Rules of maintaining the register of persons performing mining of digital currency

1. These rules determine procedure for maintaining the register of persons performing mining of digital currency (further - the register), including introduction in it of data, change of data and exception of data of the register, decision making about refusal in entering into the register of data.

2. The register is kept by the federal executive body determined by the Federal Law "About Digital Financial Assets, Digital Currency and about Modification of Separate Legal Acts of the Russian Federation" (further - the operator of the register), in electronic form.

Maintaining the register includes introduction in it of records, their storage and updating. Number is assigned to each record, and also date of its entering into the register is specified.

3. The data entered in the register are not subject to publication in mass media and to placement on the Internet (further - Internet network).

The information containing in the register is provided to public authorities, other state bodies, courts, the Central bank of the Russian Federation, the territorial network organizations, the system operator of electric utility systems of Russia by means of single system of interdepartmental electronic interaction.

4. The bases for entering of record into the register are:

a) the decision on entering into the register of information about person performing mining of digital currency;

b) the decision on entering into the register of the changes concerning the information about person performing mining of digital currency;

c) the decision on exception of the register of information about person performing mining of digital currency;

d) change of data on the complete and reduced (in the presence) names of the legal entity, surname, name, middle name (in the presence) the individual entrepreneur based on the data containing in the Unified State Register of Legal Entities, the Unified State Register of Private Entrepreneurs.

5. Records are entered in the register by the operator of the register in time no more than one working the day from the date of emergence of the bases, stipulated in Item 4 these rules.

6. Technical mistakes in the records entered in the register improve the operator of the register within 5 working days from the date of their detection by entering into the register of new record with reference to the record containing data in which the technical mistake is made.

7. The register entry about person performing mining of digital currency shall contain the following data:

a) for legal entities - the primary state registration number, identification taxpayer number, the complete and reduced (in the presence) names, for individual entrepreneurs - the primary state registration number of record about state registration as the individual entrepreneur, identification taxpayer number, surname, name, middle name (in the presence);

b) for legal entities - the legal entity or opportunity to control actions of such legal entity (beneficial owner) has the information about the physical person who eventually directly or indirectly (through the third parties) owns (more than 25 percent in the capital have the prevailing participation);

c) concerning the operator of mayningovy infrastructure (in the presence) who is:

the legal entity, - the primary state registration number, identification taxpayer number, the complete and reduced (in the presence) names;

the individual entrepreneur, - the primary state registration number of record about state registration as the individual entrepreneur, identification taxpayer number, surname, name, middle name (in the presence);

d) the points of delivery of electrical energy used concerning technical and the software and hardware used for implementation of mining of digital currency (except as specified when person performs mining of digital currency with involvement of the operator of mayningovy infrastructure);

e) the maximum capacity technical and the software and hardware used for implementation of mining (except as specified when person performs mining of digital currency with involvement of the operator of mayningovy infrastructure);

e) the address of the actual arrangement technical and the software and hardware used for the purposes of mining of digital currency;

g) the name of the territorial network organization to which networks also the software and hardware used for implementation of mining of digital currency is attached technical (except as specified when person performs mining of digital currency with involvement of the operator of mayningovy infrastructure).

8. Entering into the register of information about person performing mining of digital currency is performed based on the statement of this person for entering into the register of information about him (further - the statement for entering into the register of data) represented to the operator of the register in electronic form signed by the strengthened qualified digital signature with use of the official site of the operator of the register to Internet networks.

The application for entering into the register of data can be also submitted by the operator of mayningovy infrastructure in the presence of the corresponding condition in the agreement signed between person performing mining of digital currency and the operator of mayningovy infrastructure, the method specified in paragraph one of this Item.

9. The statement for entering into the register of data shall contain data, stipulated in Item 7 these rules. The documents electronically specified in the statement confirmatory data, provided by subitems "g" and "zh" of Item 7 of these rules, except as specified when person performs mining of digital currency with involvement of the operator of mayningovy infrastructure are enclosed to the application.

10. The operator of the register considers the submitted application for entering into the register of data no more than 15 working days from the date of submission of the statement in time.
