About first-priority measures for reforming of management system migratory processes

For the purpose of increase in process performance of implementation of temporary labor activity abroad, implementations of single vertical management system in this sphere, and also determinations of specific objectives and obligations of responsible state bodies:

1. Agree with offers of the Cabinet of Ministers about:

renaming of the Republican commission on questions of external labor migration into the Republican commission on migration and statement of its updated structure according to appendix No. 1;

the termination of activities of the Agency of external labor migration under the Ministry of employment and reducing poverty and formation of the Agency of migration under the Cabinet of Ministers (further - the Agency);

to transfer to the Agency of Fund of support and protection of the rights and interests of the citizens performing labor activity abroad and education on its base of Fund of migration (further - Fund) without the status of the legal entity.

2. Approve:

The main activities of the Agency of migration according to appendix No. 2;

Organizational structure of the Agency of migration according to appendix No. 3;

Sources of forming and the direction of use of fund of migration according to appendix No. 4;

Sources of forming and the direction of use of means of the Agency of migration according to appendix No. 5.

3. Determine that:

The agency is the authorized republican executive body realizing state policy in the sphere of implementation of external labor migration, coordinating activities of state bodies and rendering the state services in this sphere;

Agency accountably directly to the Cabinet of Ministers and Republican commission on migration;

The agency is legal successor by the rights and obligations of the Agency of external labor migration and Fund of support and protection of the rights and interests of the citizens performing labor activity abroad;

all tax benefits which are earlier provided to the Agency of external labor migration remain for the Agency.

4. Transfer to the Agency:

tasks and the functions of the Ministry of employment and reducing poverty connected with regulation of employment relationships abroad and also its rights and the obligation according to the international and interdepartmental documents;

established posts, means and property of the Agency of external labor migration, its regional branches, representations abroad and representatives, and also Fund of support and protection of the rights and interests of the citizens performing labor activity abroad.

Establish the general number of staff of managerial personnel of the Agency (except for representations abroad and representatives) in number of 117 units.

5. Since January 1, 2025:

permit the Agency to hold the control events connected with check of activities of private employment agencies with the notification of the Representative for protection of the rights and legitimate interests of subjects of entrepreneurship;

assign obligation to the Agency to place in five-day time in electronic program complex of labor migration "Xorijda ish" the protocols constituted by results of any performed by it, and also data on quantity and characteristics of the elicited facts of violation of the law by each checked subject.

6. Determine that the director of the Agency:

each six months reports to the Republican commission on migration on activities of the Agency and Fund, the carried-out work and system problems in the sphere of external labor migration, and also solutions of these problems;

bears the personal responsibility for the proper and effective organization of work of the Agency and the organizations of its system, orientation of their activities to effectiveness, and also unconditional and complete achievement of the established target indicators in this direction.

7. Grant to the director of the Agency the following rights:

distribute tasks and functions between deputy directors of the Agency;

make changes to structures of central office of the Agency, its regional branches, representations abroad within the established general number of staff of managerial personnel and the salary fund;

approve structures of the Agency, its regional branches, representations abroad, to appoint to position, to dismiss and encourage their workers;

in case of urgent cases in coordination with the Republican commission on migration (A. Aripov) - quickly to make changes to parameters of use of fund or to allocate fund for financing of the expenses which are not provided in appendix No. 4 to this Decree.

8. Determine that the Agency for accomplishment of the tasks assigned to it has the right:

request and receive from state bodies and the organizations statistical, analytical materials, the conclusions and other information concerning the questions entering competence of the Agency;

involve highly qualified specialists and experts of state bodies and other organizations, the leading design institutes, scientific and educational institutions, the international organizations, the foreign companies, including on contractual basis;

announce initiatives and make offers on providing the rights and legitimate interests of the citizens performing temporary labor activity abroad and also to enhancement of this sphere.

9. Provide to the Republican commission on migration (A. Aripov) the following rights:

form and abolish representations abroad of the Agency, open and reduce established posts for representatives of the Agency;

make offers on introduction and abolition of diplomatic positions on labor migration in diplomatic organizations of the Republic of Uzbekistan abroad.

10. Place the Agency in buildings and constructions, at the address: the city of Tashkent, Almazarsky district, Ulitsa Kamarniso, the house 1, on the basis of the right of free use.

11. Make changes and additions to some acts of the President of the Republic of Uzbekistan and the Government of the Republic of Uzbekistan according to appendix No. 6.

12. To the Cabinet of Ministers:

in week time to introduce to Administration of the President of the Republic of Uzbekistan the draft of the resolution of the President of the Republic of Uzbekistan providing regulation of processes of implementation of temporary labor activity abroad, broad involvement of representatives of private sector in this sphere and creation of optimum conditions for citizens;

in three-months time to approve updated regulations on the Agency and Fund.

13. To the agency together with the interested ministries and departments in three-months time to make in the Cabinet of Ministers offers on the changes and amendments in acts of the legislation following from this Decree.

14. Assign to the director of the Agency of migration B. A. Musayev the personal responsibility for the effective organization of execution of this Decree.
