2) placement of this order on Internet resource of the Ministry of Culture and information of the Republic of Kazakhstan after its official publication;

3) within ten working days after state registration of this order in the Ministry of Justice of the Republic of Kazakhstan submission to Legal department of the Ministry of Culture and information of the Republic of Kazakhstan of data on execution of the actions provided by subitems 1) and 2) of this Item.

4. To impose control of execution of this order on the supervising vice-Minister of Culture and Information of the Republic of Kazakhstan.

5. This order becomes effective after ten calendar days after day of its first official publication.

Rules of transition to digital on-air TV and radio broadcasting

Chapter 1. General provisions

1. These rules of transition to digital on-air TV and radio broadcasting (further - Rules) are developed according to Item 2 of article 69 of the Law of the Republic of Kazakhstan "About mass media" (further - the Law) and determine procedure for transition to digital on-air TV and radio broadcasting.

2. In these rules the following concepts are used:

1) authorized body in the field of mass media (further - authorized body) - the central executive body performing state regulation in the field of mass media;

2) set-top subscriber box (further - prefix) - the separate technical tool intended for acceptance by the subscriber digital TV, radio signal;

3) the operator of TV and radio broadcasting - the physical person or legal entity which obtained the license for occupation activities for distribution TV, radio channels;

4) the national operator of TV and radio broadcasting (further - the national operator) - the legal entity determined by the Government of the Republic of Kazakhstan with the absolute packet of the share belonging to the state to which tasks on content and development of national network of TV and radio broadcasting according to article 44 of the Law are assigned.

3. Analog on-air TV and radio broadcasting (further - AETV) represents system of distribution TV, radio channels with use of analog methods of processing of signal.

4. Digital on-air TV and radio broadcasting (further - TsETV) represents system of distribution TV, radio channels by means of land transmitting stations with use of technique of digitization (compression) of original signal.

Chapter 2. Procedure for transition to digital on-air TV and radio broadcasting

5. The procedure for transition to TsETV is performed by step-by-step shutdown of the analog transferring funds for AETV networks on administrative and territorial units according to the terms determined by authorized body according to Item 2 of article 69 of the Law (further - terms).

6. Shutdown of the analog transferring funds for AETV networks is carried out by the national operator and operators of TV and radio broadcasting according to terms.

7. Shutdown of the analog transferring funds for AETV networks on administrative and territorial units is carried out when commissioning the TsETV network providing distribution of signals of TsETV in the territory of administrative and territorial unit.

8. The national operator represents data to the authorized body and local executive bodies of areas, cities of republican value and the capital (further - MIO) exercising within the competence local public administration and self-government in the corresponding territory about terms of commissioning of the TsETV radio television stations and the territory of covering of TsETV by settlements, at least in three months prior to commissioning of the TsETV radio television stations.

9. MIO before transition to TsETV will organize providing the physical persons who are receivers of the government address public assistance, set-top subscriber boxes according to Item 7 of article 69 of the Law.

10. The authorized body a month before completion of each stage of shutdown of AETV according to terms requests information on completion of ensuring the government address public assistance with prefixes of receivers in MIO.

11. After transition to TsETV of permission to use of radio-frequency range and the license for occupation activities for distribution TV, radio channels, issued to TV channels in case of analog TV and radio broadcasting, except for analog bands of frequencies, radio frequencies (radio-frequency channels), in the territory of administrative and territorial units which are not covered by TsETV stop the actions according to Item 5 of article 69 of the Law.

Distribution TV, radio channels on TsETV network is performed according to the established rates based on the signed agreements between broadcasting companies and operators of TV and radio broadcasting.

12. In six months prior to transition to TsETV according to terms of MIO carries out information and explanatory work with the population concerning procedure and terms of transition to TsETV with involvement of regional and/or republican mass media.

The procedure and terms of transition to TsETV are placed on official Internet resources of authorized body, national operator and MIO.

13. Information illumination of questions of transition to TsETV in mass media, including on official Internet resources, covers the following information:

1) benefit of TsETV before AETV;

2) procedure and terms of transition to TsETV;
