1. Approve the enclosed Rules of inclusion in the state accounting of minerals of data on quantity and quality of the main and together with them the lying minerals.

2. This resolution becomes effective after ten calendar days after day of its first official publication.

Rules of inclusion in the state accounting of minerals of data on quantity and quality of the main and together with them the lying minerals

Chapter 1. General provisions

1. These rules of inclusion in the state accounting of minerals of data on quantity and quality of the main and together with them the lying minerals are developed according to Item 8 of article 72 of the Code of the Republic of Kazakhstan "About subsoil and subsurface use" (further - the Code) and determine procedure for inclusion in the state accounting of minerals of data on quantity and quality of the main and together with them the lying minerals.

2. In these rules the following terms and determinations are applied:

1) the author's reference - the short data on the main contents of the report prepared by authors of reports;

2) state commission on inventories - the collegiate organ created under authorized body on studying of subsoil and performing state examination of subsoil on hydrocarbons and solid minerals;

3) state commission (subcommittee) on examination of subsoil - the collegiate organ created under authorized body on studying of subsoil and performing state examination of subsoil on underground waters;

4) the competent person - the physical person which is the member of the professional organization provided by the Kazakhstan code of the public reporting on results of exploration works, mineral resources and mineral inventories (the Code of KAZRC) (further - the Code of KAZRC), according to its rules (the competent person the physical person which is the member of the foreign professional organization recognized by that Kazakhstan professional organization for the purposes of the Code of KAZRC is also recognized);

5) the valuation report of resources and inventories of solid minerals - the report prepared by the competent person according to the Code of KAZRC;

6) the report on calculation (operational calculation) of geological inventories - the report constituted according to normative and technical documents, approved by authorized body in the field of studying of subsoil;

7) the report on stock counting of solid minerals - the report constituted according to the instruction for stock counting of minerals, approved by authorized body in the field of studying of subsoil;

8) the reader - the member of the acknowledged professional organization provided by the Code of KAZRC, KAZRC attracted to check of compliance of the report to requirements of the Code.

3. The state accounting of minerals contains data on mineral deposits, quantity and quality of the main and together with them the lying minerals containing in them components, mining, hydrogeological, ecological and other characteristics of the field having industrial value, their placement, degree of study, extent of industrial development, production, losses and security of the industry with minerals, and also changes in assessment of resources and inventories of minerals for accounting year as a result of their production or revaluation of resources and (or) inventories of minerals

4. Inclusion in the state accounting of minerals of data on quantity and quality of the main and together with them the lying minerals is performed:

under the contracts for production signed or the licenses for production of solid minerals granted till December 31, 2023 - by results of the state examination of subsoil which is carried out by state commission on inventories of minerals, the interregional commission on inventories (regarding popular minerals) with involvement of the independent experts having special knowledge in the field of geology and subsurface use and who are not interested in results of examination or based on the valuation report of resources and (or) inventories of solid minerals prepared by the competent person according to the Code of KAZRC;

according to the licenses for production of solid minerals granted after December 31, 2023 and also licenses or contracts for investigation of solid minerals - according to the valuation report of resources and (or) inventories of solid minerals prepared by the competent person according to the Code of KAZRC;

under contracts for exploration and production of hydrocarbons - by results of the state examination of subsoil which is carried out by state commission on inventories of minerals till January 1, 2026 since January 1, 2026 by results of examination of the central commission on inventories of hydrocarbons of the Republic of Kazakhstan, with involvement of the independent experts having special knowledge in the field of geology and subsurface use and who are not interested in results of examination;

on search and estimative works on underground waters with operational inventories more than one thousand cubic meters per day, and also mineral, industrial, heat power waters regardless of amount of operational inventories - by results of the state examination of subsoil which is carried out by state commission on examination of subsoil with involvement of the independent experts having special knowledge in the field of geology and subsurface use and who are not interested in results of examination;

on search and estimative works on underground waters with operational inventories to one thousand cubic meters per day - by results of the state examination of subsoil which is carried out by subcommittees of state commission on examination of subsoil with involvement of the independent experts having special knowledge in the field of geology and subsurface use and who are not interested in results of examination.

5. Inclusion of data on quantity and quality of the main and together with them the lying minerals is performed for the purpose of the state stock accounting and resources of minerals of the Republic of Kazakhstan following the results of consideration of the report.

Chapter 2. Procedure for inclusion of solid minerals in the state accounting of minerals according to standards of the Code of KAZRC

6. Inclusion in the state accounting of minerals according to standards of the Code of KAZRC is performed according to the application of subsoil users which is submitted in a free form in authorized body on studying of subsoil in paper and (or) electronic type.
