates the responsible person of Local executive body.
